<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35fe78b7-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c"><num value="2286c">§ 2286c.</num><heading> Responsibilities of Secretary of Energy</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35fe78b8-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/a"><num value="a" class="bold">(a)</num><heading class="bold"> Cooperation</heading><content><p style="-uslm-lc:I11" class="indent0">Except as specifically provided by this section, the Secretary of Energy shall fully cooperate with the Board and provide the Board with prompt and unfettered access to such facilities, personnel, and information as the Board considers necessary to carry out its responsibilities under this subchapter. Each contractor operating a Department of Energy defense nuclear facility under a contract awarded by the Secretary shall, to the extent provided in such contract or otherwise with the contractor’s consent, fully cooperate with the Board and provide the Board with prompt and unfettered access to such facilities, personnel, and information of the contractor as the Board considers necessary to carry out its responsibilities under this subchapter. The access provided to defense nuclear facilities, personnel, and information under this subsection shall be provided without regard to the hazard or risk category assigned to a facility by the Secretary.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35fe78b9-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Authority of Secretary to deny information</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id35fe78ba-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/1"><num value="1">(1)</num><chapeau> The Secretary may deny access to information under subsection (a) only to any person who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id35fe9fcb-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/1/A"><num value="A">(A)</num><content> has not been granted an appropriate security clearance or access authorization by the Secretary; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35fe9fcc-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/1/B"><num value="B">(B)</num><content> does not need such access in connection with the duties of such person.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id35fe9fcd-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2"><num value="2">(2)</num><chapeau> If the Board requests access to information under subsection (a) in written form, and the Secretary denies access to such information pursuant to paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id35fe9fce-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/A"><num value="A">(A)</num><content> the Secretary shall provide the Board notice of such denial in written form; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35fe9fcf-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/B"><num value="B">(B)</num><chapeau> not later than January 1 and July 1 of each year beginning in 2020—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id35fe9fd0-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/B/i"><num value="i">(i)</num><content> the Board shall submit to the congressional defense committees a report identifying each request for access to information under subsection (a) submitted to the Secretary in written form during the preceding six-month period and denied by the Secretary; and</content>

<clause style="-uslm-lc:I13" class="indent2" id="id35fe9fd1-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/B/ii"><num value="ii">(ii)</num><chapeau> the Secretary shall submit to the congressional defense committees a report identifying—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="id35fe9fd2-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/B/ii/I"><num value="I">(I)</num><content> each such request denied by the Secretary during that period; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id35fe9fd3-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/2/B/ii/II"><num value="II">(II)</num><content> the reason for the denial.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id35fe9fd4-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/b/3"><num value="3">(3)</num><content> In this subsection, the term “congressional defense committees” has the meaning given that term in <ref href="/us/usc/t10/s101/a">section 101(a) of title 10</ref>.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id35fe9fd5-6f69-11ea-aeac-d02c02bab4a0" identifier="/us/usc/t42/s2286c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Application of nondisclosure protections by Board</heading><content><p style="-uslm-lc:I11" class="indent0">The Board may not publicly disclose information provided under this section if such information is otherwise protected from disclosure by law, including deliberative process information.</p>
