Bill Young Cell Transplantation Program","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida47461e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k\"><num value=\"274k\">§ 274k.</num><heading> National Program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida47461e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall by one or more contracts establish and maintain a C.W. Bill Young Cell Transplantation Program (referred to in this section as the “Program”), successor to the National Bone Marrow Donor Registry, that has the purpose of increasing the number of transplants for recipients suitably matched to biologically unrelated donors of bone marrow and cord blood, and that meets the requirements of this section. The Secretary may award a separate contract to perform each of the major functions of the Program described in paragraphs (1) and (2) of subsection (d) if deemed necessary by the Secretary to operate an effective and efficient system that is in the best interest of patients. The Secretary shall conduct a separate competition for the initial establishment of the cord blood functions of the Program. The Program shall be under the general supervision of the Secretary. The Secretary shall establish an Advisory Council to advise, assist, consult with, and make recommendations to the Secretary on matters related to the activities carried out by the Program. The members of the Advisory Council shall be appointed in accordance with the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida47461e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/1\"><num value=\"1\">(1)</num><chapeau> Each member of the Advisory Council shall serve for a term of 2 years, and each such member may serve as many as 3 consecutive 2-year terms, except that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida47461ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/1/A\"><num value=\"A\">(A)</num><content> such limitations shall not apply to the Chair of the Advisory Council (or the Chair-elect) or to the member of the Advisory Council who most recently served as the Chair; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida47461eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/1/B\"><num value=\"B\">(B)</num><content> one additional consecutive 2-year term may be served by any member of the Advisory Council who has no employment, governance, or financial affiliation with any donor center, recruitment organization, transplant center, or cord blood bank.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida47488fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/2\"><num value=\"2\">(2)</num><content> A member of the Advisory Council may continue to serve after the expiration of the term of such member until a successor is appointed.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida47488fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/3\"><num value=\"3\">(3)</num><content> In order to ensure the continuity of the Advisory Council, the Advisory Council shall be appointed so that each year the terms of approximately one-third of the members of the Advisory Council expire.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida47488fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/4\"><num value=\"4\">(4)</num><chapeau> The membership of the Advisory Council—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida47488ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/4/A\"><num value=\"A\">(A)</num><content> shall include as voting members a balanced number of representatives including representatives of marrow donor centers and marrow transplant centers, representatives of cord blood banks and participating birthing hospitals, recipients of a bone marrow transplant, recipients of a cord blood transplant, persons who require such transplants, family members of such a recipient or family members of a patient who has requested the assistance of the Program in searching for an unrelated donor of bone marrow or cord blood, persons with expertise in bone marrow and cord blood transplantation, persons with expertise in typing, matching, and transplant outcome data analysis, persons with expertise in the social sciences, basic scientists with expertise in the biology of adult stem cells, and members of the general public; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4748900-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/4/B\"><num value=\"B\">(B)</num><content> shall include as nonvoting members representatives from the Department of Defense Marrow Donor Recruitment and Research Program operated by the Department of the Navy, the Division of Transplantation of the Health Resources and Services Administration, the Food and Drug Administration, and the National Institutes of Health.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4748901-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/5\"><num value=\"5\">(5)</num><chapeau> Members of the Advisory Council shall be chosen so as to ensure objectivity and balance and reduce the potential for conflicts of interest. The Secretary shall establish bylaws and procedures—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4748902-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/5/A\"><num value=\"A\">(A)</num><content> to prohibit any member of the Advisory Council who has an employment, governance, or financial affiliation with a donor center, recruitment organization, transplant center, or cord blood bank from participating in any decision that materially affects the center, recruitment organization, transplant center, or cord blood bank; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4748903-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/5/B\"><num value=\"B\">(B)</num><content> to limit the number of members of the Advisory Council with any such affiliation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida474b014-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/a/6\"><num value=\"6\">(6)</num><content> The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall submit to Congress an annual report on the activities carried out under this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida474b015-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Accreditation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall, through a public process, recognize one or more accreditation entities for the accreditation of cord blood banks.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida474b016-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Informed consent</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall, through a public process, examine issues of informed consent, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida474b017-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/c/1\"><num value=\"1\">(1)</num><content> the appropriate timing of such consent; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida474b018-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/c/2\"><num value=\"2\">(2)</num><content> the information provided to the maternal donor regarding all of her medically appropriate cord blood options.