C, title XXXII, § 3202(a)(1)(B)–(3), § 3203(a), (b)(1), (c), Dec. 20, 2019, 133 Stat. 1964, 1966.)","seq_in_title":3045,"parent_identifier":"/us/usc/t42/ch23/dA/schXVII–A","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23","level":"chapter","num":"CHAPTER 23—","heading":"DEVELOPMENT AND CONTROL OF ATOMIC ENERGY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23/dA","level":"division","num":"Division A—","heading":"Atomic Energy","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch23/dA/schXVII–A","level":"subchapter","num":"SUBCHAPTER XVII–A—","heading":"DEFENSE NUCLEAR FACILITIES SAFETY BOARD","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad6d82cd-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286\"><num value=\"2286\">§ 2286.</num><heading> Establishment</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6d82ce-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is hereby established an independent establishment in the executive branch, to be known as the “Defense Nuclear Facilities Safety Board” (hereafter in this subchapter referred to as the “Board”).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6d82cf-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Membership</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6d82d0-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/b/1\"><num value=\"1\">(1)</num><content> The Board shall be composed of five members appointed from civilian life by the President, by and with the advice and consent of the Senate, from among United States citizens who are respected experts in the field of nuclear safety with a demonstrated competence and knowledge relevant to the independent investigative and oversight functions of the Board. Not more than three members of the Board shall be of the same political party.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6d82d1-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/b/2\"><num value=\"2\">(2)</num><content> Any vacancy in the membership of the Board shall be filled in the same manner in which the original appointment was made.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6d82d2-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/b/3\"><num value=\"3\">(3)</num><content> No member of the Board may be an employee of, or have any significant financial relationship with, the Department of Energy or any contractor of the Department of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9e3-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/b/4\"><num value=\"4\">(4)</num><content> The President shall enter into an arrangement with the National Academy of Sciences under which the National Academy shall maintain a list of individuals who meet the qualifications described in paragraph (1) to assist the President in selecting individuals to nominate for positions as members of the Board.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6da9e4-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Chairman, Vice Chairman, and Members</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9e5-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/1\"><num value=\"1\">(1)</num><content> The President shall designate a Chairman and Vice Chairman of the Board from among members of the Board.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9e6-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/2\"><num value=\"2\">(2)</num><chapeau> In accordance with paragraphs (5) and (6), the Chairman shall be the chief executive officer of the Board and, subject to such policies as the Board may establish, shall exercise the functions of the Board with respect to—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9e7-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/2/A\"><num value=\"A\">(A)</num><content> the appointment and supervision of employees of the Board;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9e8-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/2/B\"><num value=\"B\">(B)</num><content> the organization of any administrative units established by the Board; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9e9-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/2/C\"><num value=\"C\">(C)</num><content> the use and expenditure of funds.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9ea-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9eb-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/A\"><num value=\"A\">(A)</num><content> The Chairman may delegate any of the functions under this paragraph to any other member or to any appropriate officer of the Board.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6da9ec-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B\"><num value=\"B\">(B)</num><chapeau> In carrying out subparagraph (A), the Chairman shall delegate to the Executive Director of Operations established under <ref href=\"/us/usc/t42/s2286b/b/3\">section 2286b(b)(3) of this title</ref> the following functions:</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9ed-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/i\"><num value=\"i\">(i)</num><content> Administrative functions of the Board.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9ee-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/ii\"><num value=\"ii\">(ii)</num><content> Appointment and supervision of employees of the Board not specified under paragraph (6).</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9ef-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/iii\"><num value=\"iii\">(iii)</num><content> Distribution of business among the employees and administrative units and offices of the Board.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6da9f0-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/iv\"><num value=\"iv\">(iv)</num><chapeau> Preparation of—</chapeau><subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6da9f1-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/iv/I\"><num value=\"I\">(I)</num><content> proposals for the reorganization of the administrative units or offices of the Board;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6dd102-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/iv/II\"><num value=\"II\">(II)</num><content> the budget estimate for the Board; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6dd103-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/3/B/iv/III\"><num value=\"III\">(III)</num><content> the proposed distribution of funds according to purposes approved by the Board.