<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4f8fb47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o"><num value="294o">§ 294o.</num><heading> Advisory Council on Graduate Medical Education</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f8fb48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment; duties</heading><chapeau style="-uslm-lc:I11" class="indent0">There is established the Council on Graduate Medical Education (in this section referred to as the “Council”). The Council shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1"><num value="1">(1)</num><chapeau> make recommendations to the Secretary of Health and Human Services (in this section referred to as the “Secretary”), and to the Committee on Health, Education, Labor, and Pensions of the Senate, and the Committee on Energy and Commerce of the House of Representatives, with respect to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/A"><num value="A">(A)</num><content> the supply and distribution of physicians in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/B"><num value="B">(B)</num><content> current and future shortages or excesses of physicians in medical and surgical specialties and subspecialties;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/C"><num value="C">(C)</num><content> issues relating to foreign medical school graduates;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/D"><num value="D">(D)</num><content> appropriate Federal policies with respect to the matters specified in subparagraphs (A), (B), and (C), including policies concerning changes in the financing of undergraduate and graduate medical education programs and changes in the types of medical education training in graduate medical education programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/E"><num value="E">(E)</num><content> appropriate efforts to be carried out by hospitals, schools of medicine, schools of osteopathic medicine, and accrediting bodies with respect to the matters specified in subparagraphs (A), (B), and (C), including efforts for changes in undergraduate and graduate medical education programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f8fb4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/1/F"><num value="F">(F)</num><content> deficiencies in, and needs for improvements in, existing data bases concerning the supply and distribution of, and postgraduate training programs for, physicians in the United States and steps that should be taken to eliminate those deficiencies;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/2"><num value="2">(2)</num><content> encourage entities providing graduate medical education to conduct activities to voluntarily achieve the recommendations of the Council under paragraph (1)(E);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/3"><num value="3">(3)</num><content> develop, publish, and implement performance measures for programs under this subchapter, except for programs under part C or D;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/4"><num value="4">(4)</num><content> develop and publish guidelines for longitudinal evaluations (as described in <ref href="/us/usc/t42/s294n/d/2">section 294n(d)(2) of this title</ref>) for programs under this subchapter, except for programs under part C or D; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/a/5"><num value="5">(5)</num><content> recommend appropriation levels for programs under this subchapter, except for programs under part C or D.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f8fb54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b"><num value="b" class="bold">(b)</num><heading class="bold"> Composition</heading><chapeau style="-uslm-lc:I11" class="indent0">The Council shall be composed of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb55-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/1"><num value="1">(1)</num><content> the Assistant Secretary for Health or the designee of the Assistant Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb56-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/2"><num value="2">(2)</num><content> the Administrator of the Centers for Medicare &amp; Medicaid Services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb57-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/3"><num value="3">(3)</num><content> the Chief Medical Director of the Department of Veterans Affairs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb58-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/4"><num value="4">(4)</num><content> the Administrator of the Health Resources and Services Administration;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb59-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/5"><num value="5">(5)</num><content> 6 members appointed by the Secretary to include representatives of practicing primary care physicians, national and specialty physician organizations, foreign medical graduates, and medical student and house staff associations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb5a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/6"><num value="6">(6)</num><content> 4 members appointed by the Secretary to include representatives of schools of medicine and osteopathic medicine and public and private teaching hospitals; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4f8fb5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/b/7"><num value="7">(7)</num><content> 4 members appointed by the Secretary to include representatives of health insurers, business, and labor.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f8fb5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/c"><num value="c" class="bold">(c)</num><heading class="bold"> Terms of appointed members</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4f8fb5d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general; staggered rotation</heading><content><p style="-uslm-lc:I12" class="indent1">Members of the Council appointed under paragraphs (4), (5), and (6) of subsection (b) shall be appointed for a term of 4 years, except that the term of office of the members first appointed shall expire, as designated by the Secretary at the time of appointment, 4 at the end of 1 year, 4 at the end of 2 years, 3 at the end of 3 years, and 3 at the end of 4 years.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4f8fb5e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Date certain for appointment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall appoint the first members to the Council under paragraphs (4), (5), and (6) of subsection (b) within 60 days after <date date="1992-10-13">October 13, 1992</date>.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f9226f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/d"><num value="d" class="bold">(d)</num><heading class="bold"> Chair</heading><content><p style="-uslm-lc:I11" class="indent0">The Council shall elect one of its members as Chairman of the Council.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92270-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/e"><num value="e" class="bold">(e)</num><heading class="bold"> Quorum</heading><content><p style="-uslm-lc:I11" class="indent0">Nine members of the Council shall constitute a quorum, but a lesser number may hold hearings.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92271-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/f"><num value="f" class="bold">(f)</num><heading class="bold"> Vacancies</heading><content><p style="-uslm-lc:I11" class="indent0">Any vacancy in the Council shall not affect its power to function.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92272-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/g"><num value="g" class="bold">(g)</num><heading class="bold"> Compensation</heading><content><p style="-uslm-lc:I11" class="indent0">Each member of the Council who is not otherwise employed by the United States Government shall receive compensation at a rate equal to the daily rate prescribed for GS–18 under the General Schedule under <ref href="/us/usc/t5/s5332">section 5332 of title 5</ref> for each day, including traveltime,<ref class="footnoteRef" idref="fn002255">1</ref><note type="footnote" id="fn002255"><num>1</num> So in original. Probably should be “travel time,”.</note> such member is engaged in the actual performance of duties as a member of the Council. A member of the Council who is an officer or employee of the United States Government shall serve without additional compensation. All members of the Council shall be reimbursed for travel, subsistence, and other necessary expenses incurred by them in the performance of their duties.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92273-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/h"><num value="h" class="bold">(h)</num><heading class="bold"> Certain authorities and duties</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4f92274-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authorities</heading><chapeau style="-uslm-lc:I12" class="indent1">In order to carry out the provisions of this section, the Council is authorized to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f92275-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/h/1/A"><num value="A">(A)</num><content> collect such information, hold such hearings, and sit and act at such times and places, either as a whole or by subcommittee, and request the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, and documents as the Council or such subcommittee may consider available; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida4f92276-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/h/1/B"><num value="B">(B)</num><content> request the cooperation and assistance of Federal departments, agencies, and instrumentalities, and such departments, agencies, and instrumentalities are authorized to provide such cooperation and assistance.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida4f92277-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Coordination of activities</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall coordinate its activities with the activities of the Secretary under <ref href="/us/usc/t42/s295k">section 295k of this title</ref>. The Secretary shall, in cooperation with the Council and pursuant to the recommendations of the Council, take such steps as are practicable to eliminate deficiencies in the data base established under <ref href="/us/usc/t42/s295k">section 295k of this title</ref> and shall make available in its reports such comprehensive data sets as are developed pursuant to this section.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92278-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/i"><num value="i" class="bold">(i)</num><heading class="bold"> Reports</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than <date date="2023-09-30">September 30, 2023</date>, and not less than every 5 years thereafter, the Council shall submit to the Secretary, and to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, a report on the recommendations described in subsection (a).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida4f92279-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s294o/j"><num value="j" class="bold">(j)</num><heading class="bold"> Funding</heading><content><p style="-uslm-lc:I11" class="indent0">Amounts otherwise appropriated under this subchapter may be utilized by the Secretary to support the activities of the Council.</p>
