value=\"3001\">§ 3001.</num><heading> Congressional declaration of objectives</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Congress hereby finds and declares that, in keeping with the traditional American concept of the inherent dignity of the individual in our democratic society, the older people of our Nation are entitled to, and it is the joint and several duty and responsibility of the governments of the United States, of the several States and their political subdivisions, and of Indian tribes to assist our older people to secure equal opportunity to the full and free enjoyment of the following objectives:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/1\"><num value=\"1\">(1)</num><content> An adequate income in retirement in accordance with the American standard of living.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/2\"><num value=\"2\">(2)</num><content> The best possible physical and mental health (including access to person-centered, trauma-informed services as appropriate) which science can make available and without regard to economic status.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/3\"><num value=\"3\">(3)</num><content> Obtaining and maintaining suitable housing, independently selected, designed and located with reference to special needs and available at costs which older citizens can afford.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/4\"><num value=\"4\">(4)</num><content> Full restoration services for those who require institutional care, and a comprehensive array of community-based, long-term care services adequate to appropriately sustain older people in their communities and in their homes, including support to family members and other persons providing voluntary care to older individuals needing long-term care services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/5\"><num value=\"5\">(5)</num><content> Opportunity for employment with no discriminatory personnel practices because of age.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa7731f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/6\"><num value=\"6\">(6)</num><content> Retirement in health, honor, dignity—after years of contribution to the economy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa77320-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/7\"><num value=\"7\">(7)</num><content> Participating in and contributing to meaningful activity within the widest range of civic, cultural, education and training and recreational opportunities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa77321-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/8\"><num value=\"8\">(8)</num><content> Efficient community services, including access to low-cost transportation, which provide a choice in supported living arrangements and social assistance in a coordinated manner and which are readily available when needed, with emphasis on maintaining a continuum of care for vulnerable older individuals.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa77322-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/9\"><num value=\"9\">(9)</num><content> Immediate benefit from proven research knowledge which can sustain and improve health and happiness.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaaa77323-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3001/10\"><num value=\"10\">(10)</num><content> Freedom, independence, and the free exercise of individual initiative in planning and managing their own lives, full participation in the planning and operation of community-based services and programs provided for their benefit, and protection against abuse, L. 100–175, title VII, § 701</ref>, <date date=\"1987-11-29\">Nov. 29, 1987</date>, <ref href=\"/us/stat/101/983\">101 Stat. 983</ref>, provided that:<quotedContent origin=\"/us/pl/100/175/tVII/s701\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">General Effective Date</inline>.—</heading><content>Except as provided in subsections (b) and (c), this Act and the amendments made by this Act [see Short Title of 1987 Amendment note below] shall take effect on <date date=\"1987-10-01\">October 1, 1987</date>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Application of Amendments</inline>.—</heading><chapeau>The amendments made by title I of this Act [enacting sections 3030h to 3030p, 3035f, 3035g, 3056g, and 3057 to 3057n of this title, amending sections 3001, 3002, 3011 to 3013, 3015 to 3018, 3020c, 3021 to 3029, 3030a, 3030d, 3030g, 3030aa, 3030bb, 3030jj, 3031, 3032, 3035a, 3035b, 3035d, 3037, 3056, 3056a, 3056d, 3056e, and 3056f of this title, repealing sections 3058 to 3058d of this title, enacting provisions set out as notes under this section, sections 3026, 3027, and 3057b of this title, and <ref href=\"/us/usc/t29/s2\">section 2 of Title 29</ref>, and repealing provisions set out as a note under <ref href=\"/us/usc/t42/s3058\">section 3058 of this title</ref>] shall not apply with respect to—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> any area plan submitted under section 306(a) of the Older Americans Act of 1965 [<ref href=\"/us/usc/t42/s3026/a\">section 3026(a) of this title</ref>], or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> any State plan submitted under section 307(a) of such Act [<ref href=\"/us/usc/t42/s3027/a\">section 3027(a) of this title</ref>],</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I33\" class=\"indent0 firstIndent0\">and approved for any fiscal year beginning before the date of the enactment of this Act [<date date=\"1987-11-29\">Nov. 29, 1987</date>].