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Based on such examination, the Secretary shall require that the standards used by the accreditation entities recognized under subsection (b) ensure that a cord blood unit is acquired with the informed consent of the maternal donor.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida474b019-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Functions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida474b01a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Bone marrow functions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">With respect to bone marrow, the Program shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474b01b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/A\"><num value=\"A\">(A)</num><content> operate a system for identifying, matching, and facilitating the distribution of bone marrow that is suitably matched to candidate patients;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474b01c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/B\"><num value=\"B\">(B)</num><content> consistent with paragraph (3), permit transplant physicians, other appropriate health care professionals, and patients to search by means of electronic access all available bone marrow donors listed in the Program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474b01d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/C\"><num value=\"C\">(C)</num><content> carry out a program for the recruitment of bone marrow donors in accordance with subsection (e), including with respect to increasing the representation of racial and ethnic minority groups (including persons of mixed ancestry) in the enrollment of the Program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474b01e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/D\"><num value=\"D\">(D)</num><content> maintain and expand medical contingency response capabilities, in coordination with Federal programs, to prepare for and respond effectively to biological, chemical, or radiological attacks, and other public health emergencies that can damage marrow, so that the capability of supporting patients with marrow damage from disease can be used to support casualties with marrow damage;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d72f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/E\"><num value=\"E\">(E)</num><content> carry out informational and educational activities in accordance with subsection (e);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d730-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/F\"><num value=\"F\">(F)</num><content> at least annually update information to account for changes in the status of individuals as potential donors of bone marrow;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d731-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/G\"><num value=\"G\">(G)</num><content> provide for a system of patient advocacy through the office established under subsection (h);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d732-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/H\"><num value=\"H\">(H)</num><content> provide case management services for any potential donor of bone marrow to whom the Program has provided a notice that the potential donor may be suitably matched to a particular patient through the office established under subsection (h);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d733-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/I\"><num value=\"I\">(I)</num><content> with respect to searches for unrelated donors of bone marrow that are conducted through the system under subparagraph (A), collect, analyze, and publish data in a standardized electronic format on the number and percentage of patients at each of the various stages of the search process, including data regarding the furthest stage reached, the number and percentage of patients who are unable to complete the search process, and the reasons underlying such circumstances;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d734-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/J\"><num value=\"J\">(J)</num><content> support studies and demonstration and outreach projects for the purpose of increasing the number of individuals who are willing to be marrow donors to ensure a genetically diverse donor pool; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida474d735-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/1/K\"><num value=\"K\">(K)</num><content> facilitate research with the appropriate Federal agencies to improve the availability, efficiency, safety, and cost of transplants from unrelated donors and the effectiveness of Program operations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida474d736-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Cord blood functions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida474d737-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">With respect to cord blood, the Program shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474d738-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/i\"><num value=\"i\">(i)</num><content> operate a system for identifying, matching, and facilitating the distribution of donated cord blood units that are suitably matched to candidate patients and meet all applicable Federal and State regulations (including informed consent and Food and Drug Administration regulations) from a qualified cord blood bank;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe49-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> consistent with paragraph (3), allow transplant physicians, other appropriate health care professionals, and patients to search by means of electronic access all available cord blood units made available through the Program;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe4a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/iii\"><num value=\"iii\">(iii)</num><content> allow transplant physicians and other appropriate health care professionals to reserve, as defined by the Secretary, a cord blood unit for transplantation;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe4b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/iv\"><num value=\"iv\">(iv)</num><chapeau> support and expand new and existing studies and demonstration and outreach projects for the purpose of increasing cord blood unit donation and collection from a genetically diverse population and expanding the number of cord blood unit collection sites partnering with cord blood banks receiving a contract under the National Cord Blood Inventory program under section 2 of the Stem Cell Therapeutic and Research Act of 2005, including such studies and projects that focus on—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida474fe4c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/iv/I\"><num value=\"I\">(I)</num><content> remote collection of cord blood units, consistent with the requirements under the Program and the National Cord Blood Inventory program goal described in section 2(a) of the Stem Cell Therapeutic and Research Act of 