or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5009bf7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/2/B\"><num value=\"B\">(B)</num><content> licensed registered nurses who will receive a graduate or equivalent degree or training to become an advanced education nurse as defined by <ref href=\"/us/usc/t42/s296j/b\">section 296j(b) of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5009bf8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Collegiate school of nursing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “collegiate school of nursing” means a department, division, or other administrative unit in a college or university which provides primarily or exclusively a program of education in professional nursing and related subjects leading to the degree of bachelor of arts, bachelor of science, bachelor of nursing, or to an equivalent degree, or to a graduate degree in nursing, or to an equivalent degree, and including advanced training related to such program of education provided by such school, but only if such program, or such unit, college or university is accredited.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5009bf9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Associate degree school of nursing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “associate degree school of nursing” means a department, division, or other administrative unit in a junior college, community college, college, or university which provides primarily or exclusively a two-year program of education in professional nursing and allied subjects leading to an associate degree in nursing or to an equivalent degree, but only if such program, or such unit, college, or university is accredited.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5009bfa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Diploma school of nursing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “diploma school of nursing” means a school affiliated with a hospital or university, or an independent school, which provides primarily or exclusively a program of education in professional nursing and allied subjects leading to a diploma or to equivalent indicia that such program has been satisfactorily completed, but only if such program, or such affiliated school or such hospital or university or such independent school is accredited.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5009bfb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Accredited</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida5009bfc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/6/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), the term “accredited” when applied to any program of nurse education means a program accredited by a recognized body or bodies, or by a State agency, approved for such purpose by the Secretary of Education and when applied to a hospital, school, college, or university (or a unit thereof) means a hospital, school, college, or university (or a unit thereof) which is accredited by a recognized body or bodies, or by a State agency, approved for such purpose by the Secretary of Education. For the purpose of this paragraph, the Secretary of Education shall publish a list of recognized accrediting bodies, and of State agencies, which the Secretary of Education determines to be reliable authority as to the quality of education offered.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida5009bfd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/6/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> New programs</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A new program of nursing that, by reason of an insufficient period of operation, is not, at the time of the submission of an application for a grant or contract under this subchapter, eligible for accreditation by such a recognized body or bodies or State agency, shall be deemed accredited for purposes of this subchapter if the Secretary of Education finds, after consultation with the appropriate accreditation body or bodies, that there is reasonable assurance that the program will meet the accreditation standards of such body or bodies prior to the beginning of the academic year following the normal graduation date of students of the first entering class in such a program.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5009bfe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Nonprofit</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “nonprofit” as applied to any school, agency, organization, or institution means one which is a corporation or association, or is owned and operated by one or more corporations or associations, no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c30f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means a State, the Commonwealth of Puerto Rico, the District of Columbia, the Commonwealth of the Northern Mariana Islands, Guam, American Samoa, the Virgin Islands, or the Trust Territory of the Pacific Islands.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c310-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Ambulatory surgical center</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “ambulatory surgical center” has the meaning applicable to such term under title XVIII of the Social Security Act [<ref href=\"/us/usc/t42/s1395\">42 U.S.C. 1395</ref> et seq.].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c311-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Federally qualified health center</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federally qualified health center” has the meaning given such term under section 1861(aa)(4) of the Social Security Act [<ref href=\"/us/usc/t42/s1395x/aa/4\">42 U.S.C. 1395x(aa)(4)</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c312-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Health care facility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “health care facility” means an Indian Health Service health center, a Native Hawaiian health center, a hospital, a Federally qualified health center, a rural health clinic, a nursing home, a home health agency, a hospice program, a public health clinic, a State or local department of public health, a skilled nursing facility, an ambulatory surgical center, or any other facility designated by the Secretary.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c313-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Home health agency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “home health agency” has the meaning given such term in section 1861(<i>o</i>) of the Social Security Act [<ref href=\"/us/usc/t42/s1395x\">42 U.S.C. 1395x</ref>(<i>o</i>)].