<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaa6f99eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a"><num value="2077a">§ 2077a.</num><heading> Interagency review of applications for the transfer of United States civil nuclear technology</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6f99ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Report on transfers to covered foreign countries</heading><chapeau style="-uslm-lc:I11" class="indent0">Not less frequently than every 90 days, the Secretary of Energy shall submit to the appropriate congressional committees a report that includes—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa6f99ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/a/1"><num value="1">(1)</num><content> a description of the authorizations under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> to transfer United States civil nuclear technology to a covered foreign country during the preceding 90 days; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa6f99ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/a/2"><num value="2">(2)</num><content> a statement of whether any agency required to be consulted under that section or pursuant to regulation objected to or sought conditions on each such transfer.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6f99ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Determination of technologies to be protected</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6f99f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 90 days after <date date="2015-11-25">November 25, 2015</date>, and every five years thereafter, the Secretary of Energy shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6f99f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/1/A"><num value="A">(A)</num><content> in consultation with the Secretary of State, the Secretary of Commerce, the Secretary of Defense, the Director of National Intelligence, and the Nuclear Regulatory Commission, determine the critical United States civil nuclear technologies that should be protected from diversion to a military program of a covered foreign country, including with respect to a naval propulsion or weapons program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6f99f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/1/B"><num value="B">(B)</num><content> notify the appropriate congressional committees with respect to the determination and the technologies covered by the determination.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6f99f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Notification</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa6f99f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), not later than 14 days before making an authorization under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> for the transfer of a technology covered by a determination under paragraph (1) to a covered foreign country, the Secretary of Energy shall submit to the appropriate congressional committees a report that includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaa6f99f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/A/i"><num value="i">(i)</num><content> a notification of the intention of the Secretary to make the authorization for the transfer of such technology; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaa6f99f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/A/ii"><num value="ii">(ii)</num><content> a statement of whether any agency required to be consulted under such <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> or pursuant to regulation objected to or sought conditions on the transfer.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaa6f99f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Waiver of deadline</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary may waive the requirement under subparagraph (A) to submit the report required by that subparagraph not later than 14 days before making an authorization for the transfer of a technology covered by a determination under paragraph (1) to a covered foreign country if the Secretary—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaa6f99f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B/i"><num value="i">(i)</num><content> determines that an imminent radiological hazard exists; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaa6f99f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B/ii"><num value="ii">(ii)</num><chapeau> not later than 7 days after determining that such hazard exists, submits to the appropriate congressional committees—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idaa6f99fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B/ii/I"><num value="I">(I)</num><content> a certification that the hazard exists;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idaa6f99fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B/ii/II"><num value="II">(II)</num><content> a justification for the waiver; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idaa6f99fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/b/2/B/ii/III"><num value="III">(III)</num><content> the notification required by clause (i) of subparagraph (A) and the statement required by clause (ii) of that subparagraph.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6f99fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Consultations with intelligence community</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6f99fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary of Energy shall expeditiously revise part 810 of title 10, Code of Federal Regulations, to ensure that the Director of National Intelligence—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6f99ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/c/1/A"><num value="A">(A)</num><content> is consulted with respect to the views of the intelligence community (as defined in <ref href="/us/usc/t50/s3003/4">section 3003(4) of title 50</ref>) with respect to each authorization issued under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> for the transfer of United States civil nuclear technology to a covered foreign country before the determination to approve or disapprove the request for the authorization; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc110-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/c/1/B"><num value="B">(B)</num><content> is provided with an opportunity to present the views of the Director and the intelligence community on the national security risks of the transfer, if any.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fc111-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Submission to Congress</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary of Energy, jointly with the Director of National Intelligence, shall include the results of consultations conducted under paragraph (1) in each report under subsection (a) and each notification under subsection (b)(2).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fc112-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Report on compliance of covered foreign countries and end-users</heading><chapeau style="-uslm-lc:I11" class="indent0">Not less frequently than annually, the Secretary of Energy shall submit to the appropriate congressional committees a report that includes—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fc113-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/1"><num value="1">(1)</num><content> an assessment of whether each covered foreign country is in compliance with its obligations under any authorization for the transfer of United States civil nuclear technology under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fc114-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/2"><num value="2">(2)</num><chapeau> with respect to any covered foreign country that is not in compliance with such obligations—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc115-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/2/A"><num value="A">(A)</num><content> a description the efforts of the United States to bring the country into compliance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc116-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/2/B"><num value="B">(B)</num><content> an evaluation of the result of such efforts; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc117-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/2/C"><num value="C">(C)</num><content> an assessment of the options available to the Secretary as a result of the country not being in compliance;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fc118-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/3"><num value="3">(3)</num><content> an assessment of whether each end-user to which United States civil nuclear technology is transferred pursuant to an authorization under such <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> is in compliance with the obligations of the end-user under that authorization; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fc119-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/d/4"><num value="4">(4)</num><content> a description of any consequences for the end-user or the exporter of the technology if the end-user is not in compliance with such obligations.