2005; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida474fe4d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/iv/II\"><num value=\"II\">(II)</num><content> exploring novel approaches or incentives to encourage innovative technological advances that could be used to collect cord blood units, consistent with the requirements under the Program and such National Cord Blood Inventory program goal;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe4e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/v\"><num value=\"v\">(v)</num><content> provide for a system of patient advocacy through the office established under subsection (h);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe4f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/vi\"><num value=\"vi\">(vi)</num><content> coordinate with the qualified cord blood banks to support informational and educational activities in accordance with subsection (g);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida474fe50-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/vii\"><num value=\"vii\">(vii)</num><content> maintain and expand medical contingency response capabilities, in coordination with Federal programs, to prepare for and respond effectively to biological, chemical, or radiological attacks, and other public health emergencies that can damage marrow, so that the capability of supporting patients with marrow damage from disease can be used to support casualties with marrow damage; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4752561-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/A/viii\"><num value=\"viii\">(viii)</num><content> with respect to the system under subparagraph (A), collect, analyze, and publish data in a standardized electronic format, as required by the Secretary, on the number and percentage of patients at each of the various stages of the search process, including data regarding the furthest stage reached, the number and percentage of patients who are unable to complete the search process, and the reasons underlying such circumstances.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4752562-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Efforts to increase collection of high quality cord blood units</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In carrying out subparagraph (A)(iv), not later than 1 year after <date date=\"2010-10-08\">October 8, 2010</date>, and annually thereafter, the Secretary shall set an annual goal of increasing collections of high quality cord blood units,<ref class=\"footnoteRef\" idref=\"fn002120\">1</ref><note type=\"footnote\" id=\"fn002120\"><num>1</num> See 2015 Amendment note below.</note> consistent with the inventory goal described in section 2(a) of the Stem Cell Therapeutic and Research Act of 2005 (referred to in this subparagraph as the “inventory goal”), and shall identify at least one project under subparagraph (A)(iv) to replicate and expand nationwide, as appropriate. If the Secretary cannot identify a project as described in the preceding sentence, the Secretary shall submit a plan, not later than 180 days after the date on which the Secretary was required to identify such a project, to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives for expanding collection of high quality cord blood units, including remote collection,<ref class=\"footnoteRef\" idref=\"fn002120\">1</ref> consistent with the requirements under the National Cord Blood Inventory program under section 2 of the Stem Cell Therapeutic and Research Act of 2005 and the inventory goal. Each such plan shall be made available to the public.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4752563-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In this paragraph, the term “remote collection” means the collection of cord blood units at locations that do not have written contracts with cord blood banks for collection support.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4754c74-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Single point of access; standard data</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4754c75-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Single point of access</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that health care professionals and patients are able to search electronically for and facilitate access to, in the manner and to the extent defined by the Secretary and consistent with the functions described in paragraphs (1)(A) and (2)(A)(i), cells from bone marrow donors and cord blood units through a single point of access.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4754c76-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Standard data</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall require all recipients of contracts under this section to make available a standard dataset for purposes of subparagraph (A) in a standardized electronic format that enables transplant physicians to compare among and between bone marrow donors and cord blood units to ensure the best possible match for the patient.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4754c77-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Definition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “qualified cord blood bank” means a cord blood bank that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c78-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/A\"><num value=\"A\">(A)</num><content> has obtained all applicable Federal and State licenses, certifications, registrations (including pursuant to the regulations of the Food and Drug Administration), and other authorizations required to operate and maintain a cord blood bank;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c79-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/B\"><num value=\"B\">(B)</num><content> has implemented donor screening, cord blood collection practices, and processing methods intended to protect the health and safety of donors and transplant recipients to improve transplant outcomes, including with respect to the transmission of potentially harmful infections and other diseases;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c7a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/C\"><num value=\"C\">(C)</num><content> is accredited by an accreditation entity recognized by the Secretary under subsection (b);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/D\"><num value=\"D\">(D)</num><content> has established a system of strict confidentiality to protect the identity and privacy of patients and donors in accordance with existing Federal and State law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c7c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/E\"><num value=\"E\">(E)</num><content> has established a system for encouraging donation by a genetically diverse group of donors; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4754c7d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/d/4/F\"><num value=\"F\">(F)</num><content> has established a system to confidentially maintain linkage between a cord blood unit and a maternal donor.