value=\"2215\">§ 2215.</num><heading> Nuclear Regulatory Commission user fees and annual charges for fiscal year 2021 and each fiscal year thereafter</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa8879a6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Annual budget justification</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa8879a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In the annual budget justification submitted by the Commission to Congress, the Commission shall expressly identify anticipated expenditures necessary for completion of the requested activities of the Commission anticipated to occur during the applicable fiscal year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa8879a8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Restriction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Budget authority granted to the Commission for purposes of the requested activities of the Commission shall be used, to the maximum extent practicable, solely for conducting requested activities of the Commission.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88a0b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Limitation on corporate support costs</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">With respect to the annual budget justification submitted to Congress, corporate support costs, to the maximum extent practicable, shall not exceed the following percentages of the total budget authority of the Commission requested in the annual budget justification:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa88a0ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/3/A\"><num value=\"A\">(A)</num><content> 30 percent for each of fiscal years 2021 and 2022.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa88a0bb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/3/B\"><num value=\"B\">(B)</num><content> 29 percent for each of fiscal years 2023 and 2024.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa88a0bc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/a/3/C\"><num value=\"C\">(C)</num><content> 28 percent for fiscal year 2025 and each fiscal year thereafter.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa88a0bd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Fees and charges</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88a0be-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Annual assessment</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0bf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Each fiscal year, the Commission shall assess and collect fees and charges in accordance with paragraphs (2) and (3) in a manner that ensures that, to the maximum extent practicable, the amount assessed and collected is equal to an amount that approximates—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaa88a0c0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/A/i\"><num value=\"i\">(i)</num><content> the total budget authority of the Commission for that fiscal year; less</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaa88a0c1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> the budget authority of the Commission for the activities described in subparagraph (B).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0c2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Excluded activities described</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The activities referred to in subparagraph (A)(ii) are the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaa88a0c3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/i\"><num value=\"i\">(i)</num><content> Any fee relief activity, as identified by the Commission.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaa88a0c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii\"><num value=\"ii\">(ii)</num><chapeau> Amounts appropriated for a fiscal year to the Commission—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/I\"><num value=\"I\">(I)</num><content> from the Nuclear Waste Fund established under <ref href=\"/us/usc/t42/s10222/c\">section 10222(c) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/II\"><num value=\"II\">(II)</num><content> for implementation of section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (<ref href=\"/us/usc/t50/s2601\">50 U.S.C. 2601</ref> note; <ref class=\"footnoteRef\" idref=\"fn003208\">1</ref><note type=\"footnote\" id=\"fn003208\"><num>1</num> See References in Text below.</note> <ref href=\"/us/pl/108/375\">Public Law 108–375</ref>);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/III\"><num value=\"III\">(III)</num><content> for the homeland security activities of the Commission (other than for the costs of fingerprinting and background checks required under <ref href=\"/us/usc/t42/s2169\">section 2169 of this title</ref> and the costs of conducting security inspections);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/IV\"><num value=\"IV\">(IV)</num><content> for the Inspector General services of the Commission provided to the Defense Nuclear Facilities Safety Board;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/V\"><num value=\"V\">(V)</num><content> for research and development at universities in areas relevant to the mission of the Commission; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88a0ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/ii/VI\"><num value=\"VI\">(VI)</num><content> for a nuclear science and engineering grant program that will support multiyear projects that do not align with programmatic missions but are critical to maintaining the discipline of nuclear science and engineering.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaa88a0cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/B/iii\"><num value=\"iii\">(iii)</num><content> Costs for activities related to the development of regulatory infrastructure for advanced nuclear reactor technologies, including activities required under section 103.<sup>1</sup></content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The exclusion described in subparagraph (B)(iii) shall cease to be effective on <date date=\"2031-01-01\">January 1, 2031</date>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than <date date=\"2029-12-31\">December 31, 2029</date>, the Commission shall submit to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a report describing the views of the Commission on the continued appropriateness and necessity of the funding described in subparagraph (B)(iii).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88a0ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Fees for service or thing of value</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In accordance with <ref href=\"/us/usc/t31/s9701\">section 9701 of title 31</ref>, the Commission shall assess and collect fees from any person who receives a service or thing of value from the Commission to cover the costs to the Commission of providing the service or thing of value.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88a0cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Annual charges</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to subparagraph (B) and except as provided in subparagraph (D), the Commission may charge to any licensee or certificate holder of the Commission an annual charge in addition to the fees assessed and collected under paragraph (2).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88a0d1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Cap on annual charges of certain licensees</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88a0d2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Operating reactors</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The annual charge under subparagraph (A) charged to an operating reactor licensee, to the maximum extent practicable, shall not exceed the annual fee amount per operating reactor licensee established in the final rule of the Commission entitled “Revision of Fee Schedules; Fee Recovery for Fiscal Year 2015” (80 Fed. Reg. 37432 (<date date=\"2015-06-30\">June 30, 2015</date>)), as may be adjusted annually by the Commission to reflect changes in the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88c7e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Waiver</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Commission may waive, for a period of 1 year, the cap on annual charges described in clause (i) if the Commission submits to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a written determination that the cap on annual charges may compromise the safety and security mission of the Commission.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88c7e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Amount per licensee</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88c7e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Commission shall establish by rule a schedule of annual charges fairly and equitably allocating the aggregate amount of charges described in subparagraph (A) among licensees and certificate holders.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88c7e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Requirement</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The schedule of annual charges under clause (i)—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88c7e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/C/ii/I\"><num value=\"I\">(I)</num><content> to the maximum extent practicable, shall be reasonably related to the cost of providing regulatory services; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88c7e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/C/ii/II\"><num value=\"II\">(II)</num><content> may be based on the allocation of the resources of the Commission among licensees or certificate holders or classes of licensees or certificate holders.