<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida3b61b4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a"><num value="204a">§ 204a.</num><heading> Deployment readiness</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida3b61b4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Readiness requirements for Commissioned Corps officers</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida3b61b4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary, with respect to members of the following Corps components, shall establish requirements, including training and medical examinations, to ensure the readiness of such components to respond to urgent or emergency public health care needs that cannot otherwise be met at the Federal, State, and local levels:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b61b50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/1/A"><num value="A">(A)</num><content> Active duty Regular Corps.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b61b51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/1/B"><num value="B">(B)</num><content> Ready Reserve Corps.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida3b64262-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Annual assessment of members</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall annually determine whether each member of the Corps meets the applicable readiness requirements established under paragraph (1).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida3b64263-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Failure to meet requirements</heading><content><p style="-uslm-lc:I12" class="indent1">A member of the Corps who fails to meet or maintain the readiness requirements established under paragraph (1) or who fails to comply with orders to respond to an urgent or emergency public health care need shall, except as provided in paragraph (4), in accordance with procedures established by the Secretary, be subject to disciplinary action as prescribed by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida3b64264-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Waiver of requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida3b64265-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary may waive one or more of the requirements established under paragraph (1) for an individual who is not able to meet such requirements because of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida3b64266-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4/A/i"><num value="i">(i)</num><content> a disability;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida3b64267-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4/A/ii"><num value="ii">(ii)</num><content> a temporary medical condition; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida3b64268-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4/A/iii"><num value="iii">(iii)</num><content> any other extraordinary limitation as determined by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida3b66979-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall promulgate regulations under which a waiver described in subparagraph (A) may be granted.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida3b6697a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Urgent or emergency public health care need</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of this section and <ref href="/us/usc/t42/s215">section 215 of this title</ref>, the term “urgent or emergency public health care need” means a health care need, as determined by the Secretary, arising as the result of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b6697b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/5/A"><num value="A">(A)</num><content> a national emergency declared by the President under the National Emergencies Act (<ref href="/us/usc/t50/s1601">50 U.S.C. 1601</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b6697c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/5/B"><num value="B">(B)</num><content> an emergency or major disaster declared by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121">42 U.S.C. 5121</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b6697d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/5/C"><num value="C">(C)</num><content> a public health emergency declared by the Secretary under <ref href="/us/usc/t42/s247d">section 247d of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b6697e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/a/5/D"><num value="D">(D)</num><content> any emergency that, in the judgment of the Secretary, is appropriate for the deployment of members of the Corps.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida3b6697f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Corps management for deployment</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida3b66980-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/1"><num value="1">(1)</num><content> organize members of the Corps into units for rapid deployment by the Secretary to respond to urgent or emergency public health care needs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida3b69091-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/2"><num value="2">(2)</num><content> establish appropriate procedures for the command and control of units or individual members of the Corps that are deployed at the direction of the President or the Secretary in response to an urgent or emergency public health care need of national, State or local significance;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida3b69092-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/3"><num value="3">(3)</num><content> ensure that members of the Corps are trained, equipped and otherwise prepared to fulfill their public health and emergency response roles; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida3b69093-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/4"><num value="4">(4)</num><chapeau> ensure that deployment planning takes into account—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b69094-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/4/A"><num value="A">(A)</num><content> any deployment exemptions that may be granted by the Secretary based on the unique requirements of an agency and an individual’s functional role in such agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida3b69095-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/b/4/B"><num value="B">(B)</num><content> the nature of the urgent or emergency public health care need.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida3b69096-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s204a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Deployment of detailed or assigned officers</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of pay, allowances, and benefits of a Commissioned Corps officer who is detailed or assigned to a Federal entity, the deployment of such officer by the Secretary in response to an urgent or emergency public health care need shall be deemed to be an authorized activity of the Federal entity to which the officer is detailed or assigned.</p>