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida475738e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Bone marrow recruitment; priorities; information and education</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475738f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Recruitment; priorities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Program shall carry out activities for the recruitment of bone marrow donors. Such recruitment program shall identify populations that are underrepresented among potential donors enrolled with the Program. In the case of populations that are identified under the preceding sentence:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4757390-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/1/A\"><num value=\"A\">(A)</num><content> The Program shall give priority to carrying out activities under this part to increase representation for such populations in order to enable a member of such a population, to the extent practicable, to have a probability of finding a suitable unrelated donor that is comparable to the probability that an individual who is not a member of an underrepresented population would have.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4757391-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/1/B\"><num value=\"B\">(B)</num><content> The Program shall consider racial and ethnic minority groups (including persons of mixed ancestry) to be populations that have been identified for purposes of this paragraph, and shall carry out subparagraph (A) with respect to such populations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4757392-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Information and education regarding recruitment; testing and enrollment</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4757393-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Program shall carry out informational and educational activities, in coordination with organ donation public awareness campaigns operated through the Department of Health and Human Services, for purposes of recruiting individuals to serve as donors of bone marrow, and shall test and enroll with the Program potential bone marrow donors. Such information and educational activities shall include the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4757394-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2/A/i\"><num value=\"i\">(i)</num><content> Making information available to the general public, including information describing the needs of patients with respect to donors of bone marrow.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4757395-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> Educating and providing information to individuals who are willing to serve as potential bone marrow donors.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4757396-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2/A/iii\"><num value=\"iii\">(iii)</num><content> Training individuals in requesting individuals to serve as potential bone marrow donors.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4757397-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Priorities</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In carrying out informational and educational activities under subparagraph (A), the Program shall give priority to recruiting individuals to serve as donors of bone marrow for populations that are identified under paragraph (1).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4759aa8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Transplantation as treatment option</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In addition to activities regarding recruitment, the recruitment program under paragraph (1) shall provide information to physicians, other health care professionals, and the public regarding bone marrow transplants from unrelated donors as a treatment option.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4759aa9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/e/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Implementation of subsection</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The requirements of this subsection shall be carried out by the entity that has been awarded a contract by the Secretary under subsection (a) to carry out the functions described in subsection (d)(1).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4759aaa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Bone marrow criteria, standards, and procedures</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall enforce, for participating entities, including the Program, individual marrow donor centers, marrow donor registries, marrow collection centers, and marrow transplant centers—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4759aab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/1\"><num value=\"1\">(1)</num><content> quality standards and standards for tissue typing, obtaining the informed consent of donors, and providing patient advocacy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4759aac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/2\"><num value=\"2\">(2)</num><content> donor selection criteria, based on established medical criteria, to protect both the donor and the recipient and to prevent the transmission of potentially harmful infectious diseases such as the viruses that cause hepatitis and the etiologic agent for Acquired Immune Deficiency Syndrome;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4759aad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/3\"><num value=\"3\">(3)</num><content> procedures to ensure the proper collection and transportation of the marrow;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4759aae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/4\"><num value=\"4\">(4)</num><content> standards for the system for patient advocacy operated under subsection (h), including standards requiring the provision of appropriate information (at the start of the search process and throughout the process) to patients and their families and physicians;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4759aaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/5\"><num value=\"5\">(5)</num><chapeau> standards that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4759ab0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/5/A\"><num value=\"A\">(A)</num><content> require the establishment of a system of strict confidentiality to protect the identity and privacy of patients and donors in accordance with Federal and State law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475c1c1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/5/B\"><num value=\"B\">(B)</num><content> prescribe the purposes for which the records described in subparagraph (A) may be disclosed, and the circumstances and extent of the disclosure; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida475c1c2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/f/6\"><num value=\"6\">(6)</num><content> in the case of a marrow donor center or marrow donor registry participating in the program, procedures to ensure the establishment of a method for integrating donor files, searches, and general procedures of the center or registry with the Program.