C, title XXXI, § 3163, Jan. 2, 2013, 126 Stat. 2205.)","seq_in_title":2961,"parent_identifier":"/us/usc/t42/ch23/dA/schXI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23","level":"chapter","num":"CHAPTER 23—","heading":"DEVELOPMENT AND CONTROL OF ATOMIC ENERGY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23/dA","level":"division","num":"Division A—","heading":"Atomic Energy","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23/dA/schXI","level":"subchapter","num":"SUBCHAPTER XI—","heading":"CONTROL OF INFORMATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id0816f35e-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162\"><num value=\"2162\">§ 2162.</num><heading> Classification and declassification of Restricted Data</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0816f35f-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Periodic determination</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Commission shall from time to time determine the data, within the definition of Restricted Data, which can be published without undue risk to the common defense and security and shall thereupon cause such data to be declassified and removed from the category of Restricted Data.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0816f360-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Continuous review</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Commission shall maintain a continuous review of Restricted Data and of any Classification Guides issued for the guidance of those in the atomic energy program with respect to the areas of Restricted Data which have been declassified in order to determine which information may be declassified and removed from the category of Restricted Data without undue risk to the common defense and security.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0816f361-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Joint determination on atomic weapons; Presidential determination on disagreement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the case of Restricted Data which the Commission and the Department of Defense jointly determine to relate primarily to the military utilization of atomic weapons, the determination that such data may be published without constituting an unreasonable risk to the common defense and security shall be made by the Commission and the Department of Defense jointly, and if the Commission and the Department of Defense do not agree, the determination shall be made by the President.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0816f362-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Removal from Restricted Data category</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0816f363-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/1\"><num value=\"1\">(1)</num><content> The Commission shall remove from the Restricted Data category such data as the Commission and the Department of Defense jointly determine relates primarily to the military utilization of atomic weapons and which the Commission and Department of Defense jointly determine can be adequately safeguarded as defense information: <i>Provided, however</i>, That no such data so removed from the Restricted Data category shall be transmitted or otherwise made available to any nation or regional defense organization, while such data remains defense information, except pursuant to an agreement for cooperation entered into in accordance with subsection (b) or (d) of <ref href=\"/us/usc/t42/s2164\">section 2164 of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0816f364-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/2\"><num value=\"2\">(2)</num><chapeau> The Commission may restore to the Restricted Data category any information related to the design of nuclear weapons removed under paragraph (1) if the Commission and the Department of Defense jointly determine that—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0816f365-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/2/A\"><num value=\"A\">(A)</num><content> the programmatic requirements that caused the information to be removed from the Restricted Data category are no longer applicable or have diminished;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0816f366-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/2/B\"><num value=\"B\">(B)</num><content> the information would be more appropriately protected as Restricted Data; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0816f367-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/2/C\"><num value=\"C\">(C)</num><content> restoring the information to the Restricted Data category is in the interest of national security.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0816f368-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/d/3\"><num value=\"3\">(3)</num><content> In carrying out paragraph (2), information related to the design of nuclear weapons shall be restored to the Restricted Data category in accordance with regulations prescribed for purposes of such paragraph.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id0816f369-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Joint determination on atomic energy programs</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0816f36a-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/e/1\"><num value=\"1\">(1)</num><content> The Commission shall remove from the Restricted Data category such information concerning the atomic energy programs of other nations as the Commission and the Director of National Intelligence jointly determine to be necessary to carry out the provisions of section 102(d) of the National Security Act of 1947, as amended,<ref class=\"footnoteRef\" idref=\"fn003195\">1</ref><note type=\"footnote\" id=\"fn003195\"><num>1</num> See References in Text note below.</note> and can be adequately safeguarded as defense information.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0816f36b-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/e/2\"><num value=\"2\">(2)</num><chapeau> The Commission may restore to the Restricted Data category any information concerning atomic energy programs of other nations removed under paragraph (1) if the Commission and the Director of National Intelligence jointly determine that—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0816f36c-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/e/2/A\"><num value=\"A\">(A)</num><content> the programmatic requirements that caused the information to be removed from the Restricted Data category are no longer applicable or have diminished;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0816f36d-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s2162/e/2/B\"><num value=\"B\">(B)</num><content> the information would be more appropriately protected as Restricted Data;
