<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4a3d6e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n"><num value="283n">§ 283n.</num><heading> Shared Instrumentation Grant Program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a3d6e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a"><num value="a" class="bold">(a)</num><heading class="bold"> Requirements for grants</heading><chapeau style="-uslm-lc:I11" class="indent0">In determining whether to award a grant to an applicant under the Shared Instrumentation Grant Program, the Director of NIH, acting through the Office of the Director of NIH, shall consider—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4a3d6ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a/1"><num value="1">(1)</num><content> the extent to which an award for the specific instrument involved would meet the scientific needs and enhance the planned research endeavors of the major users by providing an instrument that is unavailable or to which availability is highly limited;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a3d6eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a/2"><num value="2">(2)</num><content> with respect to the instrument involved, the availability and commitment of the appropriate technical expertise within the major user group or the applicant institution for use of the instrumentation;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a3d6ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a/3"><num value="3">(3)</num><content> the adequacy of the organizational plan for the use of the instrument involved and the internal advisory committee for oversight of the applicant, including sharing arrangements if any;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a3d6ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a/4"><num value="4">(4)</num><content> the applicant’s commitment for continued support of the utilization and maintenance of the instrument; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a3fdfe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/a/5"><num value="5">(5)</num><content> the extent to which the specified instrument will be shared and the benefit of the proposed instrument to the overall research community to be served.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a3fdff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s283n/b"><num value="b" class="bold">(b)</num><heading class="bold"> Peer review</heading><content><p style="-uslm-lc:I11" class="indent0">In awarding grants under the program described in subsection (a), the Director of NIH, acting through the Office of the Director of NIH, shall comply with the peer review requirements in <ref href="/us/usc/t42/s289a">section 289a of this title</ref>.</p>