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida475c1c3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Cord blood recruitment; priorities; information and education</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475c1c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Recruitment; priorities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Program shall support activities, in cooperation with qualified cord blood banks, for the recruitment of cord blood donors. Such recruitment program shall identify populations that are underrepresented among cord blood donors. In the case of populations that are identified under the preceding sentence:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475c1c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/1/A\"><num value=\"A\">(A)</num><content> The Program shall give priority to supporting activities under this part to increase representation for such populations in order to enable a member of such a population, to the extent practicable, to have a probability of finding a suitable cord blood unit that is comparable to the probability that an individual who is not a member of an underrepresented population would have.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475c1c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/1/B\"><num value=\"B\">(B)</num><content> The Program shall consider racial and ethnic minority groups (including persons of mixed ancestry) to be populations that have been identified for purposes of this paragraph, and shall support activities under subparagraph (A) with respect to such populations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475c1c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Information and education regarding recruitment; testing and donation</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida475c1c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In carrying out the recruitment program under paragraph (1), the Program shall support informational and educational activities in coordination with qualified cord blood banks and organ donation public awareness campaigns operated through the Department of Health and Human Services, for purposes of recruiting pregnant women to serve as donors of cord blood. Such information and educational activities shall include the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida475e8d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2/A/i\"><num value=\"i\">(i)</num><content> Making information available to the general public, including information describing the needs of patients with respect to cord blood units.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida475e8da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2/A/ii\"><num value=\"ii\">(ii)</num><content> Educating and providing information to pregnant women who are willing to donate cord blood units.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida475e8db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2/A/iii\"><num value=\"iii\">(iii)</num><content> Training individuals in requesting pregnant women to serve as cord blood donors.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida475e8dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Priorities</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In carrying out informational and educational activities under subparagraph (A), the Program shall give priority to supporting the recruitment of pregnant women to serve as donors of cord blood for populations that are identified under paragraph (1).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475e8dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Transplantation as treatment option</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In addition to activities regarding recruitment, the recruitment program under paragraph (1) shall provide information to physicians, other health care professionals, and the public regarding cord blood transplants from donors as a treatment option.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475e8de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/g/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Implementation of subsection</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The requirements of this subsection shall be carried out by the entity that has been awarded a contract by the Secretary under subsection (a) to carry out the functions described in subsection (d)(2).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida475e8df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Patient advocacy and case management for bone marrow and cord blood</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475e8e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish and maintain, through a contract or other means determined appropriate by the Secretary, an office of patient advocacy (in this subsection referred to as the “Office”).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida475e8e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> General functions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Office shall meet the following requirements:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475e8e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/A\"><num value=\"A\">(A)</num><content> The Office shall be headed by a director.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475e8e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/B\"><num value=\"B\">(B)</num><content> The Office shall be staffed by individuals with expertise in bone marrow and cord blood therapy covered under the Program.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475e8e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/C\"><num value=\"C\">(C)</num><content> The Office shall operate a system for patient advocacy, which shall be separate from mechanisms for donor advocacy, and which shall serve patients for whom the Program is conducting, or has been requested to conduct, a search for a bone marrow donor or cord blood unit.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida475e8e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/D\"><num value=\"D\">(D)</num><content> In the case of such a patient, the Office shall serve as an advocate for the patient by directly providing to the patient (or family members, physicians, or other individuals acting on behalf of the patient) individualized services with respect to efficiently utilizing the system under paragraphs (1) and (2) of subsection (d) to conduct an ongoing search for a bone marrow donor or cord blood unit and assist with information regarding third party payor matters.