value=\"254d\">§ 254d.</num><heading> National Health Service Corps</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4322923-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment; composition; purpose; definitions</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4322924-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/1\"><num value=\"1\">(1)</num><chapeau> For the purpose of eliminating health manpower shortages in health professional shortage areas, there is established, within the Service, the National Health Service Corps, which shall consist of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4322925-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/1/A\"><num value=\"A\">(A)</num><content> such officers of the Regular and Reserve Corps <ref class=\"footnoteRef\" idref=\"fn002069\">1</ref><note type=\"footnote\" id=\"fn002069\"><num>1</num> See Change of Name note below.</note> of the Service as the Secretary may designate,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4322926-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/1/B\"><num value=\"B\">(B)</num><content> such civilian employees of the United States as the Secretary may appoint, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4322927-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/1/C\"><num value=\"C\">(C)</num><content> such other individuals who are not employees of the United States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4322928-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/2\"><num value=\"2\">(2)</num><content> The Corps shall be utilized by the Secretary to provide primary health services in health professional shortage areas.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4322929-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3\"><num value=\"3\">(3)</num><chapeau> For purposes of this subpart and subpart III:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/A\"><num value=\"A\">(A)</num><content> The term “Corps” means the National Health Service Corps.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/B\"><num value=\"B\">(B)</num><content> The term “Corps member” means each of the officers, employees, and individuals of which the Corps consists pursuant to paragraph (1).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/C\"><num value=\"C\">(C)</num><content> The term “health professional shortage area” has the meaning given such term in <ref href=\"/us/usc/t42/s254e/a\">section 254e(a) of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/D\"><num value=\"D\">(D)</num><content> The term “primary health services” means health services regarding family medicine, internal medicine, pediatrics, obstetrics and gynecology, dentistry, or mental health, that are provided by physicians or other health professionals.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/E\"><num value=\"E\">(E)</num><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432503f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/E/i\"><num value=\"i\">(i)</num><content> The term “behavioral and mental health professionals” means health service psychologists, licensed clinical social workers, licensed professional counselors, marriage and family therapists, psychiatric nurse specialists, and psychiatrists.</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4325040-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/a/3/E/ii\"><num value=\"ii\">(ii)</num><content> The term “graduate program of behavioral and mental health” means a program that trains behavioral and mental health professionals.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4325041-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Recruitment and fellowship programs</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4325042-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/b/1\"><num value=\"1\">(1)</num><content> The Secretary may conduct at schools of medicine, osteopathic medicine, dentistry, and, as appropriate, nursing and other schools of the health professions, including schools at which graduate programs of behavioral and mental health are offered, and at entities which train allied health personnel, recruiting programs for the Corps, the Scholarship Program, and the Loan Repayment Program. Such recruiting programs shall include efforts to recruit individuals who will serve in the Corps other than pursuant to obligated service under the Scholarship or Loan Repayment Program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4325043-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/b/2\"><num value=\"2\">(2)</num><content> In the case of physicians, dentists, behavioral and mental health professionals, certified nurse midwives, certified nurse practitioners, and physician assistants who have an interest and a commitment to providing primary health care, the Secretary may establish fellowship programs to enable such health professionals to gain exposure to and expertise in the delivery of primary health services in health professional shortage areas. To the maximum extent practicable, the Secretary shall ensure that any such programs are established in conjunction with accredited residency programs, and other training programs, regarding such health professions.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4325044-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Travel and moving expenses; persons entitled; reimbursement; limitation</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4325045-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/c/1\"><num value=\"1\">(1)</num><content> The Secretary may reimburse an applicant for a position in the Corps (including an individual considering entering into a written agreement pursuant to <ref href=\"/us/usc/t42/s254n\">section 254n of this title</ref>) for the actual and reasonable expenses incurred in traveling to and from the applicant’s place of residence to an eligible site to which the applicant may be assigned under <ref href=\"/us/usc/t42/s254f\">section 254f of this title</ref> for the purpose of evaluating such site with regard to being assigned at such site. The Secretary may establish a maximum total amount that may be paid to an individual as reimbursement for such expenses.