<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id07f7f93e-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c"><num value="2021c">§ 2021c.</num><heading> Responsibilities for disposal of low-level radioactive waste</heading><subsection style="-uslm-lc:I11" class="indent0" id="id07f7f93f-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f940-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1"><num value="1">(1)</num><chapeau> Each State shall be responsible for providing, either by itself or in cooperation with other States, for the disposal of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f941-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/A"><num value="A">(A)</num><content> low-level radioactive waste generated within the State (other than by the Federal Government) that consists of or contains class A, B, or C radioactive waste as defined by section 61.55 of title 10, Code of Federal Regulations, as in effect on <date date="1983-01-26">January 26, 1983</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f942-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/B"><num value="B">(B)</num><chapeau> low-level radioactive waste described in subparagraph (A) that is generated by the Federal Government except such waste that is—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id07f7f943-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/B/i"><num value="i">(i)</num><content> owned or generated by the Department of Energy;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id07f7f944-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/B/ii"><num value="ii">(ii)</num><content> owned or generated by the United States Navy as a result of the decommissioning of vessels of the United States Navy; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id07f7f945-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/B/iii"><num value="iii">(iii)</num><content> owned or generated as a result of any research, development, testing, or production of any atomic weapon; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f946-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/1/C"><num value="C">(C)</num><content> low-level radioactive waste described in subparagraphs (A) and (B) that is generated outside of the State and accepted for disposal in accordance with sections <ref class="footnoteRef" idref="fn003184">1</ref><note type="footnote" id="fn003184"><num>1</num> So in original. Probably should be “section”.</note> 2021e or 2021f of this title.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f947-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/2"><num value="2">(2)</num><chapeau> No regional disposal facility may be required to accept for disposal any material—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f948-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/2/A"><num value="A">(A)</num><content> that is not low-level radioactive waste as defined by section 61.55 of title 10, Code of Federal Regulations, as in effect on <date date="1983-01-26">January 26, 1983</date>, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f949-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/a/2/B"><num value="B">(B)</num><content> identified under the Formerly Utilized Sites Remedial Action Program.</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Nothing in this paragraph shall be deemed to prohibit a State, subject to the provisions of its compact, or a compact region from accepting for disposal any material identified in subparagraph (A) or (B).</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id07f7f94a-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f94b-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/1"><num value="1">(1)</num><chapeau> The Federal Government shall be responsible for the disposal of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f94c-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/1/A"><num value="A">(A)</num><content> low-level radioactive waste owned or generated by the Department of Energy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f94d-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/1/B"><num value="B">(B)</num><content> low-level radioactive waste owned or generated by the United States Navy as a result of the decommissioning of vessels of the United States Navy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f94e-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/1/C"><num value="C">(C)</num><content> low-level radioactive waste owned or generated by the Federal Government as a result of any research, development, testing, or production of any atomic weapon; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f94f-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/1/D"><num value="D">(D)</num><content> any other low-level radioactive waste with concentrations of radionuclides that exceed the limits established by the Commission for class C radioactive waste, as defined by section 61.55 of title 10, Code of Federal Regulations, as in effect on <date date="1983-01-26">January 26, 1983</date>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f950-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/2"><num value="2">(2)</num><content> All radioactive waste designated a Federal responsibility pursuant to subparagraph (b)(1)(D) that results from activities licensed by the Nuclear Regulatory Commission under the Atomic Energy Act of 1954, as amended, shall be disposed of in a facility licensed by the Nuclear Regulatory Commission that the Commission determines is adequate to protect the public health and safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f951-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3"><num value="3">(3)</num><chapeau> Not later than 12 months after <date date="1986-01-15">January 15, 1986</date>, the Secretary shall submit to the Congress a comprehensive report setting forth the recommendations of the Secretary for ensuring the safe disposal of all radioactive waste designated a Federal responsibility pursuant to subparagraph (b)(1)(D). Such report shall include—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f952-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/A"><num value="A">(A)</num><content> an identification of the radioactive waste involved, including the source of such waste, and the volume, concentration, and other relevant characteristics of such waste;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f953-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/B"><num value="B">(B)</num><content> an identification of the Federal and non-Federal options for disposal of such radioactive waste;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f954-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/C"><num value="C">(C)</num><content> a description of the actions proposed to ensure the safe disposal of such radioactive waste;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f955-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/D"><num value="D">(D)</num><content> a description of the projected costs of undertaking such actions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f956-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/E"><num value="E">(E)</num><content> an identification of the options for ensuring that the beneficiaries of the activities resulting in the generation of such radioactive wastes bear all reasonable costs of disposing of such wastes; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07f7f957-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/3/F"><num value="F">(F)</num><content> an identification of any statutory authority required for disposal of such waste.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id07f7f958-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s2021c/b/4"><num value="4">(4)</num><content> The Secretary may not dispose of any radioactive waste designated a Federal responsibility pursuant to paragraph (b)(1)(D) that becomes a Federal responsibility for the first time pursuant to such paragraph until ninety days after the report prepared pursuant to paragraph (3) has been submitted to the Congress.</content>
