<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id889aa4c5-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g"><num value="291g">§ 291g.</num><heading> Withholding of payments; noncompliance with requirements</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Whenever the Surgeon General, after reasonable notice and opportunity for hearing to the State agency designated as provided in <ref href="/us/usc/t42/s291d/a/1">section 291d(a)(1) of this title</ref>, finds—</chapeau><subsection style="-uslm-lc:I12" class="indent1" id="id889aa4c6-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/a"><num value="a">(a)</num><content> that the State agency is not complying substantially with the provisions required by <ref href="/us/usc/t42/s291d">section 291d of this title</ref> to be included in its State plan; or</content>
</subsection>
<subsection style="-uslm-lc:I12" class="indent1" id="id889aa4c7-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/b"><num value="b">(b)</num><content> that any assurance required to be given in an application filed under <ref href="/us/usc/t42/s291e">section 291e of this title</ref> is not being or cannot be carried out; or</content>
</subsection>
<subsection style="-uslm-lc:I12" class="indent1" id="id889aa4c8-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/c"><num value="c">(c)</num><content> that there is a substantial failure to carry out plans and specifications approved by the Surgeon General under <ref href="/us/usc/t42/s291e">section 291e of this title</ref>; or</content>
</subsection>
<subsection style="-uslm-lc:I12" class="indent1" id="id889aa4c9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/d"><num value="d">(d)</num><content> that adequate State funds are not being provided annually for the direct administration of the State plan,</content>
</subsection>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the Surgeon General may forthwith notify the State agency that—</continuation>
<subsection style="-uslm-lc:I12" class="indent1" id="id889aa4ca-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/e"><num value="e">(e)</num><content> no further payments will be made to the State under this part, or</content>
</subsection>
<subsection style="-uslm-lc:I12" class="indent1" id="id889aa4cb-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s291g/f"><num value="f">(f)</num><content> no further payments will be made from the allotments of such State from appropriations under any one or more subparagraphs or paragraphs of <ref href="/us/usc/t42/s291a">section 291a of this title</ref>, or for any project or projects, designated by the Surgeon General as being affected by the action or inaction referred to in paragraph (a), (b), (c), or (d) of this section,</content>
</subsection>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">as the Surgeon General may determine to be appropriate under the circumstances; and, except with regard to any project for which the application has already been approved and which is not directly affected, further payments may be withheld, in whole or in part, until there is no longer any failure to comply (or carry out the assurance or plans and specifications or provide adequate State funds, as the case may be) or, if such compliance (or other action) is impossible, until the State repays or arranges for the repayment of Federal moneys to which the recipient was not entitled.</continuation>
