or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4366eb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/a/2\"><num value=\"2\">(2)</num><chapeau> because payment for the services would be made under—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4366eb3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/a/2/A\"><num value=\"A\">(A)</num><content> the medicare program under title XVIII of the Social Security Act (<ref href=\"/us/usc/t42/s1395\">42 U.S.C. 1395</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4366eb4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/a/2/B\"><num value=\"B\">(B)</num><content> the medicaid program under title XIX of such Act (<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida43695c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/a/2/C\"><num value=\"C\">(C)</num><content> the State children’s health insurance program under title XXI of such Act (<ref href=\"/us/usc/t42/s1397aa\">42 U.S.C. 1397aa</ref> et seq.).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida43695c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Charges for services</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The following rules shall apply to charges for health care services provided by an entity to which a Corps member is assigned:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida43695c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida43695c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Schedule of fees or payments</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in paragraph (2), the entity shall prepare a schedule of fees or payments for the entity’s services, consistent with locally prevailing rates or charges and designed to cover the entity’s reasonable cost of operation.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida43695c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Schedule of discounts</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in paragraph (2), the entity shall prepare a corresponding schedule of discounts (including, in appropriate cases, waivers) to be applied to the payment of such fees or payments. In preparing the schedule, the entity shall adjust the discounts on the basis of a patient’s ability to pay.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida43695ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Use of schedules</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The entity shall make every reasonable effort to secure from patients fees and payments for services in accordance with such schedules, and fees or payments shall be sufficiently discounted in accordance with the schedule described in subparagraph (B).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida43695cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Services to beneficiaries of Federal and federally assisted programs</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In the case of health care services furnished to an individual who is a beneficiary of a program listed in subsection (a)(2), the entity—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida43695cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/2/A\"><num value=\"A\">(A)</num><content> shall accept an assignment pursuant to section 1842(b)(3)(B)(ii) of the Social Security Act (<ref href=\"/us/usc/t42/s1395u/b/3/B/ii\">42 U.S.C. 1395u(b)(3)(B)(ii)</ref>) with respect to an individual who is a beneficiary under the medicare program; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida43695cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/2/B\"><num value=\"B\">(B)</num><chapeau> shall enter into an appropriate agreement with—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida43695ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/2/B/i\"><num value=\"i\">(i)</num><content> the State agency administering the program under title XIX of such Act [<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.] with respect to an individual who is a beneficiary under the medicaid program; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida43695cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> the State agency administering the program under title XXI of such Act [<ref href=\"/us/usc/t42/s1397aa\">42 U.S.C. 1397aa</ref> et seq.] with respect to an individual who is a beneficiary under the State children’s health insurance program.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida43695d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254g/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Collection of payments</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The entity shall take reasonable and appropriate steps to collect all payments due for health care services provided by the entity, including payments from any third party (including a Federal, State, or local government agency and any other third party) that is responsible for part or all of the charge for such services.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida43695d1-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1944-07-01/ch373\">July 1, 1944, ch. 373</ref>, title III, § 334, as added <ref href=\"/us/pl/107/251/tIII/s305\">Pub.