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4760ff6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/E\"><num value=\"E\">(E)</num><chapeau> In carrying out subparagraph (D), the Office shall monitor the system under paragraphs (1) and (2) of subsection (d) to determine whether the search needs of the patient involved are being met, including with respect to the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ff7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/E/i\"><num value=\"i\">(i)</num><content> Periodically providing to the patient (or an individual acting on behalf of the patient) information regarding bone marrow donors or cord blood units that are suitably matched to the patient, and other information regarding the progress being made in the search.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ff8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/E/ii\"><num value=\"ii\">(ii)</num><content> Informing the patient (or such other individual) if the search has been interrupted or discontinued.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ff9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/E/iii\"><num value=\"iii\">(iii)</num><content> Identifying and resolving problems in the search, to the extent practicable.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4760ffa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F\"><num value=\"F\">(F)</num><chapeau> The Office shall ensure that the following data are made available to patients:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ffb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F/i\"><num value=\"i\">(i)</num><content> The resources available through the Program.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ffc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F/ii\"><num value=\"ii\">(ii)</num><content> A comparison of transplant centers regarding search and other costs that prior to transplantation are charged to patients by transplant centers.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ffd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F/iii\"><num value=\"iii\">(iii)</num><content> The post-transplant outcomes for individual transplant centers.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760ffe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F/iv\"><num value=\"iv\">(iv)</num><content> Information concerning issues that patients may face after a transplant.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4760fff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/F/v\"><num value=\"v\">(v)</num><content> Such other information as the Program determines to be appropriate.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4761000-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/2/G\"><num value=\"G\">(G)</num><content> The Office shall conduct surveys of patients (or family members, physicians, or other individuals acting on behalf of patients) to determine the extent of satisfaction with the system for patient advocacy under this subsection, and to identify ways in which the system can be improved to best meet the needs of patients.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4761001-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Case management</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4763712-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In serving as an advocate for a patient under paragraph (2), the Office shall provide individualized case management services directly to the patient (or family members, physicians, or other individuals acting on behalf of the patient), including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4763713-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/3/A/i\"><num value=\"i\">(i)</num><content> individualized case assessment; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida4763714-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/3/A/ii\"><num value=\"ii\">(ii)</num><content> the functions described in paragraph (2)(D) (relating to progress in the search process).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida4763715-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/h/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Postsearch functions</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In addition to the case management services described in paragraph (1) for patients, the Office shall, on behalf of patients who have completed the search for a bone marrow donor or cord blood unit, provide information and education on the process of receiving a transplant, including the post-transplant process.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4763716-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Comment procedures</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall establish and provide information to the public on procedures under which the Secretary shall receive and consider comments from interested persons relating to the manner in which the Program is carrying out the duties of the Program. The Secretary may promulgate regulations under this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4763717-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Consultation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In developing policies affecting the Program, the Secretary shall consult with the Advisory Council, the Department of Defense Marrow Donor Recruitment and Research Program operated by the Department of the Navy, and the board of directors of each entity awarded a contract under this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4763718-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Contracts</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4763719-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/k/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Application</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To be eligible to enter into a contract under this section, an entity shall submit to the Secretary and obtain approval of an application at such time, in such manner, and containing such information as the Secretary shall by regulation prescribe.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida476371a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/k/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Considerations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In awarding contracts under this section, the Secretary shall give consideration to the continued safety of donors and patients and other factors deemed appropriate by the Secretary.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida476371b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Eligibility</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Entities eligible to receive a contract under this section shall include private nonprofit entities.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida476371c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/m\"><num value=\"m\" class=\"bold\">(m)</num><heading class=\"bold\"> Records</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida476371d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/m/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Recordkeeping</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each recipient of a contract or subcontract under subsection (a) shall keep such records as the Secretary shall prescribe, including records that fully disclose the amount and disposition by the recipient of the proceeds of the contract, the total cost of the undertaking in connection with which the contract was made, and the amount of the portion of the cost of the undertaking supplied by other sources, and such other records as will facilitate an effective audit.