value=\"254s\">§ 254s.</num><heading> Native Hawaiian Health Scholarships</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4473795-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Subject to the availability of funds appropriated under the authority of subsection (d), the Secretary shall provide funds to Papa Ola Lokahi for the purpose of providing scholarship assistance to students who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4475ea6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/a/1\"><num value=\"1\">(1)</num><content> meet the requirements of section 254<i>l</i>(b) of this title, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4475ea7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/a/2\"><num value=\"2\">(2)</num><content> are Native Hawaiians.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4475ea8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Terms and conditions</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4475ea9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/b/1\"><num value=\"1\">(1)</num><content> The scholarship assistance provided under subsection (a) shall be provided under the same terms and subject to the same conditions, regulations, and rules that apply to scholarship assistance provided under section 254<i>l</i> of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ida4475eaa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/b/2\"><num value=\"2\">(2)</num><content> The Native Hawaiian Health Scholarship program shall not be administered by or through the Indian Health Service.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4475eab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> “Native Hawaiian” defined</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “Native Hawaiian” means any individual who is—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4475eac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/1\"><num value=\"1\">(1)</num><content> a citizen of the United States,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4475ead-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/2\"><num value=\"2\">(2)</num><content> a resident of the State of Hawaii, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4475eae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/3\"><num value=\"3\">(3)</num><chapeau> a descendant of the aboriginal people, who prior to 1778, occupied and exercised sovereignty in the area that now constitutes the State of Hawaii, as evidenced by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4475eaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/3/A\"><num value=\"A\">(A)</num><content> genealogical records,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4475eb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/3/B\"><num value=\"B\">(B)</num><content> Kupuna (elders) or Kama’aina (long-term community residents) verification, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4475eb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/c/3/C\"><num value=\"C\">(C)</num><content> birth records of the State of Hawaii.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4475eb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s254s/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated $1,800,000 for each of the fiscal years 1990, (a). <ref href=\"/us/pl/107/116\">Pub. L. 107–116</ref>, which directed the amendment of subsec. (a) by substituting “Papa Ola Lokahi” for “Kamehameha School/Bishop Estate”, was executed by making the substitution for “Kamehameha Schools/Bishop Estate” to reflect the probable intent of Congress.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">1990—Subsec. (a). <ref href=\"/us/pl/101/644\">Pub. L. 101–644</ref>, which directed the general amendment of subsec. (a) of section 338J of the Public Health Service Act, was executed to subsec. (a) of this section, to reflect the probable intent of Congress and the intervening renumbering of section 338J as 338K by <ref href=\"/us/pl/101/597\">Pub. L. 101–597</ref>. Prior to amendment, subsec.
