<chapeau style="-uslm-lc:I11" class="indent0">For purposes of sections 2021b to 2021j of this title:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Agreement State</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “agreement State” means a State that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa67d1b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/1/A"><num value="A">(A)</num><content> has entered into an agreement with the Nuclear Regulatory Commission under <ref href="/us/usc/t42/s2021">section 2021 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa67d1b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/1/B"><num value="B">(B)</num><content> has authority to regulate the disposal of low-level radioactive waste under such agreement.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Allocation</heading><content><p style="-uslm-lc:I12" class="indent1">The term “allocation” means the assignment of a specific amount of low-level radioactive waste disposal capacity to a commercial nuclear power reactor for which access is required to be provided by sited States subject to the conditions specified under sections 2021b to 2021j of this title.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Commercial nuclear power reactor</heading><content><p style="-uslm-lc:I12" class="indent1">The term “commercial nuclear power reactor” means any unit of a civilian light-water moderated utilization facility required to be licensed under section 2133 or 2134(b) of this title.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Compact</heading><content><p style="-uslm-lc:I12" class="indent1">The term “compact” means a compact entered into by two or more States pursuant to sections 2021b to 2021j of this title.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Compact commission</heading><content><p style="-uslm-lc:I12" class="indent1">The term “compact commission” means the regional commission, committee, or board established in a compact to administer such compact.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Compact region</heading><content><p style="-uslm-lc:I12" class="indent1">The term “compact region” means the area consisting of all States that are members of a compact.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/7"><num value="7" class="bold">(7)</num><heading class="bold"> Disposal</heading><content><p style="-uslm-lc:I12" class="indent1">The term “disposal” means the permanent isolation of low-level radioactive waste pursuant to the requirements established by the Nuclear Regulatory Commission under applicable laws, or by an agreement State if such isolation occurs in such agreement State.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/8"><num value="8" class="bold">(8)</num><heading class="bold"> Generate</heading><content><p style="-uslm-lc:I12" class="indent1">The term “generate”, when used in relation to low-level radioactive waste, means to produce low-level radioactive waste.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67d1c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/9"><num value="9" class="bold">(9)</num><heading class="bold"> Low-level radioactive waste</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa67d1c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/9/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “low-level radioactive waste” means radioactive material that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaa67d1c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/9/A/i"><num value="i">(i)</num><content> is not high-level radioactive waste, spent nuclear fuel, or byproduct material (as defined in <ref href="/us/usc/t42/s2014/e/2">section 2014(e)(2) of this title</ref>); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaa67d1c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/9/A/ii"><num value="ii">(ii)</num><content> the Nuclear Regulatory Commission, consistent with existing law and in accordance with paragraph (A), classifies as low-level radioactive waste.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa67f8d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/9/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusion</heading><content><p style="-uslm-lc:I13" class="indent2">The term “low-level radioactive waste” does not include byproduct material (as defined in paragraphs (3) and (4) of <ref href="/us/usc/t42/s2014/e">section 2014(e) of this title</ref>).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67f8d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/10"><num value="10" class="bold">(10)</num><heading class="bold"> Non-sited compact region</heading><content><p style="-uslm-lc:I12" class="indent1">The term “non-sited compact region” means any compact region that is not a sited compact region.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67f8d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/11"><num value="11" class="bold">(11)</num><heading class="bold"> Regional disposal facility</heading><content><p style="-uslm-lc:I12" class="indent1">The term “regional disposal facility” means a non-Federal low-level radioactive waste disposal facility in operation on <date date="1985-01-01">January 1, 1985</date>, or subsequently established and operated under a compact.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa67f8d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021b/12"><num value="12" class="bold">(12)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Energy.</p>