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4327756-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/c/2\"><num value=\"2\">(2)</num><content> The Secretary may also reimburse the applicant for the actual and reasonable expenses incurred for the travel of 1 family member to accompany the applicant to such site. The Secretary may establish a maximum total amount that may be paid to an individual as reimbursement for such expenses.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4327757-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/c/3\"><num value=\"3\">(3)</num><content> In the case of an individual who has entered into a contract for obligated service under the Scholarship Program or under the Loan Repayment Program, the Secretary may reimburse such individual for all or part of the actual and reasonable expenses incurred in transporting the individual, the individual’s family, and the family’s possessions to the site of the individual’s assignment under <ref href=\"/us/usc/t42/s254f\">section 254f of this title</ref>. The Secretary may establish a maximum total amount that may be paid to an individual as reimbursement for such expenses.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4327758-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Monthly pay adjustments of members directly engaged in delivery of health services in health professional shortage area; “monthly pay” defined; monthly pay adjustment of member with service obligation incurred under Scholarship Program or Loan Repayment Program; personnel system applicable</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4327759-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/1\"><num value=\"1\">(1)</num><chapeau> The Secretary may, under regulations promulgated by the Secretary, adjust the monthly pay of each member of the Corps (other than a member described in subsection (a)(1)(C)) who is directly engaged in the delivery of health services in a health professional shortage area as follows:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432775a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/1/A\"><num value=\"A\">(A)</num><content> During the first 36 months in which such a member is so engaged in the delivery of health services, his monthly pay may be increased by an amount which when added to the member’s monthly pay and allowances will provide a monthly income competitive with the average monthly income from a practice of an individual who is a member of the profession of the Corps member, who has equivalent training, and who has been in practice for a period equivalent to the period during which the Corps member has been in practice.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432775b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/1/B\"><num value=\"B\">(B)</num><content> During the period beginning upon the expiration of the 36 months referred to in subparagraph (A) and ending with the month in which the member’s monthly pay and allowances are equal to or exceed the monthly income he received for the last of such 36 months, the member may receive in addition to his monthly pay and allowances an amount which when added to such monthly pay and allowances equals the monthly income he received for such last month.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432775c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/1/C\"><num value=\"C\">(C)</num><content> For each month in which a member is directly engaged in the delivery of health services in a health professional shortage area in accordance with an agreement with the Secretary entered into under section 294n(f)(1)(C) <ref class=\"footnoteRef\" idref=\"fn002070\">2</ref><note type=\"footnote\" id=\"fn002070\"><num>2</num> See References in Text note below.</note> of this title, under which the Secretary is obligated to make payments in accordance with section 294n(f)(2) <ref class=\"footnoteRef\" idref=\"fn002070\">2</ref> of this title, the amount of any monthly increase under subparagraph (A) or (B) with respect to such member shall be decreased by an amount equal to one-twelfth of the amount which the Secretary is obligated to pay upon the completion of the year of practice in which such month occurs.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">For purposes of subparagraphs (A) and (B), the term “monthly pay” includes special pay received under chapter 5 of title 37.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4329e6d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/2\"><num value=\"2\">(2)</num><content> In the case of a member of the Corps who is directly engaged in the delivery of health services in a health professional shortage area in accordance with a service obligation incurred under the Scholarship Program or the Loan Repayment Program, the adjustment in pay authorized by paragraph (1) may be made for such a member only upon satisfactory completion of such service obligation, and the first 36 months of such member’s being so engaged in the delivery of health services shall, for purposes of paragraph (1)(A), be deemed to begin upon such satisfactory completion.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4329e6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/d/3\"><num value=\"3\">(3)</num><content> A member of the Corps described in subparagraph (C) of subsection (a)(1) shall when assigned to an entity under <ref href=\"/us/usc/t42/s254f\">section 254f of this title</ref> be subject to the personnel system of such entity, except that such member shall receive during the period of assignment the income that the member would receive if the member was a member of the Corps described in subparagraph (B) of such subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4329e6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Employment ceiling of Department not affected by Corps members</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Corps members assigned under <ref href=\"/us/usc/t42/s254f\">section 254f of this title</ref> to provide health services in health professional shortage areas shall not be counted against any employment ceiling affecting the Department.