<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4464d0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r"><num value="254r">§ 254r.</num><heading> Grants to State Offices of Rural Health</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4464d0b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary, acting through the Director of the Federal Office of Rural Health Policy (established under <ref href="/us/usc/t42/s912">section 912 of this title</ref>), shall make grants to each State Office of Rural Health for the purpose of improving health care in rural areas.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4464d0c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirement of matching funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4464d0d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees, with respect to the costs to be incurred in carrying out the purpose described in such subsection, to provide non-Federal contributions toward such costs in an amount equal to $3 for each $1 of Federal funds provided in the grant.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4464d0e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Waiver or reduction</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may waive or reduce the non-Federal contribution if the Secretary determines that requiring matching funds would limit the State office of rural health’s ability to carry out the purpose described in subsection (a).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida446741f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Determination of amount of non-Federal contribution</heading><content><p style="-uslm-lc:I12" class="indent1">Non-Federal contributions required in paragraph (1) may be in cash or in kind, fairly evaluated, including plant, equipment, or services. Amounts provided by the Federal Government, or services assisted or subsidized to any significant extent by the Federal Government, may not be included in determining the amount of such non-Federal contributions.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4467420-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c"><num value="c" class="bold">(c)</num><heading class="bold"> Certain required activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Recipients of a grant under subsection (a) shall use the grant funds for purposes of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4467421-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/1"><num value="1">(1)</num><chapeau> maintaining within the State office of rural health a clearinghouse for collecting and disseminating information on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4467422-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/1/A"><num value="A">(A)</num><content> rural health care issues;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4467423-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/1/B"><num value="B">(B)</num><content> research findings relating to rural health care; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4467424-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/1/C"><num value="C">(C)</num><content> innovative approaches to the delivery of health care in rural areas;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4467425-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/2"><num value="2">(2)</num><content> coordinating the activities carried out in the State that relate to rural health care, including providing coordination for the purpose of avoiding redundancy in such activities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4467426-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/c/3"><num value="3">(3)</num><content> identifying Federal and State programs regarding rural health, and providing technical assistance to public and nonprofit private entities regarding participation in such programs.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4469b37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/d"><num value="d" class="bold">(d)</num><heading class="bold"> Requirement regarding annual budget for office</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may not make a grant under subsection (a) unless the State involved agrees that, for any fiscal year for which the State office of rural health receives such a grant, the office operated pursuant to subsection (a) of this section will be provided with an annual budget of not less than $150,000.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4469b38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e"><num value="e" class="bold">(e)</num><heading class="bold"> Certain uses of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4469b39-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Restrictions</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees that the grant will not be expended—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4469b3a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/A"><num value="A">(A)</num><content> to provide health care (including providing cash payments regarding such care);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4469b3b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/B"><num value="B">(B)</num><chapeau> to conduct activities for which Federal funds are expended—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida4469b3c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/B/i"><num value="i">(i)</num><content> within the State to provide technical and other nonfinancial assistance under <ref href="/us/usc/t42/s254c/f">section 254c(f) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4469b3d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/B/ii"><num value="ii">(ii)</num><content> under a memorandum of agreement entered into with the State office of rural health under <ref href="/us/usc/t42/s254c/h">section 254c(h) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4469b3e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/B/iii"><num value="iii">(iii)</num><content> under a grant under <ref href="/us/usc/t42/s254q–1">section 254q–1 of this title</ref>;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4469b3f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/C"><num value="C">(C)</num><content> to purchase medical equipment, to purchase ambulances, aircraft, or other vehicles, or to purchase major communications equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida446c250-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/D"><num value="D">(D)</num><content> to purchase or improve real property; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida446c251-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/1/E"><num value="E">(E)</num><content> to carry out any activity regarding a certificate of need.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida446c252-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Authorities</heading><chapeau style="-uslm-lc:I12" class="indent1">Activities for which a State office of rural health may expend a grant under subsection (a) include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida446c253-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/2/A"><num value="A">(A)</num><content> paying the costs of maintaining an office of rural health for purposes of subsection (a);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida446c254-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/2/B"><num value="B">(B)</num><content> subject to paragraph (1)(B)(iii), paying the costs of any activity carried out with respect to recruiting and retaining health professionals to serve in rural areas of the State; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida446c255-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/2/C"><num value="C">(C)</num><content> providing grants and contracts to public and nonprofit private entities to carry out activities authorized in this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida446c256-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limit on indirect costs</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may impose a limit of no more than 15 percent on indirect costs claimed by the recipient of the grant.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida446c257-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/f"><num value="f" class="bold">(f)</num><heading class="bold"> Reports</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida446c258-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/f/1"><num value="1">(1)</num><content> to submit to the Secretary reports or performance data containing such information as the Secretary may require regarding activities carried out under this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida446e969-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/f/2"><num value="2">(2)</num><content> to submit such a report or performance data not later than September 30 of each fiscal year immediately following any fiscal year for which the State office of rural health has received such a grant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida446e96a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/g"><num value="g" class="bold">(g)</num><heading class="bold"> Requirement of application</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may not make a grant under subsection (a) unless an application for the grant is submitted to the Secretary and the application is in such form, is made in such manner, and contains such agreements, assurances, and information as the Secretary determines to be necessary to carry out such subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida446e96b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/h"><num value="h" class="bold">(h)</num><heading class="bold"> Noncompliance</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may not make payments under subsection (a) to a State office of rural health for any fiscal year subsequent to the first fiscal year of such payments unless the Secretary determines that, for the immediately preceding fiscal year, the State office of rural health has complied with each of the agreements made by the State office of rural health under this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida446e96c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/i"><num value="i" class="bold">(i)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida446e96d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s254r/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">For the purpose of making grants under subsection (a), there are authorized to be appropriated $12,500,000 for each of fiscal years 2018 through 2022.</p>
