{"identifier":"/us/usc/t42/s2384","title_num":"42","num":"§ 2384.","heading":"Transfer to governmental entity or private nonprofit organization; determination of transferee","status":null,"guid":"id72a3238c-4aa7-11eb-94f5-9ff2c44f6f3c","source_credit":"(Aug. 4, 1955, ch. 543, ch. 8, § 84, 69 Stat. 481.)","seq_in_title":3153,"parent_identifier":"/us/usc/t42/ch24/schVII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch24","level":"chapter","num":"CHAPTER 24—","heading":"DISPOSAL OF ATOMIC ENERGY COMMUNITIES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch24/schVII","level":"subchapter","num":"SUBCHAPTER VII—","heading":"MUNICIPALITIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id42eeb4ee-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384\"><num value=\"2384\">§ 2384.</num><heading> Transfer to governmental entity or private nonprofit organization; determination of transferee</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id42eeb4ef-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/a\"><num value=\"a\">(a)</num><content> Transfers may be made to one or more of the following, if the entity has the legal authority to receive the installation: (1) the city at the community; (2) the State in which the community is located; (3) any political subdivision or agency of that State; or (4) a private nonprofit organization in the case of the hospital installation or cemetery at the community.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id42eeb4f0-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/b\"><num value=\"b\">(b)</num><chapeau> In determining the entity to which school, hospital, and other municipal installations, respectively, shall be transferred, the Commission shall be governed, in order, by</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4f1-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/b/1\"><num value=\"1\">(1)</num><content> the results of a vote in which the eligible voters in the community expressed themselves directly on the transfer in the vote on the incorporation of the city;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4f2-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/b/2\"><num value=\"2\">(2)</num><content> the results of a vote in which the eligible voters have directly expressed themselves on the proposed transfer in a referendum or other officially recognized procedure;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4f3-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/b/3\"><num value=\"3\">(3)</num><content> there being only one entity which is legally authorized to receive the municipal installation; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id42eeb4f4-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s2384/b/4\"><num value=\"4\">(4)</num><content> in the absence of the other alternatives, the Commission has conducted a vote of the eligible voters of the community on the proposed transfer under such procedures as it may establish.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id42eeb4f5-3271-11e3-ab2f-8f7fedb88afd\">(<ref href=\"/us/act/1955-08-04/ch543\">Aug. 4, 1955, ch. 543</ref>, ch. 8, § 84, <ref href=\"/us/stat/69/481\">69 Stat. 481</ref>.)</sourceCredit>\n<notes type=\"uscNote\" id=\"id42eeb4f6-3271-11e3-ab2f-8f7fedb88afd\">\n<note style=\"-uslm-lc:I85\" topic=\"transferOfFunctions\" id=\"id42eeb4f7-3271-11e3-ab2f-8f7fedb88afd\">\n<heading class=\"centered smallCaps\">Transfer of Functions</heading>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Atomic Energy Commission abolished and functions transferred by sections 5814 and 5841 of this title.