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4329e70-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Assignment of personnel provisions inapplicable to members whose service obligation incurred under Scholarship Program or Loan Repayment Program</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Sections 215 and 217 of this title shall not apply to members of the National Health Service Corps during their period of obligated service under the Scholarship Program or the Loan Repayment Program, except when such members are Commissioned Corps officers who entered into a contract with <ref class=\"footnoteRef\" idref=\"fn002071\">3</ref><note type=\"footnote\" id=\"fn002071\"><num>3</num> So in original. The word “the” probably should appear.</note> Secretary under section 254<i>l</i> or 254<i>l</i>–1 of this title after <date date=\"2006-12-31\">December 31, 2006</date> and when the Secretary determines that exercising the authority provided under section 215 or 217 of this title with respect to any such officer to <ref class=\"footnoteRef\" idref=\"fn002072\">4</ref><note type=\"footnote\" id=\"fn002072\"><num>4</num> So in original.</note> would not cause unreasonable disruption to health care services provided in the community in which such officer is providing health care services.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida432c581-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Conversion from Corps member to commissioned officer; retirement credits</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida432c582-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/g/1\"><num value=\"1\">(1)</num><content> The Secretary shall, by rule, prescribe conversion provisions applicable to any individual who, within a year after completion of service as a member of the Corps described in subsection (a)(1)(C), becomes a commissioned officer in the Regular or Reserve Corps <sup>1</sup> of the Service.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida432c583-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/g/2\"><num value=\"2\">(2)</num><content> The rules prescribed under paragraph (1) shall provide that in applying the appropriate provisions of this chapter which relate to retirement, any individual who becomes such an officer shall be entitled to have credit for any period of service as a member of the Corps described in subsection (a)(1)(C).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida432c584-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Effective administration of program</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall ensure that adequate staff is provided to the Service with respect to effectively administering the program for the Corps.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida432c585-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Demonstration projects; waivers</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida432c586-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/1\"><num value=\"1\">(1)</num><content> In carrying out subpart III, the Secretary may, in accordance with this subsection, issue waivers to individuals who have entered into a contract for obligated service under the Scholarship Program or the Loan Repayment Program under which the individuals are authorized to satisfy the requirement of obligated service through providing clinical practice that is half time.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida432c587-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2\"><num value=\"2\">(2)</num><chapeau> A waiver described in paragraph (1) may be provided by the Secretary only if—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432c588-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/A\"><num value=\"A\">(A)</num><chapeau> the entity for which the service is to be performed—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida432c589-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/A/i\"><num value=\"i\">(i)</num><content> has been approved under <ref href=\"/us/usc/t42/s254f–1\">section 254f–1 of this title</ref> for assignment of a Corps member; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida432c58a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/A/ii\"><num value=\"ii\">(ii)</num><content> has requested in writing assignment of a health professional who would serve half time;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432c58b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/B\"><num value=\"B\">(B)</num><content> the Secretary has determined that assignment of a health professional who would serve half time would be appropriate for the area where the entity is located;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432c58c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/C\"><num value=\"C\">(C)</num><content> a Corps member who is required to perform obligated service has agreed in writing to be assigned for half-time service to an entity described in subparagraph (A);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432c58d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/D\"><num value=\"D\">(D)</num><content> the entity and the Corps member agree in writing that the Corps member will perform half-time clinical practice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432c58e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/E\"><num value=\"E\">(E)</num><chapeau> the Corps member agrees in writing to fulfill all of the service obligations under <ref href=\"/us/usc/t42/s254m\">section 254m of this title</ref> through half-time clinical practice and either—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida432c58f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/E/i\"><num value=\"i\">(i)</num><content> double the period of obligated service that would otherwise be required; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida432c590-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/E/ii\"><num value=\"ii\">(ii)</num><content> in the case of contracts entered into under section 254<i>l</i>–1 of this title, accept a minimum service obligation of 2 years with an award amount equal to 50 percent of the amount that would otherwise be payable for full-time service; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/2/F\"><num value=\"F\">(F)</num><content> the Corps member agrees in writing that if the Corps member begins providing half-time service but fails to begin or complete the period of obligated service, the method stated in 254<i>o</i>(c) of this title for determining the damages for breach of the individual’s written contract will be used after converting periods of obligated service or of service performed into their full-time equivalents.