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd104-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/4\"><num value=\"4\">(4)</num><content> The Vice Chairman shall act as Chairman in the event of the absence or incapacity of the Chairman or in case of a vacancy in the office of Chairman.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd105-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/5\"><num value=\"5\">(5)</num><chapeau> Each member of the Board, including the Chairman and Vice Chairman, shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd106-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/5/A\"><num value=\"A\">(A)</num><content> have equal responsibility and authority in establishing decisions and determining actions of the Board;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd107-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/5/B\"><num value=\"B\">(B)</num><content> have full access to all information relating to the performance of the Board’s functions, powers, and mission; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd108-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/5/C\"><num value=\"C\">(C)</num><content> have one vote.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd109-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6\"><num value=\"6\">(6)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd10a-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6/A\"><num value=\"A\">(A)</num><content> The Chairman, subject to the approval of the Board, shall appoint the senior employees described in subparagraph (C). Any member of the Board may propose to the Chairman an individual to be so appointed.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd10b-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6/B\"><num value=\"B\">(B)</num><content> The Chairman, subject to the approval of the Board, may remove a senior employee described in subparagraph (C). Any member of the Board may propose to the Chairman an individual to be so removed.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd10c-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6/C\"><num value=\"C\">(C)</num><chapeau> The senior employees described in this subparagraph are the following senior employees of the Board:</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd10d-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6/C/i\"><num value=\"i\">(i)</num><content> The Executive Director of Operations established under <ref href=\"/us/usc/t42/s2286b/b/3\">section 2286b(b)(3) of this title</ref>.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd10e-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/c/6/C/ii\"><num value=\"ii\">(ii)</num><content> The general counsel.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6dd10f-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Terms</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd110-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/1\"><num value=\"1\">(1)</num><content> Except as provided under paragraph (2), the members of the Board shall serve for terms of five years. Members of the Board may be reappointed.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6dd111-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2\"><num value=\"2\">(2)</num><chapeau> Of the members first appointed—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd112-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2/A\"><num value=\"A\">(A)</num><content> one shall be appointed for a term of one year;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd113-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2/B\"><num value=\"B\">(B)</num><content> one shall be appointed for a term of two years;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6dd114-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2/C\"><num value=\"C\">(C)</num><content> one shall be appointed for a term of three years;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6df825-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2/D\"><num value=\"D\">(D)</num><content> one shall be appointed for a term of four years; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6df826-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/2/E\"><num value=\"E\">(E)</num><content> one shall be appointed for a term of five years,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">as designated by the President at the time of appointment.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6df827-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/3\"><num value=\"3\">(3)</num><content> Any member appointed to fill a vacancy occurring before the expiration of the term of office for which such member’s predecessor was appointed shall be appointed only for the remainder of such term. A member may serve after the expiration of that member’s term until a successor has taken office.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6df828-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4\"><num value=\"4\">(4)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6df829-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/A\"><num value=\"A\">(A)</num><chapeau> Not later than 180 days after the expiration of the term of a member of the Board, the President shall—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6df82a-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/A/i\"><num value=\"i\">(i)</num><content> submit to the Senate the nomination of an individual to fill the vacancy; or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad6df82b-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/A/ii\"><num value=\"ii\">(ii)</num><chapeau> submit to the Committee on Armed Services of the Senate a report that includes—</chapeau><subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6df82c-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/A/ii/I\"><num value=\"I\">(I)</num><content> a description of the reasons the President did not submit such a nomination; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6df82d-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/A/ii/II\"><num value=\"II\">(II)</num><content> a plan for submitting such a nomination during the 90-day period following the submission of the report.