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4765e2e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/m/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Examination of records</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary and the Comptroller General of the United States shall have access to any books, documents, papers, and records of the recipient of a contract or subcontract entered into under this section that are pertinent to the contract, for the purpose of conducting audits and examinations.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4765e2f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s274k/n\"><num value=\"n\" class=\"bold\">(n)</num><heading class=\"bold\"> Penalties for disclosure</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person who discloses the content of any record referred to in subsection (d)(4)(D) or (f)(5)(A) without the prior written consent of the donor or potential donor with respect to whom the record is maintained, or in violation of the standards described in subsection (f)(5)(B), shall be imprisoned for not more than 2 years L. 101–616, title I, § 102</ref>, <date date=\"1990-11-16\">Nov. 16, 1990</date>, <ref href=\"/us/stat/104/3282\">104 Stat. 3282</ref>, provided that:<quotedContent origin=\"/us/pl/101/616/tI/s102\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>This title [enacting this section and section 274<i>l</i> of this title and amending <ref href=\"/us/usc/t42/s274a\">section 274a of this title</ref>], and the amendments made by this title, shall not affect any legal document, including any order, regulation, grant, or contract, in effect on the date of enactment of this Act [<date date=\"1990-11-16\">Nov. 16, 1990</date>], or any administrative proceeding or lawsuit pending on the date, that relates to the bone marrow registry established under section 373(b) of the Public Health Service Act [<ref href=\"/us/usc/t42/s274a/b\">42 U.S.C. 274a(b)</ref>] (as it existed before the amendment made by section 101(b) of this Act).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Continued Effect</inline>.—</heading><content>A legal document described in subsection (a) or an order issued in a lawsuit described in subsection (a) shall continue in effect until modified, terminated, or revoked.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Proceedings</inline>.—</heading><content>In any administrative proceeding or lawsuit described in subsection (a), parties shall take appeals, and officials shall hold proceedings and render judgments, in the same manner and with the same effect as if this title had not been enacted.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida476fa76-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Cord Blood Inventory</heading><p><ref href=\"/us/pl/109/129/s2\">Pub. L. 109–129, § 2</ref>, <date date=\"2005-12-20\">Dec. 20, 2005</date>, <ref href=\"/us/stat/119/2550\">119 Stat. 2550</ref>, as amended by <ref href=\"/us/pl/111/264/s2/a\">Pub. L. 111–264, § 2(a)</ref>, <date date=\"2010-10-08\">Oct. 8, 2010</date>, <ref href=\"/us/stat/124/2789\">124 Stat. 2789</ref>; <ref href=\"/us/pl/114/104/s3\">Pub. L. 114–104, § 3</ref>, <date date=\"2015-12-18\">Dec. 18, 2015</date>, <ref href=\"/us/stat/129/2217\">129 Stat. 2217</ref>, provided that:<quotedContent origin=\"/us/pl/114/104/s3\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>The Secretary of Health and Human Services shall enter into contracts with qualified cord blood banks to assist in the collection and maintenance of the inventory goal of at least 150,000 new units of high-quality cord blood to be made available for transplantation through the C.W. Bill Young Cell Transplantation Program and to carry out the requirements of subsection (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Requirements</inline>.—</heading><chapeau>The Secretary shall require each recipient of a contract under this section—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> to acquire, tissue-type, test, cryopreserve, and store donated units of cord blood acquired with the informed consent of the donor, as determined by the Secretary pursuant to section 379(c) of the Public Health Service Act [<ref href=\"/us/usc/t42/s274k/c\">42 U.S.C. 274k(c)</ref>], in a manner that complies with applicable Federal and State regulations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> to encourage donation from a genetically diverse population;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> to make cord blood units that are collected pursuant to this section or otherwise and meet all applicable Federal standards available to transplant centers for transplantation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> to make cord blood units that are collected, but not appropriate for clinical use, available for peer-reviewed research;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> to make data available, as required by the Secretary and consistent with section 379(d)(3) of the Public Health Service Act (<ref href=\"/us/usc/t42/s274k/d/3\">42 U.S.C. 274k(d)(3)</ref>), as amended by this Act, in a standardized electronic format, as determined by the Secretary, for the C.W. Bill Young Cell Transplantation Program; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> to submit data in a standardized electronic format for inclusion in the stem cell therapeutic outcomes database maintained under section 379A of the Public Health Service Act [<ref href=\"/us/usc/t42/s274\">42 U.S.C. 274</ref><i>l</i>], as amended by this Act.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Application</inline>.—</heading><chapeau>To seek to enter into a contract under this section, a qualified cord blood bank shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require. At a minimum, an application for a contract under this section shall include a requirement that the applicant—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> will participate in the C.W. Bill Young Cell Transplantation Program for a period of at least 10 years beginning on the last date on which the recipient of a contract under this section receives Federal funds under this section;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> will make cord blood units collected pursuant to this section available through the C.W. Bill Young Cell Transplantation Program in perpetuity or for such time as determined viable by the Secretary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> will provide a plan to increase cord blood unit collections at collection sites that exist at the time of application, assist with the establishment of new collection sites, or contract with new collection sites;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> will annually provide to the Secretary a plan for, and demonstrate, ongoing measurable progress toward achieving self-sufficiency of cord blood unit collection and banking operations; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> if the Secretary determines through an assessment, or through petition by the applicant, that a cord blood bank is no longer operational or does not meet the requirements of section 379(d)(4) of the Public Health Service Act [<ref href=\"/us/usc/t42/s274k/d/4\">42 U.S.C. 274k(d)(4)</ref>] (as added by this Act) and as a result may not distribute the units, transfer the units collected pursuant to this section to another qualified cord blood bank approved by the Secretary to ensure continued availability of cord blood units.