<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4c8754b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g"><num value="289g">§ 289g.</num><heading> Fetal research</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4c8754c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/a"><num value="a" class="bold">(a)</num><heading class="bold"> Conduct or support by Secretary; restrictions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may not conduct or support any research or experimentation, in the United States or in any other country, on a nonviable living human fetus ex utero or a living human fetus ex utero for whom viability has not been ascertained unless the research or experimentation—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4c8754d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/a/1"><num value="1">(1)</num><content> may enhance the well-being or meet the health needs of the fetus or enhance the probability of its survival to viability; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4c8754e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/a/2"><num value="2">(2)</num><content> will pose no added risk of suffering, injury, or death to the fetus and the purpose of the research or experimentation is the development of important biomedical knowledge which cannot be obtained by other means.</content>
</paragraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4c8754f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/b"><num value="b" class="bold">(b)</num><heading class="bold"> Risk standard for fetuses intended to be aborted and fetuses intended to be carried to term to be same</heading><chapeau style="-uslm-lc:I11" class="indent0">In administering the regulations for the protection of human research subjects which—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4c87550-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/b/1"><num value="1">(1)</num><content> apply to research conducted or supported by the Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4c87551-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/b/2"><num value="2">(2)</num><content> involve living human fetuses in utero; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4c87552-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s289g/b/3"><num value="3">(3)</num><content> are published in section 46.208 of part 46 of title 45 of the Code of Federal Regulations;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">or any successor to such regulations, the Secretary shall require that the risk standard (published in section 46.102(g) of such part 46 or any successor to such regulations) be the same for fetuses which are intended to be aborted and fetuses which are intended to be carried to term.</continuation>

<heading class="centered smallCaps">Federal Funding of Fetal Tissue Transplantation Research</heading>
<p style="-uslm-lc:I21" class="indent0">Memorandum of President of the United States, <date date="1993-01-22">Jan. 22, 1993</date>, 58 F.R. 7457, provided:</p>
<p style="-uslm-lc:I21" class="indent0">Memorandum for the Secretary of Health and Human Services</p>
<p style="-uslm-lc:I21" class="indent0">On <date date="1988-03-22">March 22, 1988</date>, the Assistant Secretary for Health of Health and Human Services (“HHS”) imposed a temporary moratorium on Federal funding of research involving transplantation of fetal tissue from induced abortions. Contrary to the recommendations of a National Institutes of Health advisory panel, on <date date="1989-11-02">November 2, 1989</date>, the Secretary of Health and Human Services extended the moratorium indefinitely. This moratorium has significantly hampered the development of possible treatments for individuals afflicted with serious diseases and disorders, such as Parkinson’s disease, Alzheimer’s disease, diabetes, and leukemia. Accordingly, I hereby direct that you immediately lift the moratorium.</p>
<p style="-uslm-lc:I21" class="indent0">You are hereby authorized and directed to publish this memorandum in the Federal Register.</p>
