<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4a7a760-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h"><num value="284h">§ 284h.</num><heading> Pediatric Research Initiative</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7a761-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish within the Office of the Director of NIH a Pediatric Research Initiative (referred to in this section as the “Initiative”) to conduct and support research that is directly related to diseases, disorders, and other conditions in children. The Initiative shall be headed by the Director of NIH.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7a762-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Purpose</heading><chapeau style="-uslm-lc:I11" class="indent0">The purpose of the Initiative is to provide funds to enable the Director of NIH—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7a763-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/b/1"><num value="1">(1)</num><content> to increase support for pediatric biomedical research within the National Institutes of Health to realize the expanding opportunities for advancement in scientific investigations and care for children;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7a764-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/b/2"><num value="2">(2)</num><content> to enhance collaborative efforts among the Institutes to conduct and support multidisciplinary research in the areas that the Director deems most promising; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7a765-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/b/3"><num value="3">(3)</num><content> in coordination with the Food and Drug Administration, to increase the development of adequate pediatric clinical trials and pediatric use information to promote the safer and more effective use of prescription drugs in the pediatric population.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7a766-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out subsection (b), the Director of NIH shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7a767-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/c/1"><num value="1">(1)</num><content> consult with the Director of the Eunice Kennedy Shriver National Institute of Child Health and Human Development and the other national research institutes, in considering their requests for new or expanded pediatric research efforts, and consult with the Administrator of the Health Resources and Services Administration and other advisors as the Director determines to be appropriate;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7a768-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/c/2"><num value="2">(2)</num><content> have broad discretion in the allocation of any Initiative assistance among the Institutes, among types of grants, and between basic and clinical research so long as the assistance is directly related to the illnesses and conditions of children; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7ce79-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/c/3"><num value="3">(3)</num><content> be responsible for the oversight of any newly appropriated Initiative funds and annually report to Congress and the public on the extent of the total funds obligated to conduct or support pediatric research across the National Institutes of Health, including the specific support and research awards allocated through the Initiative.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7ce7a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d"><num value="d" class="bold">(d)</num><heading class="bold"> National Pediatric Research Network</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4a7ce7b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Network</heading><chapeau style="-uslm-lc:I12" class="indent1">In carrying out the Initiative, the Director of NIH, in collaboration with the national research institutes and national centers that carry out activities involving pediatric research, shall support a National Pediatric Research Network in order to more effectively support pediatric research and optimize the use of Federal resources. Such National Pediatric Research Network may be comprised of, as appropriate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4a7ce7c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/1/A"><num value="A">(A)</num><content> the pediatric research consortia receiving awards under paragraph (2); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4a7ce7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/1/B"><num value="B">(B)</num><content> other consortia, centers, or networks focused on pediatric research that are recognized by the Director of NIH and established pursuant to the authorities vested in the National Institutes of Health by other sections of this chapter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4a7ce7e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Pediatric research consortia</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida4a7ce7f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Director of NIH shall award funding, including through grants, contracts, or other mechanisms, to public or private nonprofit entities for providing support for pediatric research consortia, including with respect to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce80-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/A/i"><num value="i">(i)</num><content> basic, clinical, behavioral, or translational research to meet unmet needs for pediatric research; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce81-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/A/ii"><num value="ii">(ii)</num><content> training researchers in pediatric research techniques in order to address unmet pediatric research needs.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida4a7ce82-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Research</heading><chapeau style="-uslm-lc:I13" class="indent2">The Director of NIH shall, as appropriate, ensure that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce83-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/B/i"><num value="i">(i)</num><content> each consortium receiving an award under subparagraph (A) conducts or supports at least one category of research described in subparagraph (A)(i) and collectively such consortia conduct or support such categories of research; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce84-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/B/ii"><num value="ii">(ii)</num><content> one or more such consortia provide training described in subparagraph (A)(ii).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida4a7ce85-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Organization of consortium</heading><chapeau style="-uslm-lc:I13" class="indent2">Each consortium receiving an award under subparagraph (A) shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce86-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/i"><num value="i">(i)</num><content> be formed from a collaboration of cooperating institutions;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce87-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/ii"><num value="ii">(ii)</num><content> be coordinated by a lead institution or institutions;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce88-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iii"><num value="iii">(iii)</num><chapeau> agree to disseminate scientific findings, including from clinical trials, rapidly and efficiently, as appropriate, to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida4a7ce89-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iii/I"><num value="I">(I)</num><content> other consortia;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida4a7ce8a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iii/II"><num value="II">(II)</num><content> the National Institutes of Health;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida4a7ce8b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iii/III"><num value="III">(III)</num><content> the Food and Drug Administration;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida4a7ce8c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iii/IV"><num value="IV">(IV)</num><content> and <ref class="footnoteRef" idref="fn002162">1</ref><note type="footnote" id="fn002162"><num>1</num> So in original. The word “and” probably should appear at end of subcl. (III).</note> other relevant agencies; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida4a7ce8d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/C/iv"><num value="iv">(iv)</num><content> meet such requirements as may be prescribed by the Director of NIH.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida4a7ce8e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Supplement, not supplant</heading><content><p style="-uslm-lc:I13" class="indent2">Any support received by a consortium under subparagraph (A) shall be used to supplement, and not supplant, other public or private support for activities authorized to be supported under this paragraph.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida4a7f59f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/2/E"><num value="E" class="bold">(E)</num><heading class="bold"> Duration of support</heading><content><p style="-uslm-lc:I13" class="indent2">Support of a consortium under subparagraph (A) shall be for a period of not to exceed 5 years. Such period may be extended at the discretion of the Director of NIH.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4a7f5a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Coordination of consortia activities</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director of NIH shall, as appropriate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4a7f5a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/3/A"><num value="A">(A)</num><content> provide for the coordination of activities (including the exchange of information and regular communication) among the consortia established pursuant to paragraph (2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4a7f5a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/3/B"><num value="B">(B)</num><content> require the periodic preparation and submission to the Director of reports on the activities of each such consortium.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4a7f5a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Assistance with registries</heading><content><p style="-uslm-lc:I12" class="indent1">Each consortium receiving an award under paragraph (2)(A) may provide assistance, as appropriate, to the Centers for Disease Control and Prevention for activities related to patient registries and other surveillance systems upon request by the Director of the Centers for Disease Control and Prevention.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7f5a4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/e"><num value="e" class="bold">(e)</num><heading class="bold"> Research on pediatric rare diseases or conditions</heading><chapeau style="-uslm-lc:I11" class="indent0">In making awards under subsection (d)(2) for pediatric research consortia, the Director of NIH shall ensure that an appropriate number of such awards are awarded to such consortia that agree to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7f5a5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/e/1"><num value="1">(1)</num><content> consider pediatric rare diseases or conditions, or those related to birth defects; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4a7f5a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/e/2"><num value="2">(2)</num><content> conduct or coordinate one or more multisite clinical trials of therapies for, or approaches to, the prevention, diagnosis, or treatment of one or more pediatric rare diseases or conditions.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4a7f5a7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s284h/f"><num value="f" class="bold">(f)</num><heading class="bold"> Transfer of funds</heading><content><p style="-uslm-lc:I11" class="indent0">The Director of NIH may transfer amounts appropriated under this section to any of the Institutes for a fiscal year to carry out the purposes of the Initiative under this section.</p>
