<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4709166-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274"><num value="274">§ 274.</num><heading> Organ procurement and transplantation network</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4709167-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/a"><num value="a" class="bold">(a)</num><heading class="bold"> Contract authority of Secretary; limitation; available appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall by contract provide for the establishment and operation of an Organ Procurement and Transplantation Network which meets the requirements of subsection (b). The amount provided under such contract in any fiscal year may not exceed $7,000,000. Funds for such contracts shall be made available from funds available to the Public Health Service from appropriations for fiscal years beginning after fiscal year 1984.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4709168-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b"><num value="b" class="bold">(b)</num><heading class="bold"> Functions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida4709169-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/1"><num value="1">(1)</num><chapeau> The Organ Procurement and Transplantation Network shall carry out the functions described in paragraph (2) and shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida470916a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/1/A"><num value="A">(A)</num><content> be a private nonprofit entity that has an expertise in organ procurement and transplantation, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470916b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/1/B"><num value="B">(B)</num><chapeau> have a board of directors—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida470916c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/1/B/i"><num value="i">(i)</num><content> that includes representatives of organ procurement organizations (including organizations that have received grants under <ref href="/us/usc/t42/s273">section 273 of this title</ref>), transplant centers, voluntary health associations, and the general public; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida470916d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/1/B/ii"><num value="ii">(ii)</num><content> that shall establish an executive committee and other committees, whose chairpersons shall be selected to ensure continuity of leadership for the board.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida470916e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2"><num value="2">(2)</num><chapeau> The Organ Procurement and Transplantation Network shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida470916f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/A"><num value="A">(A)</num><chapeau> establish in one location or through regional centers—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida4709170-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/A/i"><num value="i">(i)</num><content> a national list of individuals who need organs, and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida470b881-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/A/ii"><num value="ii">(ii)</num><content> a national system, through the use of computers and in accordance with established medical criteria, to match organs and individuals included in the list, especially individuals whose immune system makes it difficult for them to receive organs,</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b882-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/B"><num value="B">(B)</num><content> establish membership criteria and medical criteria for allocating organs and provide to members of the public an opportunity to comment with respect to such criteria,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b883-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/C"><num value="C">(C)</num><content> maintain a twenty-four-hour telephone service to facilitate matching organs with individuals included in the list,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b884-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/D"><num value="D">(D)</num><content> assist organ procurement organizations in the nationwide distribution of organs equitably among transplant patients,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b885-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/E"><num value="E">(E)</num><content> adopt and use standards of quality for the acquisition and transportation of donated organs,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b886-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/F"><num value="F">(F)</num><content> prepare and distribute, on a regionalized basis (and, to the extent practicable, among regions or on a national basis), samples of blood sera from individuals who are included on the list and whose immune system makes it difficult for them to receive organs, in order to facilitate matching the compatibility of such individuals with organ donors,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b887-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/G"><num value="G">(G)</num><content> coordinate, as appropriate, the transportation of organs from organ procurement organizations to transplant centers,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b888-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/H"><num value="H">(H)</num><content> provide information to physicians and other health professionals regarding organ donation,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b889-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/I"><num value="I">(I)</num><content> collect, analyze, and publish data concerning organ donation and transplants,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b88a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/J"><num value="J">(J)</num><content> carry out studies and demonstration projects for the purpose of improving procedures for organ procurement and allocation,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b88b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/K"><num value="K">(K)</num><content> work actively to increase the supply of donated organs,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b88c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/L"><num value="L">(L)</num><content> submit to the Secretary an annual report containing information on the comparative costs and patient outcomes at each transplant center affiliated with the organ procurement and transplantation network,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470b88d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/M"><num value="M">(M)</num><content> recognize the differences in health and in organ transplantation issues between children and adults throughout the system and adopt criteria, polices, and procedures that address the unique health care needs of children,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470df9e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/N"><num value="N">(N)</num><content> carry out studies and demonstration projects for the purpose of improving procedures for organ donation procurement and allocation, including but not limited to projects to examine and attempt to increase transplantation among populations with special needs, including children and individuals who are members of racial or ethnic minority groups, and among populations with limited access to transportation, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470df9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/2/O"><num value="O">(O)</num><content> provide that for purposes of this paragraph, the term “children” refers to individuals who are under the age of 18.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida470dfa0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Clarification</inline>.—</heading><chapeau>In adopting and using standards of quality under paragraph (2)(E), the Organ Procurement and Transplantation Network may adopt and use such standards with respect to organs infected with human immunodeficiency virus (in this paragraph referred to as “HIV”), provided that any such standards ensure that organs infected with HIV may be transplanted only into individuals who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida470dfa1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/3/A"><num value="A">(A)</num><content> are infected with HIV before receiving such organ; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida470dfa2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/3/B"><num value="B">(B)</num><clause style="-uslm-lc:I12" class="indent1" id="ida470dfa3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/3/B/i"><num value="i">(i)</num><content> are participating in clinical research approved by an institutional review board under the criteria, standards, and regulations described in subsections (a) and (b) of <ref href="/us/usc/t42/s274f–5">section 274f–5 of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida470dfa4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/b/3/B/ii"><num value="ii">(ii)</num><content> if the Secretary has determined under <ref href="/us/usc/t42/s274f–5/c">section 274f–5(c) of this title</ref> that participation in such clinical research, as a requirement for such transplants, is no longer warranted, are receiving a transplant under the standards and regulations under <ref href="/us/usc/t42/s274f–5/c">section 274f–5(c) of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida470dfa5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/c"><num value="c" class="bold">(c)</num><heading class="bold"> Consideration of critical comments</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish procedures for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida470dfa6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/c/1"><num value="1">(1)</num><content> receiving from interested persons critical comments relating to the manner in which the Organ Procurement and Transplantation Network is carrying out the duties of the Network under subsection (b); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida470dfa7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s274/c/2"><num value="2">(2)</num><content> the consideration by the Secretary of such critical comments.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> a comparison of the number of transplants performed, the mortality rate for individuals on the transplant waiting lists, and the post-transplant survival rate nationally and by region prior to and after the heart allocation policy change of 2006; and</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Limitation on Funding</inline>.—</heading><content>The increase provided for in the amendment made by section 2 [amending this section] shall not apply with respect to contracts entered into under section 372(a) of the Public Health Service Act (<ref href="/us/usc/t42/s274/a">42 U.S.C. 274(a)</ref>) after the date that is 1 year after the date of enactment of this Act [<date date="2008-10-15">Oct. 15, 2008</date>] if the Executive Director of the Organ Procurement and Transplantation Network fails to submit the report under subsection (a).”</content>
