determination of transferee</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id42eeb4c9-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/a\"><num value=\"a\">(a)</num><chapeau> Transfer may be made to one or more of the following, if the transferee has the legal authority to receive and operate the utility.</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4ca-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/a/1\"><num value=\"1\">(1)</num><content> the city at the community;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4cb-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/a/2\"><num value=\"2\">(2)</num><content> the State in which the community is located;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4cc-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/a/3\"><num value=\"3\">(3)</num><content> any political subdivision or agency of that State; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4cd-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/a/4\"><num value=\"4\">(4)</num><content> any person, firm, corporation, or other legal entity.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id42eeb4ce-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/b\"><num value=\"b\">(b)</num><chapeau> In determining the transferee for any utility, the Commission may consider the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4cf-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/b/1\"><num value=\"1\">(1)</num><content> the pattern of ownership of the comparable utilities in the State in which the community is located;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4d0-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/b/2\"><num value=\"2\">(2)</num><content> the ability of the transferee to operate the utility;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4d1-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/b/3\"><num value=\"3\">(3)</num><content> the probable price of the sale of the utility, the ability of the transferee to pay that price, and any probable expense;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4d2-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2373/b/4\"><num value=\"4\">(4)</num><content> the desires of the eligible voters of the community as directly expressed in any vote in any officially recognized procedure or in any procedure established by the Commission;
