and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fdb5db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/a/2\"><num value=\"2\">(2)</num><content> the individuals each agree to the requirements of service in substance use disorder treatment employment, as described in subsection (d).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fdb5dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Payments</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For each year of obligated service by an individual pursuant to an agreement under subsection (a), the Secretary shall make a payment to such individual as follows:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4fdb5dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Service in a shortage area</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall pay—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4fdb5de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/b/1/A\"><num value=\"A\">(A)</num><content> for each year of obligated service by an individual pursuant to an agreement under subsection (a), ⅙ of the principal of and interest on each eligible loan of the individual which is outstanding on the date the individual began service pursuant to the agreement; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4fdb5df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/b/1/B\"><num value=\"B\">(B)</num><content> for completion of the sixth and final year of such service, the remainder of such principal and interest.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4fdb5e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Maximum amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The total amount of payments under this section to any individual shall not exceed $250,000.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fdb5e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Eligible loans</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The loans eligible for repayment under this section are each of the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fdb5e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c/1\"><num value=\"1\">(1)</num><content> Any loan for education or training for a substance use disorder treatment employment.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fdb5e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c/2\"><num value=\"2\">(2)</num><content> Any loan under part E of subchapter VI (relating to nursing student loans).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcf4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c/3\"><num value=\"3\">(3)</num><content> Any Federal Direct Stafford Loan, Federal Direct PLUS Loan, Federal Direct Unsubsidized Stafford Loan, or Federal Direct Consolidation Loan (as such terms are used in section 455 of the Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1087e\">20 U.S.C. 1087e</ref>]).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcf5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c/4\"><num value=\"4\">(4)</num><content> Any Federal Perkins Loan under part E of title I <ref class=\"footnoteRef\" idref=\"fn002265\">1</ref><note type=\"footnote\" id=\"fn002265\"><num>1</num> So in original. Probably should be “part E of title IV of the Higher Education Act of 1965”.</note> of the Higher Education Act of 1965.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcf6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/c/5\"><num value=\"5\">(5)</num><content> Any other Federal loan as determined appropriate by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fddcf7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Requirements of service</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Any individual receiving payments under this program as required by an agreement under subsection (a) shall agree to an annual commitment to full-time employment, with no more than 1 year passing between any 2 years of covered employment, in substance use disorder treatment employment in the United States in—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcf8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/d/1\"><num value=\"1\">(1)</num><content> a Mental Health Professional Shortage Area, as designated under <ref href=\"/us/usc/t42/s254e\">section 254e of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcf9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/d/2\"><num value=\"2\">(2)</num><content> a county (or a municipality, if not contained within any county) where the mean drug overdose death rate per 100,000 people over the past 3 years for which official data is available from the State, is higher than the most recent available national average overdose death rate per 100,000 people, as reported by the Centers for Disease Control and Prevention.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fddcfa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Ineligibility for double benefits</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">No borrower may, for the same service, receive a reduction of loan obligations or a loan repayment under both—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcfb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/e/1\"><num value=\"1\">(1)</num><content> this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddcfc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/e/2\"><num value=\"2\">(2)</num><content> any Federally supported loan forgiveness program, including under section 254<i>l</i>–1, 254q–1, or 297n of this title, or section 428J, 428L, 455(m), or 460 of the Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1078–10\">20 U.S.C. 1078–10</ref>, 1078–12, 1087e(m), 1087j].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fddcfd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Breach</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4fddcfe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Liquidated damages formula</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may establish a liquidated damages formula to be used in the event of a breach of an agreement entered into under subsection (a).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida4fddcff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The failure by an individual to complete the full period of service obligated pursuant to such an agreement, taken alone, shall not constitute a breach of the agreement, so long as the individual completed in good faith the years of service for which payments were made to the individual under this section.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fddd00-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Additional criteria</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddd01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/g/1\"><num value=\"1\">(1)</num><content> may establish such criteria and rules to carry out this section as the Secretary determines are needed and in addition to the criteria and rules specified in this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fddd02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/g/2\"><num value=\"2\">(2)</num><content> shall give notice to the committees specified in subsection (h) of any criteria and rules so established.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fddd03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Report to Congress</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 5 years after <date date=\"2018-10-24\">October 24, 2018</date>, and every other year thereafter, the Secretary shall prepare and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fe0414-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/h/1\"><num value=\"1\">(1)</num><content> the number and location of borrowers who have qualified for loan repayments under this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fe0415-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/h/2\"><num value=\"2\">(2)</num><content> the impact of this section on the availability of substance use disorder treatment employees nationally and in shortage areas and counties described in subsection (d).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fe0416-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Definition</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fe0417-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i/1\"><num value=\"1\">(1)</num><content> The terms “Indian tribe” and “tribal organization” have the meanings given those terms in <ref href=\"/us/usc/t25/s5304\">section 5304 of title 25</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fe0418-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i/2\"><num value=\"2\">(2)</num><content> The term “municipality” means a city, town, or other public body created by or pursuant to State law, or an Indian tribe.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida4fe0419-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i/3\"><num value=\"3\">(3)</num><chapeau> The term “substance use disorder treatment employment” means full-time employment (including a fellowship)—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4fe041a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i/3/A\"><num value=\"A\">(A)</num><content> where the primary intent and function of the position is the direct treatment or recovery support of patients with or in recovery from a substance use disorder, including master’s level social workers, psychologists, counselors, marriage and family therapists, psychiatric mental health practitioners, occupational therapists, psychology doctoral interns, and behavioral health paraprofessionals and physicians, physician assistants, and nurses, who are licensed or certified in accordance with applicable State and Federal laws; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida4fe041b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/i/3/B\"><num value=\"B\">(B)</num><content> which is located at a substance use disorder treatment program, private physician practice, hospital or health system-affiliated inpatient treatment center or outpatient clinic (including an academic medical center-affiliated treatment program), correctional facility or program, youth detention center or program, inpatient psychiatric facility, crisis stabilization unit, community health center, community mental health or other specialty community behavioral health center, recovery center, school, community-based organization, telehealth platform, migrant health center, health program or facility operated by an Indian tribe or tribal organization, Federal medical facility, or any other facility as determined appropriate for purposes of this section by the Secretary.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida4fe041c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s295h/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2019 through 2023.</p>\n</content>\n</subsection>\n<sourceCredit id=\"ida4fe041d-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1944-07-01/ch373\">July 1, 1944, ch. 373</ref>, title VII, § 781, as added <ref href=\"/us/pl/115/271/tVII/s7071/2\">Pub.