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fc11a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Report on transfers to all foreign countries</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fc11b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Concurrent with the submission to Congress of the budget of the President for a fiscal year under <ref href="/us/usc/t31/s1105/a">section 1105(a) of title 31</ref>, the Secretary of Energy shall submit to the appropriate congressional committees a report on the activities of the Department of Energy associated with the review of applications for authorization under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> to transfer United States civil nuclear technology to any foreign country.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fc11c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Elements</heading><chapeau style="-uslm-lc:I12" class="indent1">The report required by paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc11d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2/A"><num value="A">(A)</num><content> the number of applications for authorization under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> to transfer United States civil nuclear technology to a foreign country submitted during the year preceding the submission of the report;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc11e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2/B"><num value="B">(B)</num><content> the length of time each such application was under review;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc11f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2/C"><num value="C">(C)</num><content> for each such application, an identification of any officer to which the authorization under such <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref> was delegated pursuant to <ref href="/us/usc/t42/s2201/n">section 2201(n) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc120-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2/D"><num value="D">(D)</num><content> the number of such applications that were granted; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fc121-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/e/2/E"><num value="E">(E)</num><content> a description of efforts to streamline the review of such applications, taking into account the proliferation and diversion potential of end-users in the country to which United States civil nuclear technology would be transferred pursuant to such applications.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fc122-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Notifications of potential diversions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director of National Intelligence shall notify the Department of Energy and the appropriate congressional committees not later than 30 days after the date on which the Director determines that there is credible intelligence that United States civil nuclear technology is being or has been diverted—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fc123-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/f/1"><num value="1">(1)</num><content> to a military program in a foreign country to which the transfer of the technology was authorized under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa6fe834-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/f/2"><num value="2">(2)</num><content> to a foreign country to which the transfer of the technology was not so authorized.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fe835-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/g"><num value="g" class="bold">(g)</num><heading class="bold"> Guidelines</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 60 days after <date date="2015-11-25">November 25, 2015</date>, the Secretary of Energy shall issue guidance with respect to the use of the clear and intended authority of the Secretary under <ref href="/us/usc/t42/s2282">section 2282 of this title</ref> to impose civil penalties, including fines and debarment, and to make referrals to the Attorney General for prosecution, for violations of the terms of authorizations for the transfer of United States civil nuclear technology issued under <ref href="/us/usc/t42/s2077/b">section 2077(b) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fe836-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/h"><num value="h" class="bold">(h)</num><heading class="bold"> Report on transfer of sensitive items</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fe837-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2015-11-25">November 25, 2015</date>, and annually thereafter, the President shall submit to the appropriate congressional committees a report—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fe838-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/h/1/A"><num value="A">(A)</num><content> describing the efforts of covered foreign countries to prevent the transfer of sensitive items, including efforts to improve the prevention of the transfer of such items; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fe839-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/h/1/B"><num value="B">(B)</num><content> assessing the adequacy of such efforts.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fe83a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Sensitive items defined</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “sensitive items” means goods, services, and technologies described in section 2(a) of the Iran, North Korea, and Syria Nonproliferation Act (<ref href="/us/pl/106/178">Public Law 106–178</ref>; <ref href="/us/usc/t50/s1701">50 U.S.C. 1701</ref> note).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa6fe83b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/i"><num value="i" class="bold">(i)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaa6fe83c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Appropriate congressional committees</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “appropriate congressional committees” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fe83d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/i/1/A"><num value="A">(A)</num><content> the congressional defense committees;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fe83e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/i/1/B"><num value="B">(B)</num><content> the Committee on Energy and Natural Resources, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa6fe83f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2077a/i/1/C"><num value="C">(C)</num><content> the Committee on Energy and Commerce, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives.</content>

<p style="-uslm-lc:I21" class="indent0">Memorandum for the Secretary of State</p>
<p style="-uslm-lc:I21" class="indent0">By the authority vested in me as President by the Constitution and the laws of the United States of America, including <ref href="/us/usc/t3/s301">section 301 of title 3</ref>, United States Code, I hereby order as follows:</p>
<p style="-uslm-lc:I21" class="indent0">I hereby delegate functions and authorities vested in the President by section 3136(h) of the National Defense Authorization Act for Fiscal Year 2016 (<ref href="/us/pl/114/92">Public Law 114–92</ref>) (the “Act”) to the Secretary of State.</p>
<p style="-uslm-lc:I21" class="indent0">Any reference in this memorandum to the Act shall be deemed to be a reference to any future act that is the same or substantially the same as such provision.</p>
<p style="-uslm-lc:I21" class="indent0">You are authorized and directed to publish this memorandum in the Federal Register.</p>
