</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida494bb61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Identification of priorities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida494bb62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall identify national priorities for improvement in developing the strategy under paragraph (1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida494bb63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall ensure that priorities identified under subparagraph (A) will—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida494bb64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/i"><num value="i">(i)</num><content> have the greatest potential for improving the health outcomes, efficiency, and patient-centeredness of health care for all populations, including children and vulnerable populations;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494bb65-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/ii"><num value="ii">(ii)</num><content> identify areas in the delivery of health care services that have the potential for rapid improvement in the quality and efficiency of patient care;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494bb66-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/iii"><num value="iii">(iii)</num><content> address gaps in quality, efficiency, comparative effectiveness information (taking into consideration the limitations set forth in subsections (c) and (d) of section 1182 of the Social Security Act [<ref href="/us/usc/t42/s1320e–1/c">42 U.S.C. 1320e–1(c)</ref>, (d)]), and health outcomes measures and data aggregation techniques;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e277-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/iv"><num value="iv">(iv)</num><content> improve Federal payment policy to emphasize quality and efficiency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e278-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/v"><num value="v">(v)</num><content> enhance the use of health care data to improve quality, efficiency, transparency, and outcomes;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e279-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/vi"><num value="vi">(vi)</num><content> address the health care provided to patients with high-cost chronic diseases;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e27a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/vii"><num value="vii">(vii)</num><content> improve research and dissemination of strategies and best practices to improve patient safety and reduce medical errors, preventable admissions and readmissions, and health care-associated infections;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e27b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/viii"><num value="viii">(viii)</num><content> reduce health disparities across health disparity populations (as defined in section 285t <ref class="footnoteRef" idref="fn002146">1</ref><note type="footnote" id="fn002146"><num>1</num> See References in Text note below.</note> of this title) and geographic areas; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida494e27c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/B/ix"><num value="ix">(ix)</num><content> address other areas as determined appropriate by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida494e27d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Considerations</heading><content><p style="-uslm-lc:I13" class="indent2">In identifying priorities under subparagraph (A), the Secretary shall take into consideration the recommendations submitted by the entity with a contract under section 1890(a) of the Social Security Act [<ref href="/us/usc/t42/s1395aaa/a">42 U.S.C. 1395aaa(a)</ref>] and other stakeholders.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida494e27e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/a/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Coordination with State agencies</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall collaborate, coordinate, and consult with State agencies responsible for administering the Medicaid program under title XIX of the Social Security Act [<ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.] and the Children’s Health Insurance Program under title XXI of such Act [<ref href="/us/usc/t42/s1397aa">42 U.S.C. 1397aa</ref> et seq.] with respect to developing and disseminating strategies, goals, models, and timetables that are consistent with the national priorities identified under subparagraph (A).</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida494e27f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b"><num value="b" class="bold">(b)</num><heading class="bold"> Strategic plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida494e280-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The national strategy shall include a comprehensive strategic plan to achieve the priorities described in subsection (a).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida494e281-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">The strategic plan shall include provisions for addressing, at a minimum, the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida494e282-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/A"><num value="A">(A)</num><content> Coordination among agencies within the Department, which shall include steps to minimize duplication of efforts and utilization of common quality measures, where available. Such common quality measures shall be measures identified by the Secretary under section 1139A or 1139B of the Social Security Act [<ref href="/us/usc/t42/s1320b–9a">42 U.S.C. 1320b–9a</ref>, 1320b–9b] or endorsed under section 1890 of such Act [<ref href="/us/usc/t42/s1395aaa">42 U.S.C. 1395aaa</ref>].</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida494e283-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/B"><num value="B">(B)</num><content> Agency-specific strategic plans to achieve national priorities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4950994-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/C"><num value="C">(C)</num><content> Establishment of annual benchmarks for each relevant agency to achieve national priorities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4950995-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/D"><num value="D">(D)</num><content> A process for regular reporting by the agencies to the Secretary on the implementation of the strategic plan.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4950996-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/E"><num value="E">(E)</num><content> Strategies to align public and private payers with regard to quality and patient safety efforts.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4950997-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/b/2/F"><num value="F">(F)</num><content> Incorporating quality improvement and measurement in the strategic plan for health information technology required by the American Recovery and Reinvestment Act of 2009 (<ref href="/us/pl/111/5">Public Law 111–5</ref>).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4950998-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/c"><num value="c" class="bold">(c)</num><heading class="bold"> Periodic update of national strategy</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall update the national strategy not less than annually. Any such update shall include a review of short- and long-term goals.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4950999-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d"><num value="d" class="bold">(d)</num><heading class="bold"> Submission and availability of national strategy and updates</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida495099a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Deadline for initial submission of national strategy</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than <date date="2011-01-01">January 1, 2011</date>, the Secretary shall submit to the relevant committees of Congress the national strategy described in subsection (a).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida495099b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Updates</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida495099c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall submit to the relevant committees of Congress an annual update to the strategy described in paragraph (1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida495099d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Information submitted</heading><chapeau style="-uslm-lc:I13" class="indent2">Each update submitted under subparagraph (A) shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida495099e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/B/i"><num value="i">(i)</num><content> a review of the short- and long-term goals of the national strategy and any gaps in such strategy;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida495099f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/B/ii"><num value="ii">(ii)</num><content> an analysis of the progress, or lack of progress, in meeting such goals and any barriers to such progress;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida49509a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/B/iii"><num value="iii">(iii)</num><content> the information reported under section 1139A of the Social Security Act [<ref href="/us/usc/t42/s1320b–9a">42 U.S.C. 1320b–9a</ref>], consistent with the reporting requirements of such section; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida49509a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/B/iv"><num value="iv">(iv)</num><content> in the case of an update required to be submitted on or after <date date="2014-01-01">January 1, 2014</date>, the information reported under section 1139B(b)(4) of the Social Security Act [<ref href="/us/usc/t42/s1320b–9b/b/4">42 U.S.C. 1320b–9b(b)(4)</ref>], consistent with the reporting requirements of such section.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida49509a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/d/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Satisfaction of other reporting requirements</heading><content><p style="-uslm-lc:I13" class="indent2">Compliance with the requirements of clauses (iii) and (iv) of subparagraph (B) shall satisfy the reporting requirements under sections 1139A(a)(6) and 1139B(b)(4), respectively, of the Social Security Act [<ref href="/us/usc/t42/s1320b–9a/a/6">42 U.S.C. 1320b–9a(a)(6)</ref>, 1320b–9b(b)(4)].</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida49509a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/e"><num value="e" class="bold">(e)</num><heading class="bold"> Health care quality Internet website</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than <date date="2011-01-01">January 1, 2011</date>, the Secretary shall create an Internet website to make public information regarding—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida49509a4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/e/1"><num value="1">(1)</num><content> the national priorities for health care quality improvement established under subsection (a)(2);</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida49530b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s280j/e/2"><num value="2">(2)</num><content> the agency-specific strategic plans for health care quality described in subsection (b)(2)(B); and</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Chair and vice-chair.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">Chair</inline>.—</heading><content>The Working Group shall be chaired by the Secretary of Health and Human Services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Vice chair</inline>.—</heading><content>Members of the Working Group, other than the Secretary of Health and Human Services, shall serve as Vice Chair of the Group on a rotating basis, as determined by the Group.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><content>Not later than <date date="2010-12-31">December 31, 2010</date>, and annually thereafter, the Working Group shall submit to the relevant Committees of Congress, and make public on an Internet website, a report describing the progress and recommendations of the Working Group in meeting the goals described in subsection (b).”</content>
