<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa684725-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Interstate compacts</heading><content><p style="-uslm-lc:I12" class="indent1">To carry out the policy set forth in paragraph (1), the States may enter into such compacts as may be necessary to provide for the establishment and operation of regional disposal facilities for low-level radioactive waste.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa684726-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Applicability to Federal activities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa684727-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa684728-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Activities of the Secretary</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), no compact or action taken under a compact shall be applicable to the transportation, management, or disposal of any low-level radioactive waste designated in section 2021c(a)(1)(B)(i)–(iii) of this title.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa684729-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Federal low-level radioactive waste disposed of at non-Federal facilities</heading><content><p style="-uslm-lc:I13" class="indent2">Low-level radioactive waste owned or generated by the Federal Government that is disposed of at a regional disposal facility or non-Federal disposal facility within a State that is not a member of a compact shall be subject to the same conditions, regulations, requirements, fees, taxes, and surcharges imposed by the compact commission, and by the State in which such facility is located, in the same manner and to the same extent as any low-level radioactive waste not generated by the Federal Government.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa68472a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Federal low-level radioactive waste disposal facilities</heading><content><p style="-uslm-lc:I12" class="indent1">Any low-level radioactive waste disposal facility established or operated exclusively for the disposal of low-level radioactive waste owned or generated by the Federal Government shall not be subject to any compact or any action taken under a compact.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa686e3b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Effect of compacts on Federal law</heading><chapeau style="-uslm-lc:I12" class="indent1">Nothing contained in sections 2021b to 2021j of this title or any compact may be construed to confer any new authority on any compact commission or State—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa686e3c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3/A"><num value="A">(A)</num><content> to regulate the packaging, generation, treatment, storage, disposal, or transportation of low-level radioactive waste in a manner incompatible with the regulations of the Nuclear Regulatory Commission or inconsistent with the regulations of the Department of Transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa686e3d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3/B"><num value="B">(B)</num><content> to regulate health, safety, or environmental hazards from source material, byproduct material, or special nuclear material;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa686e3e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3/C"><num value="C">(C)</num><content> to inspect the facilities of licensees of the Nuclear Regulatory Commission;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa686e3f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3/D"><num value="D">(D)</num><content> to inspect security areas or operations at the site of the generation of any low-level radioactive waste by the Federal Government, or to inspect classified information related to such areas or operations; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa686e40-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/3/E"><num value="E">(E)</num><content> to require indemnification pursuant to the provisions of chapter 171 of title 28 (commonly referred to as the Federal Tort Claims Act), or <ref href="/us/usc/t42/s2210">section 2210 of this title</ref>, whichever is applicable.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa686e41-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Federal authority</heading><content><p style="-uslm-lc:I12" class="indent1">Except as expressly provided in sections 2021b to 2021j of this title, nothing contained in sections 2021b to 2021j of this title or any compact may be construed to limit the applicability of any Federal law or to diminish or otherwise impair the jurisdiction of any Federal agency, or to alter, amend, or otherwise affect any Federal law governing the judicial review of any action taken pursuant to any compact.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa686e43-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Restricted use of regional disposal facilities</heading><chapeau style="-uslm-lc:I11" class="indent0">Any authority in a compact to restrict the use of the regional disposal facilities under the compact to the disposal of low-level radioactive waste generated within the compact region shall not take effect before each of the following occurs:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa686e44-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/c/1"><num value="1">(1)</num><content> <date date="1986-01-01">January 1, 1986</date>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa686e45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2021d/c/2"><num value="2">(2)</num><content> the Congress by law consents to the compact.</content>

<section style="-uslm-lc:I580467"><num value="213">“SEC. 213.</num><heading> CONGRESSIONAL REVIEW.</heading><content><p style="-uslm-lc:I21" class="indent0">“The Congress may alter, amend, or repeal this Act with respect to any compact set forth in subtitle B after the expiration of the 10-year period following the date of the enactment of this Act [<date date="1986-01-15">Jan. 15, 1986</date>], and at such intervals thereafter as may be provided in such compact.</p>
