<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8812fdf9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s249"><num value="249">§ 249.</num><heading> Medical care and treatment of quarantined and detained persons</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8812fdfa-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s249/a"><num value="a" class="bold">(a)</num><heading class="bold"> Persons entitled to treatment</heading><content><p style="-uslm-lc:I11" class="indent0">Any person when detained in accordance with quarantine laws, or, at the request of the Immigration and Naturalization Service, any person detained by that Service, may be treated and cared for by the Public Health Service.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8812fdfb-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s249/b"><num value="b" class="bold">(b)</num><heading class="bold"> Temporary treatment in emergency cases</heading><content><p style="-uslm-lc:I11" class="indent0">Persons not entitled to treatment and care at institutions, hospitals, and stations of the Service may, in accordance with regulations of the Surgeon General, be admitted thereto for temporary treatment and care in case of emergency.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8812fdfc-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s249/c"><num value="c" class="bold">(c)</num><heading class="bold"> Authorization for outside treatment</heading><content><p style="-uslm-lc:I11" class="indent0">Persons whose care and treatment is authorized by subsection (a) may, in accordance with regulations, receive such care and treatment at the expense of the Service from public or private medical or hospital facilities other than those of the Service, when authorized by the officer in charge of the station at which the application is made.</p>

<p style="-uslm-lc:I21" class="indent0">Functions of Public Health Service, Surgeon General of Public Health Service, and all other officers and employees of Public Health Service, and functions of all agencies of or in Public Health Service transferred to Secretary of Health, Education, and Welfare by Reorg. Plan No. 3 of 1966, eff. <date date="1966-06-25">June 25, 1966</date>, 31 F.R. 8855, <ref href="/us/stat/80/1610">80 Stat. 1610</ref>, set out as a note under <ref href="/us/usc/t42/s202">section 202 of this title</ref>. Secretary of Health, Education, and Welfare redesignated Secretary of Health and Human Services by <ref href="/us/pl/96/88/s509/b">section 509(b) of Pub. L. 96–88</ref> which is classified to <ref href="/us/usc/t20/s3508/b">section 3508(b) of Title 20</ref>, Education.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><chapeau> The Secretary shall provide, by contract or other arrangement with a Federal entity and without charge but subject to subsection (b), for the continuation of inpatient hospital services (and outpatient services related to the condition of hospitalization) to any individual who—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> on <date date="1981-09-30">September 30, 1981</date>, is receiving inpatient hospital services at a Public Health Service hospital on the basis of the entitlement contained in section 322(a) of the Public Health Service Act (<ref href="/us/usc/t42/s249/a">42 U.S.C. 249(a)</ref>), as such section was in effect on such date, for treatment of a condition,</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> requires continued hospitalization after such date for treatment of that condition (or requires outpatient services related to such condition), and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the Secretary determines has no other source of inpatient hospital services available for continued treatment of that condition.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><chapeau> Services may not be provided under subsection (a) to an individual after the earlier of—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> <date date="1982-09-30">September 30, 1982</date>,</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the end of the first 60-day consecutive period (beginning after <date date="1981-09-30">September 30, 1981</date>) during the entire period of which the individual is not an inpatient of a hospital.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><content> Notwithstanding any other provision of law, the head of any Federal department or agency which provides, under other authority of law and through federal facilities, inpatient hospital services or outpatient services, or both, is authorized to provide inpatient hospital services (and related outpatient services) to individuals under contract or other arrangement with the Secretary pursuant to this section.”</content>
