The provisions shall specify various degrees of violations and the amount of the reduction attributable to each degree of violation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa8d0cf2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2282b/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Powers and limitations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The powers and limitations applicable to the assessment of civil penalties under <ref href=\"/us/usc/t42/s2282a\">section 2282a of this title</ref>, except for subsection (d) of that section, shall apply to the assessment of civil penalties under this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaa8d0cf3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2282b/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application to certain entities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the case of an entity specified in subsection (d) of <ref href=\"/us/usc/t42/s2282a\">section 2282a of this title</ref>—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa8d0cf4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2282b/d/1\"><num value=\"1\">(1)</num><content> the assessment of any civil penalty under subsection (a) against that entity may not be made until the entity enters into a new contract with the Department of Energy or an extension of a current contract with the Department; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaa8d0cf5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s2282b/d/2\"><num value=\"2\">(2)</num><content> the total amount of civil penalties under subsection (a) in a fiscal year may not exceed the total amount of fees paid by the Department of Energy to that entity in that fiscal year.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaa8d0cf6-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1946-08-01/ch724\">Aug. 1, 1946, ch. 724</ref>, title I, § 234B, as added <ref href=\"/us/pl/106/65/dC/tXXXI/s3147/a\">Pub.