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Duration of Contracts.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Except as provided in paragraph (2), the term of each contract entered into by the Secretary under this section shall be for a period of at least 10 years beginning on the last date on which the recipient of a contract under this section receives Federal funds under this section. The Secretary shall ensure that no Federal funds shall be obligated under any such contract after the date that is 5 years after the date on which the contract is entered into, except as provided in paragraphs (2), (3), and (4).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Extensions</inline>.—</heading><chapeau>The Secretary may extend the period of funding under a contract under this section to exceed a period of 5 years if—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the Secretary finds that the inventory goal described in subsection (a) has not yet been met;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the Secretary does not receive an application for a contract under this section meeting the requirements under subsection (c) from any qualified cord blood bank that has not previously entered into a contract under this section; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> the Secretary determines that the outstanding inventory need cannot be met by the qualified cord blood banks under contract under this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Extension eligibility</inline>.—</heading><chapeau>A qualified cord blood bank shall be eligible for a 5-year extension of a contract awarded under this section, as described in paragraph (2), provided that the qualified cord blood bank—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> demonstrates a superior ability to satisfy the requirements described in subsection (b) and achieves the overall goals for which the contract was awarded;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> provides a plan for how the qualified cord blood bank will increase cord blood unit collections at collection sites that exist at the time of consideration for such extension of a contract, assist with the establishment of new collection sites, or contract with new collection sites; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> annually provides to the Secretary a plan for, and demonstrates, ongoing measurable progress toward achieving self-sufficiency of cord blood unit collection and banking operations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Consideration of best science</inline>.—</heading><content>The Secretary shall take into consideration the best scientific information available in order to maximize the number of cord blood units available for transplant when entering into contracts under this section, or when extending a period of funding under such a contract under paragraph (2).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Consideration of banked units of cord blood</inline>.—</heading><content>In extending contracts pursuant to paragraph (3), and determining new allocation amounts for the next contract period or contract extension for such cord blood bank, the Secretary shall take into account the number of cord blood units banked in the National Cord Blood Inventory by a cord blood bank during the previous contract period, in addition to consideration of the ability of such cord blood bank to increase the collection and maintenance of additional, genetically diverse cord blood units.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Regulations</inline>.—</heading><content>The Secretary may promulgate regulations to carry out this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> The term ‘C.W. Bill Young Cell Transplantation Program’ means the C.W. Bill Young Cell Transplantation Program under section 379 of the Public Health Service Act [<ref href=\"/us/usc/t42/s274k\">42 U.S.C. 274k</ref>], as amended by this Act.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> The term ‘cord blood donor’ means a mother who has delivered a baby and consents to donate the neonatal blood remaining in the placenta and umbilical cord after separation from the newborn baby.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> The term ‘cord blood unit’ means the neonatal blood collected from the placenta and umbilical cord of a single newborn baby.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> The term ‘qualified cord blood bank’ has the meaning given to that term in section 379(d)(4) of the Public Health Service Act [<ref href=\"/us/usc/t42/s274k/d/4\">42 U.S.C. 274k(d)(4)</ref>], as amended by this Act.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> The term ‘Secretary’ means the Secretary of Health and Human Services.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Authorization of Appropriations.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> [sic; there is no par. (2)] <inline class=\"small-caps\">Authorization of appropriations</inline>.—</heading><content>There are authorized to be appropriated to the Secretary to carry out the program under this section $20,000,000 for fiscal year 2015 and $23,000,000 for each of fiscal years 2016 through 2020.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida4776fa7-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Report of Inspector General; Plan Regarding Relationship Between Registry and Donor Centers</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/105/196/s2/b/2\">Pub. L. 105–196, § 5</ref>, <date date=\"1998-07-16\">July 16, 1998</date>, <ref href=\"/us/stat/112/636\">112 Stat. 636</ref>, provided that the Comptroller General was to conduct a study of the National Bone Marrow Donor Registry under this section to determine the extent to which the Registry had increased the representation of racial and ethnic minority groups among potential donors enrolled with the Registry and whether the extent of increase resulted in a level of representation that met the standard established in subsec. (c)(1)(A) of this section, the extent to which patients in need of a transplant of bone marrow from a biologically unrelated donor, and the physicians of such patients, had been utilizing the Registry, the number of patients for whom the Registry began a preliminary but not complete search process and the reasons underlying such circumstances, the extent to which the plan required in <ref href=\"/us/pl/105/196/s2/b/2\">section 2(b)(2) of Pub.
