Such licenses shall be issued in accordance with the provisions of subchapter XV and subject to such conditions as the Commission may by rule or regulation establish to effectuate the purposes and provisions of this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0808c206-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2133/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Nonexclusive basis</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Commission shall issue such licenses on a nonexclusive basis to persons applying therefor (1) whose proposed activities will serve a useful purpose proportionate to the quantities of special nuclear material or source material to be utilized; (2) who are equipped to observe and who agree to observe such safety standards to protect health and to minimize danger to life or property as the Commission may by rule establish; and (3) who agree to make available to the Commission such technical information and data concerning activities under such licenses as the Commission may determine necessary to promote the common defense and security and to protect the health and safety of the public. All such information may be used by the Commission only for the purposes of the common defense and security and to protect the health and safety of the public.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0808c207-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2133/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> License period</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each such license shall be issued for a specified period, as determined by the Commission, depending on the type of activity to be licensed, but not exceeding forty years from the authorization to commence operations, and may be renewed upon the expiration of such period.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0808c208-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2133/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No license under this section may be given to any person for activities which are not under or within the jurisdiction of the United States, except for the export of production or utilization facilities under terms of an agreement for cooperation arranged pursuant to <ref href=\"/us/usc/t42/s2153\">section 2153 of this title</ref>, or except under the provisions of <ref href=\"/us/usc/t42/s2139\">section 2139 of this title</ref>. No license may be issued to an alien or any any <ref class=\"footnoteRef\" idref=\"fn003190\">1</ref><note type=\"footnote\" id=\"fn003190\"><num>1</num> So in original.</note> corporation or other entity if the Commission knows or has reason to believe it is owned, controlled, or dominated by an alien, a foreign corporation, or a foreign government. In any event, no license may be issued to any person within the United States if, in the opinion of the Commission, the issuance of a license to such person would be inimical to the common defense and security or to the health and safety of the public.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0808c209-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2133/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> <ref class=\"footnoteRef\" idref=\"fn003191\">2</ref><note type=\"footnote\" id=\"fn003191\"><num>2</num> So in original. Probably should be “(e)”.</note> Accident notification condition; license revocation; license amendment to include condition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each license issued for a utilization facility under this section or <ref href=\"/us/usc/t42/s2134/b\">section 2134(b) of this title</ref> shall require as a condition thereof that in case of any accident which could result in an unplanned release of quantities of fission products in excess of allowable limits for normal operation established by the Commission, the licensee shall immediately so notify the Commission. Violation of the condition prescribed by this subsection may, in the Commission’s discretion, constitute grounds for license revocation. and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><chapeau> developing procedures and processes for—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> using a licensing project plan; and</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><content> optional use of a conceptual design assessment.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Risk-informed licensing</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Commission shall develop and implement, where appropriate, strategies for the increased use of risk-informed, performance-based licensing evaluation techniques and guidance for commercial advanced nuclear reactors within the existing regulatory framework, including evaluation techniques and guidance for the resolution of the following:</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> Applicable policy issues identified during the course of review by the Commission of a commercial advanced nuclear reactor licensing application.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><chapeau> The issues described in SECY–93–092 and SECY–15–077, including—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> licensing basis event selection and evaluation;</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><content> source terms;</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"iii\">“(iii)</num><content> containment performance; and</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"iv\">“(iv)</num><content> emergency preparedness.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Research and test reactor licensing</inline>.—</heading><content>For the purpose of predictable, efficient, and timely reviews, not later than 2 years after the date of enactment of this Act, the Commission shall develop and implement strategies within the existing regulatory framework for licensing research and test reactors, including the issuance of guidance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Technology-inclusive regulatory framework</inline>.—</heading><content>Not later than <date date=\"2027-12-31\">December 31, 2027</date>, the Commission shall complete a rulemaking to establish a technology-inclusive, regulatory framework for optional use by commercial advanced nuclear reactor applicants for new reactor license applications.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Training and expertise</inline>.—</heading><chapeau>As soon as practicable after the date of enactment of this Act, the Commission shall provide for staff training or the hiring of experts, as necessary—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> to support the activities described in paragraphs (1) through (4); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><chapeau> to support preparations—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> to conduct pre-application interactions;