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad6df82e-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/d/4/B\"><num value=\"B\">(B)</num><content> If the President does not submit to the Senate the nomination of an individual to fill a vacancy during the 90-day period described in subclause (II) of subparagraph (A)(ii), the President shall submit to the Committee on Armed Services a report described in that subparagraph not less frequently than every 90 days until the President submits such a nomination.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6df82f-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s2286/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Quorum</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Three members of the Board shall constitute a quorum, but a lesser number may hold hearings.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad6df830-c149-11ea-9926-d3ea3d33fdd4\">(<ref href=\"/us/act/1946-08-01/ch724\">Aug. 1, 1946, ch. 724</ref>, title I, § 311, as added <ref href=\"/us/pl/100/456/dA/tXIV/s1441/a/1\">Pub. The report shall include the following:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> An assessment of the value of and the need for the Board to continue to perform the functions specified under chapter 21 of the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2286\">42 U.S.C. 2286</ref> et seq.).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> An assessment of the relationship between the functions of the Board and a proposal by the Department of Energy to place Department of Energy defense nuclear facilities under the jurisdiction of external regulatory agencies.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> An assessment of the functions of the Board and whether there is a need to modify or amend such functions.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> An assessment of the relative advantages and disadvantages to the Department and the public of continuing the functions of the Board with respect to Department of Energy defense nuclear facilities and replacing the activities of the Board with external regulation of such facilities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> A list of all existing or planned Department of Energy defense nuclear facilities that are similar to facilities under the regulatory jurisdiction of the Nuclear Regulatory Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> A list of all Department of Energy defense nuclear facilities that are in compliance with all applicable Department of Energy orders, regulations, and requirements relating to the design, construction, operation, and decommissioning of defense nuclear facilities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> A list of all Department of Energy defense nuclear facilities that have implemented, pursuant to an implementation plan, recommendations made by the Board and accepted by the Secretary of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> A list of Department of Energy defense nuclear facilities that have a function related to Department weapons activities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">(A)</num><chapeau> A list of each existing defense nuclear facility that the Board determines—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> should continue to stay within the jurisdiction of the Board for a period of time or indefinitely; and</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><content> should come under the jurisdiction of an outside regulatory authority.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> An explanation of the determinations made under subparagraph (A).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><content> For any existing facilities that should, in the opinion of the Board, come under the jurisdiction of an outside regulatory authority, the date when this move would occur and the period of time necessary for the transition.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"11\">“(11)</num><content> A list of any proposed Department of Energy defense nuclear facilities that should come under the Board’s jurisdiction.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"12\">“(12)</num><content> An assessment of regulatory and other issues associated with the design, construction, operation, and decommissioning of facilities that are not owned by the Department of Energy but which would provide services to the Department of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"13\">“(13)</num><content> An assessment of the role of the Board, if any, in privatization projects undertaken by the Department.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"14\">“(14)</num><content> An assessment of the role of the Board, if any, in any tritium production facilities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"15\">“(15)</num><content> An assessment of the comparative advantages and disadvantages to the Department of Energy in the event some or all Department of Energy defense nuclear facilities were no longer included in the functions of the Board and were regulated by the Nuclear Regulatory Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"16\">“(16)</num><content> A comparison of the cost, as identified by the Nuclear Regulatory Commission, that would be incurred at a gaseous diffusion plant to comply with regulations issued by the Nuclear Regulatory Commission, with the cost that would be incurred by a gaseous diffusion plant if such a plant was considered to be a Department of Energy defense nuclear facility as defined by chapter 21 of the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2286\">42 U.S.C. 2286</ref> et seq.).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Comments on Report</inline>.—</heading><content>Before submission of the report to Congress under subsection (c), the Board shall transmit the report to the Secretary of Energy and the Nuclear Regulatory Commission. The Secretary and the Commission shall provide their comments on the report to both the Board and to Congress.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Submission to Congress</inline>.—</heading><content>Not later than six months after the date of the enactment of this Act [<date date=\"1997-11-18\">Nov. 18, 1997</date>], the Board shall provide to Congress an interim report on the status of the implementation of this section.
