<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4556883-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g"><num value="256g">§ 256g.</num><heading> Grants for innovative programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4556884-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grant program authorized</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary, acting through the Administrator of the Health Resources and Services Administration, is authorized to award grants to States for the purpose of helping States develop and implement innovative programs to address the dental workforce needs of designated dental health professional shortage areas in a manner that is appropriate to the States’ individual needs.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4558f95-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b"><num value="b" class="bold">(b)</num><heading class="bold"> State activities</heading><chapeau style="-uslm-lc:I11" class="indent0">A State receiving a grant under subsection (a) may use funds received under the grant for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4558f96-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1"><num value="1">(1)</num><chapeau> loan forgiveness and repayment programs for dentists who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4558f97-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1/A"><num value="A">(A)</num><content> agree to practice in designated dental health professional shortage areas;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4558f98-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1/B"><num value="B">(B)</num><content> are dental school graduates who agree to serve as public health dentists for the Federal, State, or local government; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4558f99-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1/C"><num value="C">(C)</num><chapeau> agree to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida4558f9a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1/C/i"><num value="i">(i)</num><content> provide services to patients regardless of such patients’ ability to pay; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4558f9b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/1/C/ii"><num value="ii">(ii)</num><content> use a sliding payment scale for patients who are unable to pay the total cost of services;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4558f9c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/2"><num value="2">(2)</num><content> dental recruitment and retention efforts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4558f9d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/3"><num value="3">(3)</num><content> grants and low-interest or no-interest loans to help dentists who participate in the medicaid program under title XIX of the Social Security Act (<ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.) to establish or expand practices in designated dental health professional shortage areas by equipping dental offices or sharing in the overhead costs of such practices;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4558f9e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/4"><num value="4">(4)</num><content> the establishment or expansion of dental residency programs in coordination with accredited dental training institutions in States without dental schools;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4558f9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5"><num value="5">(5)</num><chapeau> programs developed in consultation with State and local dental societies to expand or establish oral health services and facilities in designated dental health professional shortage areas, including services and facilities for children with special needs, such as—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4558fa0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5/A"><num value="A">(A)</num><content> the expansion or establishment of a community-based dental facility, free-standing dental clinic, consolidated health center dental facility, school-linked dental facility, or United States dental school-based facility;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida455b6b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5/B"><num value="B">(B)</num><content> the establishment of a mobile or portable dental clinic;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida455b6b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5/C"><num value="C">(C)</num><content> the establishment or expansion of private dental services to enhance capacity through additional equipment or additional hours of operation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida455b6b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5/D"><num value="D">(D)</num><content> the establishment or development of models for the provision of dental services to children and adults, such as dental homes, including for the elderly, blind, individuals with disabilities, and individuals living in long-term care facilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida455b6b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/5/E"><num value="E">(E)</num><content> the establishment of initiatives to reduce the use of emergency departments by individuals who seek dental services more appropriately delivered in a dental primary care setting;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/6"><num value="6">(6)</num><content> placement and support of dental students, dental residents, and advanced dentistry trainees;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/7"><num value="7">(7)</num><content> continuing dental education, including distance-based education;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/8"><num value="8">(8)</num><content> practice support through teledentistry conducted in accordance with State laws;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/9"><num value="9">(9)</num><content> community-based prevention services such as water fluoridation and dental sealant programs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/10"><num value="10">(10)</num><content> coordination with local educational agencies within the State to foster programs that promote children going into oral health or science professions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/11"><num value="11">(11)</num><content> the establishment of faculty recruitment programs at accredited dental training institutions whose mission includes community outreach and service and that have a demonstrated record of serving underserved States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455b6bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/12"><num value="12">(12)</num><content> the development of a State dental officer position or the augmentation of a State dental office to coordinate oral health and access issues in the State; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida455ddcc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/b/13"><num value="13">(13)</num><content> any other activities determined to be appropriate by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida455ddcd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/c"><num value="c" class="bold">(c)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida455ddce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each State desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida455ddcf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Assurances</heading><content><p style="-uslm-lc:I12" class="indent1">The application shall include assurances that the State will meet the requirements of subsection (d) and that the State possesses sufficient infrastructure to manage the activities to be funded through the grant and to evaluate and report on the outcomes resulting from such activities.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida455ddd0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/d"><num value="d" class="bold">(d)</num><heading class="bold"> Matching requirement</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may not make a grant to a State under this section unless that State agrees that, with respect to the costs to be incurred by the State in carrying out the activities for which the grant was awarded, the State will provide non-Federal contributions in an amount equal to not less than 40 percent of Federal funds provided under the grant. The State may provide the contributions in cash or in kind, fairly evaluated, including plant, equipment, and services and may provide the contributions from State, local, or private sources.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida455ddd1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/e"><num value="e" class="bold">(e)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 5 years after <date date="2002-10-26">October 26, 2002</date>, the Secretary shall prepare and submit to the appropriate committees of Congress a report containing data relating to whether grants provided under this section have increased access to dental services in designated dental health professional shortage areas.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida455ddd2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s256g/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to carry out this section, $13,903,000 for each of fiscal years 2019 through 2023.</p>
