<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4c60465-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a"><num value="289a">§ 289a.</num><heading> Peer review requirements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4c60466-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Applications for biomedical and behavioral research grants, cooperative agreements, and contracts; regulations</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida4c60467-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/1"><num value="1">(1)</num><chapeau> The Secretary, acting through the Director of NIH, shall by regulation require appropriate technical and scientific peer review of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida4c60468-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/1/A"><num value="A">(A)</num><content> applications made for grants and cooperative agreements under this chapter for biomedical and behavioral research; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida4c60469-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/1/B"><num value="B">(B)</num><content> applications made for biomedical and behavioral research and development contracts to be administered through the National Institutes of Health.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida4c6046a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/2"><num value="2">(2)</num><chapeau> Regulations promulgated under paragraph (1) shall require that the review of applications made for grants, contracts, and cooperative agreements required by the regulations be conducted—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida4c6046b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/2/A"><num value="A">(A)</num><content> to the extent practical, in a manner consistent with the system for technical and scientific peer review applicable on <date date="1985-11-20">November 20, 1985</date>, to grants under this chapter for biomedical and behavioral research, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida4c6046c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/a/2/B"><num value="B">(B)</num><content> to the extent practical, by technical and scientific peer review groups performing such review on or before <date date="1985-11-20">November 20, 1985</date>,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">and shall authorize such review to be conducted by groups appointed under sections 282(b)(16) and 284(c)(3) of this title.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4c6046d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Periodic review of research at National Institutes of Health</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director of NIH shall establish procedures for periodic technical and scientific peer review of research at the National Institutes of Health. Such procedures shall require that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4c6046e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/b/1"><num value="1">(1)</num><content> the reviewing entity be provided a written description of the research to be reviewed, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4c6046f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/b/2"><num value="2">(2)</num><content> the reviewing entity provide the advisory council of the national research institute involved with such description and the results of the review by the entity,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">and shall authorize such review to be conducted by groups appointed under sections 282(b)(6) <ref class="footnoteRef" idref="fn002203">1</ref><note type="footnote" id="fn002203"><num>1</num> See References in Text note below.</note> and 284(c)(3) of this title.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4c60470-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Compliance with requirements for inclusion of women and minorities in clinical research</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida4c60471-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/c/1"><num value="1">(1)</num><content> In technical and scientific peer review under this section of proposals for clinical research, the consideration of any such proposal (including the initial consideration) shall, except as provided in paragraph (2), include an evaluation of the technical and scientific merit of the proposal regarding compliance with <ref href="/us/usc/t42/s289a–2">section 289a–2 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida4c60472-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289a/c/2"><num value="2">(2)</num><content> Paragraph (1) shall not apply to any proposal for clinical research that, pursuant to subsection (b) of <ref href="/us/usc/t42/s289a–2">section 289a–2 of this title</ref>, is not subject to the requirement of subsection (a) of such section regarding the inclusion of women and members of minority groups as subjects in clinical research.</content>