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c314-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Hospice program</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “hospice program” has the meaning given such term in section 1861(dd)(2) of the Social Security Act [<ref href=\"/us/usc/t42/s1395x/dd/2\">42 U.S.C. 1395x(dd)(2)</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c315-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Rural health clinic</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “rural health clinic” has the meaning given such term in section 1861(aa)(2) of the Social Security Act [<ref href=\"/us/usc/t42/s1395x/aa/2\">42 U.S.C. 1395x(aa)(2)</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c316-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> Skilled nursing facility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “skilled nursing facility” has the meaning given such term in section 1819(a) of the Social Security Act [<ref href=\"/us/usc/t42/s1395i–3/a\">42 U.S.C. 1395i–3(a)</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c317-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Accelerated nursing degree program</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “accelerated nursing degree program” means a program of education in professional nursing offered by an accredited school of nursing in which an individual holding a bachelors degree in another discipline receives a BSN or MSN degree in an accelerated time frame as determined by the accredited school of nursing.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida500c318-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s296/17\"><num value=\"17\" class=\"bold\">(17)</num><heading class=\"bold\"> Bridge or degree completion program</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “bridge or degree completion program” means a program of education in professional nursing offered by an accredited school of nursing, as defined in paragraph (2), that leads to a baccalaureate degree in nursing. L. 107–205, title II, § 204</ref>, <date date=\"2002-08-01\">Aug. 1, 2002</date>, <ref href=\"/us/stat/116/818\">116 Stat. 818</ref>, provided that:<quotedContent origin=\"/us/pl/107/205/tII/s204\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">National Variations</inline>.—</heading><content>Not later than 4 years after the date of the enactment of this Act [<date date=\"2002-08-01\">Aug. 1, 2002</date>], the Comptroller General of the United States shall conduct a survey to determine national variations in the nursing shortage at hospitals, nursing homes, and other health care providers, and submit a report, including recommendations, to the Congress on Federal remedies to ease nursing shortages. The Comptroller General shall submit to the Congress this report describing the findings relating to ownership status and associated remedies.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Hiring Differences Among Certain Private Entities</inline>.—</heading><content>The Comptroller General of the United States shall conduct a study to determine differences in the hiring of nurses by nonprofit private entities as compared to the hiring of nurses by private entities that are not nonprofit. In carrying out the study, the Comptroller General shall determine the effect of the inclusion of private entities that are not nonprofit in the program under section 846 of the Public Health Service Act [<ref href=\"/us/usc/t42/s297n\">42 U.S.C. 297n</ref>]. Not later than 4 years after the date of the enactment of this Act [<date date=\"2002-08-01\">Aug. 1, 2002</date>], the Comptroller General shall submit to the Congress a report describing the findings of the study.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Nursing Scholarships</inline>.—</heading><content>The Comptroller General of the United States shall conduct an evaluation of whether the program carried out under section 846(d) of the Public Health Service Act [<ref href=\"/us/usc/t42/s297n/d\">42 U.S.C. 297n(d)</ref>] has demonstrably increased the number of applicants to schools of nursing and, not later than 4 years after the date of the enactment of this Act [<date date=\"2002-08-01\">Aug. 1, 2002</date>], submit a report to the Congress on the results of such evaluation.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida5011142-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Purpose</heading><p><ref href=\"/us/pl/105/392/tI/s122\">Pub. L. 94–63, title IX, § 951</ref>, <date date=\"1975-07-29\">July 29, 1975</date>, <ref href=\"/us/stat/89/367\">89 Stat. 367</ref>, as amended by <ref href=\"/us/pl/95/623/s12/h\">Pub. L. 95–623, § 12(h)</ref>, <date date=\"1978-11-09\">Nov. 9, 1978</date>, <ref href=\"/us/stat/92/3457\">92 Stat. 3457</ref>, provided that:<quotedContent origin=\"/us/pl/95/623/s12/h\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">(1)</num><chapeau> Using procedures developed in accordance with paragraph (3), the Secretary of Health, Education, and Welfare [now Health and Human Services] (hereinafter in this section referred to as the ‘Secretary’) shall determine on a continuing basis—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> the supply (both current and projected and within the United States and within each State) of registered nurses, licensed practical and vocational nurses, nurse’s aides, registered nurses with advanced training or graduate degrees, and nurse practitioners;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> the distribution within the United States and within each State, of such nurses so as to determine (i) those areas of the United States which are oversupplied or undersupplied, or which have an adequate supply of such nurses in relation to the population of the area, and (ii) the demand for the services which such nurses provide; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> the current and future requirements for such nurses, nationally and within each State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><chapeau> The Secretary shall survey and gather data, on a continuing basis, on—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> the number and distribution of nurses, by type of employment and location of practice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> the number of nurses who are practicing full time and those who are employed part time, within the United States and within each State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> the average rates of compensation for nurses, by type of practice and location of practice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"D\">“(D)</num><content> the activity status of the total number of registered nurses within the United States and within each State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"E\">“(E)</num><content> the number of nurses with advanced training or graduate degrees in nursing, by specialty, including nurse practitioners, nurse clinicians, nurse researchers, nurse educators, and nurse supervisors and administrators; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"F\">“(F)</num><content> the number of registered nurses entering the United States annually from other nations, by country of nurse training and by immigrant status.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><content> Within six months of the date of the enactment of this Act [<date date=\"1975-07-29\">July 29, 1975</date>], the Secretary shall develop procedures for determining (on both a current and projected basis) the supply and distribution of and requirements for nurses within the United States and within each State.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><chapeau> Not later than <date date=\"1979-10-01\">October 1, 1979</date>, and October 1 of each odd-numbered year thereafter, the Secretary shall report to the Congress—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> his determinations under subsection (a)(1) and the data gathered under subsection (a)(2);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> an analysis of such determination and data;
