<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaa5a1661-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc"><num value="2000cc">§ 2000cc.</num><heading> Protection of land use as religious exercise</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa5a1662-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a"><num value="a" class="bold">(a)</num><heading class="bold"> Substantial burdens</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa5a1663-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> General rule</heading><chapeau style="-uslm-lc:I12" class="indent1">No government shall impose or implement a land use regulation in a manner that imposes a substantial burden on the religious exercise of a person, including a religious assembly or institution, unless the government demonstrates that imposition of the burden on that person, assembly, or institution—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a1664-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/1/A"><num value="A">(A)</num><content> is in furtherance of a compelling governmental interest; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a1665-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/1/B"><num value="B">(B)</num><content> is the least restrictive means of furthering that compelling governmental interest.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa5a1666-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Scope of application</heading><chapeau style="-uslm-lc:I12" class="indent1">This subsection applies in any case in which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a1667-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/2/A"><num value="A">(A)</num><content> the substantial burden is imposed in a program or activity that receives Federal financial assistance, even if the burden results from a rule of general applicability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a1668-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/2/B"><num value="B">(B)</num><content> the substantial burden affects, or removal of that substantial burden would affect, commerce with foreign nations, among the several States, or with Indian tribes, even if the burden results from a rule of general applicability; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a1669-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/a/2/C"><num value="C">(C)</num><content> the substantial burden is imposed in the implementation of a land use regulation or system of land use regulations, under which a government makes, or has in place formal or informal procedures or practices that permit the government to make, individualized assessments of the proposed uses for the property involved.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa5a166a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b"><num value="b" class="bold">(b)</num><heading class="bold"> Discrimination and exclusion</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa5a166b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Equal terms</heading><content><p style="-uslm-lc:I12" class="indent1">No government shall impose or implement a land use regulation in a manner that treats a religious assembly or institution on less than equal terms with a nonreligious assembly or institution.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa5a3d7c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Nondiscrimination</heading><content><p style="-uslm-lc:I12" class="indent1">No government shall impose or implement a land use regulation that discriminates against any assembly or institution on the basis of religion or religious denomination.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa5a3d7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Exclusions and limits</heading><chapeau style="-uslm-lc:I12" class="indent1">No government shall impose or implement a land use regulation that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a3d7e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b/3/A"><num value="A">(A)</num><content> totally excludes religious assemblies from a jurisdiction; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa5a3d7f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2000cc/b/3/B"><num value="B">(B)</num><content> unreasonably limits religious assemblies, institutions, or structures within a jurisdiction.</content>