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida432eca2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/i/3\"><num value=\"3\">(3)</num><content> In evaluating waivers issued under paragraph (1), the Secretary shall examine the effect of multidisciplinary teams.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida432eca3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For the purposes of this subpart and subpart III:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/1\"><num value=\"1\">(1)</num><content> The term “Department” means the Department of Health and Human Services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/2\"><num value=\"2\">(2)</num><content> The term “Loan Repayment Program” means the National Health Service Corps Loan Repayment Program established under section 254<i>l</i>–1 of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/3\"><num value=\"3\">(3)</num><content> The term “Scholarship Program” means the National Health Service Corps Scholarship Program established under section 254<i>l</i> of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/4\"><num value=\"4\">(4)</num><content> The term “State” includes, in addition to the several States, only the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Virgin Islands, Guam, American Samoa, and the Trust Territory of the Pacific Islands.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/5\"><num value=\"5\">(5)</num><content> The terms “full time” and “full-time” mean a minimum of 40 hours per week in a clinical practice, for a minimum of 45 weeks per year.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida432eca9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254d/j/6\"><num value=\"6\">(6)</num><content> The terms “half time” and “half-time” mean a minimum of 20 hours per week (not to exceed 39 hours per week) in a clinical practice, for a minimum of 45 weeks per year.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida432ecaa-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1944-07-01/ch373\">July 1, 1944, ch. 373</ref>, title III, § 331, as added <ref href=\"/us/pl/94/484/tIV/s407/b/3\">Pub. on such date and in which National Health Service Corps personnel were, on such date, providing, under an assignment made under such section (as so in effect), health care and services for persons residing in such area shall, effective <date date=\"1977-10-01\">October 1, 1977</date>, be considered under subpart II of part C of title III of such Act (as added by subsection (b) of this section) [<ref href=\"/us/usc/t42/s254d\">42 U.S.C. 254d</ref> et seq.] to (i) be designated a health manpower shortage area (as defined by section 332 of such Act (as so added)) [<ref href=\"/us/usc/t42/s254e\">42 U.S.C. 254e</ref>], and (ii) have had an application approved under section 333 of such Act (as so added)) [<ref href=\"/us/usc/t42/s254f\">42 U.S.C. 254f</ref>] for the assignment of Corps personnel unless, as determined under subparagraph (B) of this paragraph, the assignment period applicable to such area (within the meaning of section 334 (as so added)) [former <ref href=\"/us/usc/t42/s254g\">42 U.S.C. 254g</ref>] has expired.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"B\">“(B)</num><content> The assignment period (within the meaning of such section 334) [former <ref href=\"/us/usc/t42/s254g\">42 U.S.C. 254g</ref>] applicable to an area described in subparagraph (A) of this paragraph shall be considered to have begun on the date Corps personnel were first assigned to such area under section 329 of such Act (as in effect on <date date=\"1977-09-30\">September 30, 1977</date>) [former <ref href=\"/us/usc/t42/s254b\">42 U.S.C. 254b</ref>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"C\">“(C)</num><content> In the case of any physician or dentist member of the Corps who was providing health care and services on <date date=\"1977-09-30\">September 30, 1977</date>, under an assignment made under section 329(b) of such Act (as in effect on <date date=\"1977-09-30\">September 30, 1977</date>) [former <ref href=\"/us/usc/t42/s254b/b\">42 U.S.C. 254b(b)</ref>], the number of the months during which such member provided such care and services before <date date=\"1977-10-01\">October 1, 1977</date>, shall be counted in determining the application of the additional pay provisions of section 331(d) of such Act (as added by subsection (b) of this section) [<ref href=\"/us/usc/t42/s254d/d\">42 U.S.C. 254d(d)</ref>] to such number.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> The amendment made by subsection (b) which established an Advisory Council previously established under section 329 of the Public Health Service Act [former <ref href=\"/us/usc/t42/s254b\">42 U.S.C. 254b</ref>] shall not be construed as requiring the establishment of a new Advisory Council under such section 337 [<ref href=\"/us/usc/t42/s254j\">42 U.S.C. 254j</ref>], and the amendment made by such subsection with respect to the composition of such Advisory Council shall apply with respect to appointments made to the Advisory Council after <date date=\"1977-10-01\">October 1, 1977</date>, and the Secretary of Health, Education, and Welfare [now Health and Human Services] shall make appointments to the Advisory Council after such date in a manner which will bring about, at the earliest feasible time, the Advisory Council composition prescribed by the