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaa88c7e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Exemption</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88c7ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Definition of research reactor</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In this subparagraph, the term “research reactor” means a nuclear reactor that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88c7eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i/I\"><num value=\"I\">(I)</num><content> is licensed by the Commission under <ref href=\"/us/usc/t42/s2134/c\">section 2134(c) of this title</ref> for operation at a thermal power level of not more than 10 megawatts; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaa88c7ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i/II\"><num value=\"II\">(II)</num><chapeau> if licensed under subclause (I) for operation at a thermal power level of more than 1 megawatt, does not contain—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idaa88c7ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i/II/aa\"><num value=\"aa\">(aa)</num><content> a circulating loop through the core in which the licensee conducts fuel experiments;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idaa88c7ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i/II/bb\"><num value=\"bb\">(bb)</num><content> a liquid fuel loading; or</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idaa88c7ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/i/II/cc\"><num value=\"cc\">(cc)</num><content> an experimental facility in the core in excess of 16 square inches in cross-section.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idaa88c7f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/b/3/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Exemption</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Subparagraph (A) shall not apply to the holder of any license for a federally owned research reactor used primarily for educational training and academic research purposes.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa88c7f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Performance and reporting</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88c7f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 180 days after <date date=\"2019-01-14\">January 14, 2019</date>, the Commission shall develop for the requested activities of the Commission—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa88c7f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c/1/A\"><num value=\"A\">(A)</num><content> performance metrics; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaa88c7f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c/1/B\"><num value=\"B\">(B)</num><content> milestone schedules.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88c7f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Delays in issuance of final safety evaluation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Executive Director for Operations of the Commission shall inform the Commission of a delay in issuance of the final safety evaluation for a requested activity of the Commission by the completion date required by the performance metrics or milestone schedule under paragraph (1) by not later than 30 days after the completion date.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaa88c7f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Delays in issuance of final safety evaluation exceeding 180 days</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If the final safety evaluation for the requested activity of the Commission described in paragraph (2) is not completed by the date that is 180 days after the completion date required by the performance metrics or milestone schedule under paragraph (1), the Commission shall submit to the appropriate congressional committees a timely report describing the delay, including a detailed explanation accounting for the delay and a plan for timely completion of the final safety evaluation.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa88c7f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Accurate invoicing</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">With respect to invoices for fees described in subsection (b)(2), the Commission shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa88c7f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/d/1\"><num value=\"1\">(1)</num><content> ensure appropriate review and approval prior to the issuance of invoices;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa88c7f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/d/2\"><num value=\"2\">(2)</num><content> develop and implement processes to audit invoices to ensure accuracy, transparency, and fairness; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa88ef0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/d/3\"><num value=\"3\">(3)</num><content> modify regulations to ensure fair and appropriate processes to provide licensees and applicants an opportunity to efficiently dispute or otherwise seek review and correction of errors in invoices for those fees.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa88ef0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than <date date=\"2021-09-30\">September 30, 2021</date>, the Commission shall submit to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a report describing the implementation of this section, including any impacts and recommendations for improvement.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa88ef0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2215/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Effective date</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except as provided in subsection (c), this section takes effect on <date date=\"2020-10-01\">October 1, 2020</date>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idaa88ef0d-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/115/439/tI/s102\">Pub. or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"H\">“(H)</num><content> ability to integrate into electric and nonelectric applications.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Advanced nuclear reactor fuel</inline>.—</heading><content>The term ‘advanced nuclear reactor fuel’ means fuel for use in an advanced nuclear reactor or a research and test reactor, including fuel with a low uranium enrichment level of not greater than 20 percent.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Agreement state</inline>.—</heading><content>The term ‘Agreement State’ means any State with which the Commission has entered into an effective agreement under section 274 b. of the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2021/b\">42 U.S.C. 2021(b)</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Appropriate congressional committees</inline>.—</heading><content>The term ‘appropriate congressional committees’ means the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Commission</inline>.—</heading><content>The term ‘Commission’ means the Nuclear Regulatory Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Conceptual design assessment</inline>.—</heading><chapeau>The term ‘conceptual design assessment’ means an early-stage review by the Commission that—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> assesses preliminary design information for consistency with applicable regulatory requirements of the Commission;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> is performed on a set of topic areas agreed to in the licensing project plan; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> is performed at a cost and schedule agreed to in the licensing project plan.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Corporate support costs</inline>.—</heading><content>The term ‘corporate support costs’ means expenditures for acquisitions, administrative services, financial management, human resource management, information management, information technology, policy support, outreach, and training, as those categories are described and calculated in Appendix A of the Congressional Budget Justification for Fiscal Year 2018 of the Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><heading> <inline class=\"small-caps\">Licensing project plan</inline>.—</heading><chapeau>The term ‘licensing project plan’ means a plan that describes—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the interactions between an applicant and the Commission; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> project schedules and deliverables in specific detail to support long-range resource planning undertaken by the Commission and an applicant.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><heading> <inline class=\"small-caps\">Regulatory framework</inline>.—</heading><content>The term ‘regulatory framework’ means the framework for reviewing requests for certifications, permits, approvals, and licenses for nuclear reactors.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><heading> <inline class=\"small-caps\">Requested activity of the commission</inline>.—</heading><chapeau>The term ‘requested activity of the Commission’ means—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><chapeau> the processing of applications for—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> design certifications or approvals;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> licenses;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> permits;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> license amendments;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> license renewals;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vi\">“(vi)</num><content> certificates of compliance;
