<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaa7eb521-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169"><num value="2169">§ 2169.</num><heading> Fingerprinting for criminal history record checks</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa7eb522-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaa7eb523-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idaa7eb524-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I11" class="indent0" id="idaa7eb525-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A/i"><num value="i">(i)</num><content> The Commission shall require each individual or entity described in clause (ii) to fingerprint each individual described in subparagraph (B) before the individual described in subparagraph (B) is permitted access under subparagraph (B).</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="idaa7edc36-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A/ii"><num value="ii">(ii)</num><chapeau> The individuals and entities referred to in clause (i) are individuals and entities that, on or before the date on which an individual is permitted access under subparagraph (B)—</chapeau><subclause style="-uslm-lc:I12" class="indent1" id="idaa7edc37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A/ii/I"><num value="I">(I)</num><content> are licensed or certified to engage in an activity subject to regulation by the Commission;</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="idaa7edc38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A/ii/II"><num value="II">(II)</num><content> have filed an application for a license or certificate to engage in an activity subject to regulation by the Commission; or</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="idaa7edc39-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/A/ii/III"><num value="III">(III)</num><content> have notified the Commission in writing of an intent to file an application for licensing, certification, permitting, or approval of a product or activity subject to regulation by the Commission.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idaa7edc3a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/B"><num value="B">(B)</num><chapeau> The Commission shall require to be fingerprinted any individual who—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idaa7edc3b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/B/i"><num value="i">(i)</num><chapeau> is permitted unescorted access to—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idaa7edc3c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/B/i/I"><num value="I">(I)</num><content> a utilization facility; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idaa7edc3d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/B/i/II"><num value="II">(II)</num><content> radioactive material or other property subject to regulation by the Commission that the Commission determines to be of such significance to the public health and safety or the common defense and security as to warrant fingerprinting and background checks; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idaa7edc3e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/1/B/ii"><num value="ii">(ii)</num><content> is permitted access to safeguards information under <ref href="/us/usc/t42/s2167">section 2167 of this title</ref>.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaa7edc3f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/2"><num value="2">(2)</num><content> All fingerprints obtained by an individual or entity as required in paragraph (1) shall be submitted to the Attorney General of the United States through the Commission for identification and a criminal history records check.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaa7edc40-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/3"><num value="3">(3)</num><content> The costs of an identification or records check under paragraph (2) shall be paid by the individual or entity required to conduct the fingerprinting under paragraph (1)(A).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaa7edc41-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/4"><num value="4">(4)</num><chapeau> Notwithstanding any other provision of law—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaa7edc42-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/4/A"><num value="A">(A)</num><content> the Attorney General may provide any result of an identification or records check under paragraph (2) to the Commission; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaa7edc43-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/a/4/B"><num value="B">(B)</num><content> the Commission, in accordance with regulations prescribed under this section, may provide the results to the individual or entity required to conduct the fingerprinting under paragraph (1)(A).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa7edc44-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/b"><num value="b" class="bold">(b)</num><heading class="bold"> Waiver</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission, by rule, may relieve persons from the obligations imposed by this section, upon specified terms, conditions, and periods, if the Commission finds that such action is consistent with its obligations to promote the common defense and security and to protect the health and safety of the public.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa7edc45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c"><num value="c" class="bold">(c)</num><heading class="bold"> Regulations</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of administering this section, the Commission shall prescribe requirements—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa7edc46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/1"><num value="1">(1)</num><content> to implement procedures for the taking of fingerprints;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa7edc47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2"><num value="2">(2)</num><chapeau> to establish the conditions for use of information received from the Attorney General, in order—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaa7edc48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/A"><num value="A">(A)</num><content> to limit the redissemination of such information;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa7edc49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/B"><num value="B">(B)</num><content> to ensure that such information is used solely for the purpose of determining whether an individual shall be permitted unescorted access to a utilization facility, radioactive material, or other property described in subsection (a)(1)(B) or shall be permitted access to safeguards information under <ref href="/us/usc/t42/s2167">section 2167 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa7edc4a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/C"><num value="C">(C)</num><chapeau> to ensure that no final determination may be made solely on the basis of information provided under this section involving—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaa7edc4b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/C/i"><num value="i">(i)</num><content> an arrest more than 1 year old for which there is no information of the disposition of the case; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaa7edc4c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/C/ii"><num value="ii">(ii)</num><content> an arrest that resulted in dismissal of the charge or an acquittal; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaa7edc4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/2/D"><num value="D">(D)</num><content> to protect individuals subject to fingerprinting under this section from misuse of the criminal history records; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa7edc4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/c/3"><num value="3">(3)</num><content> to provide each individual subject to fingerprinting under this section with the right to complete, correct, and explain information contained in the criminal history records prior to any final adverse determination.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa7edc4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/d"><num value="d" class="bold">(d)</num><heading class="bold"> Use of biometric methods</heading><chapeau style="-uslm-lc:I11" class="indent0">The Commission may require a person or individual to conduct fingerprinting under subsection (a)(1) by authorizing or requiring the use of any alternative biometric method for identification that has been approved by—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaa7f0360-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/d/1"><num value="1">(1)</num><content> the Attorney General; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaa7f0361-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/d/2"><num value="2">(2)</num><content> the Commission, by regulation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaa7f0362-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e"><num value="e" class="bold">(e)</num><heading class="bold"> Processing fees; use of amounts collected</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaa7f0363-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e/1"><num value="1">(1)</num><content> The Commission may establish and collect fees to process fingerprints and criminal history records under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaa7f0364-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e/2"><num value="2">(2)</num><chapeau> Notwithstanding <ref href="/us/usc/t31/s3302/b">section 3302(b) of title 31</ref>, and to the extent approved in appropriation Acts—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaa7f0365-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e/2/A"><num value="A">(A)</num><content> a portion of the amounts collected under this subsection in any fiscal year may be retained and used by the Commission to carry out this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaa7f0366-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e/2/B"><num value="B">(B)</num><content> the remaining portion of the amounts collected under this subsection in such fiscal year may be transferred periodically to the Attorney General and used by the Attorney General to carry out this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaa7f0367-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s2169/e/3"><num value="3">(3)</num><content> Any amount made available for use under paragraph (2) shall remain available until expended.</content>