</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Effective Date of Section</inline> 506.—</heading><content>The amendments made by section 506 of this Act [enacting <ref href=\"/us/usc/t42/s2991b–1\">section 2991b–1 of this title</ref> and amending sections 2991a, 2991b, and 2992d of this title] shall take effect upon the expiration of the 90-day period beginning on the date of the enactment of this Act [<date date=\"1987-11-29\">Nov. 29, 1987</date>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"effectiveDateOfAmendment\" id=\"idaaa7c149-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Effective Date of 1984 Amendment</heading><p><ref href=\"/us/pl/98/459/tVIII/s803\">Pub. L. 116–131, title VI, § 604</ref>, <date date=\"2020-03-25\">Mar. 25, 2020</date>, <ref href=\"/us/stat/134/269\">134 Stat. 269</ref>, provided that:<quotedContent origin=\"/us/pl/116/131/tVI/s604\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Definitions.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Administrator</inline>.—</heading><content>The term ‘Administrator means the Administrator of the Administration for Community Living.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Covered agency</inline>.—</heading><chapeau>The term ‘covered agency’ means—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> a State agency or area agency on aging; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> a Federal agency other than the Department of Health and Human Services, and a unit of that Department other than the Administration on Aging, that the Assistant Secretary determines performs functions for which the principles are relevant, and the Centers for Medicare &amp; Medicaid Services.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Principles</inline>.—</heading><content>The term ‘principles’ means the Principles for Person-directed Services and Supports during Serious Illness, issued by the Administration for Community Living on <date date=\"2017-09-01\">September 1, 2017</date>, or an updated set of such Principles.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">State agency</inline>.—</heading><content>The term ‘State agency’ has the meaning given the term in section 102 of the Older Americans Act of 1965 (<ref href=\"/us/usc/t42/s3002\">42 U.S.C. 3002</ref>).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Dissemination</inline>.—</heading><content>The Administrator shall disseminate the principles to appropriate stakeholders within the aging network, as determined by the Assistant Secretary, and to covered agencies. The covered agencies may use the principles in setting priorities for service delivery and care plans in programs carried out by the agencies.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Feedback</inline>.—</heading><content>The Administrator shall solicit, on an ongoing basis, feedback on the principles from covered agencies, experts in the fields of aging and dementia, and stakeholders who provide or receive disability services.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not less often than once, but not more often than annually, during the 3 years after the date of enactment of this Act [<date date=\"2020-03-25\">Mar. 25, 2020</date>], the Administrator shall prepare and submit to Congress a report describing the feedback received under subsection (c) and indicating if any changes or updates are needed to the principles.”</content>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For definitions of “area agency on aging” and “Assistant Secretary” as used in <ref href=\"/us/pl/116/131/s604\">section 604 of Pub. L. 116–131</ref>, set out above, as being the same as those given in <ref href=\"/us/usc/t42/s3002\">section 3002 of this title</ref>, see <ref href=\"/us/pl/116/131/s4\">section 4 of Pub. L. 116–131</ref>, set out as a note below.]</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa8368d-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Guidance on Serving Holocaust Survivors</heading><p><ref href=\"/us/pl/114/144/s10\">Pub. L. 114–144, § 10</ref>, <date date=\"2016-04-19\">Apr. 19, 2016</date>, <ref href=\"/us/stat/130/352\">130 Stat. 352</ref>, provided that:<quotedContent origin=\"/us/pl/114/144/s10\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Because the services under the Older Americans Act of 1965 (<ref href=\"/us/usc/t42/s3001\">42 U.S.C. 3001</ref> et seq.) are critical to meeting the urgent needs of Holocaust survivors to age in place with dignity, comfort, security, and quality of life, the Assistant Secretary for Aging shall issue guidance to States, that shall be applicable to States, area agencies on aging, and providers of services for older individuals, with respect to serving Holocaust survivors, including guidance on promising practices for conducting outreach to that population. In developing the guidance, the Assistant Secretary for Aging shall consult with experts and organizations serving Holocaust survivors, and shall take into account the possibility that the needs of Holocaust survivors may differ based on geography.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Contents</inline>.—</heading><chapeau>The guidance shall include the following:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> How nutrition service providers may meet the special health-related or other dietary needs of participants in programs under the Older Americans Act of 1965, including needs based on religious, cultural, or ethnic requirements.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> How transportation service providers may address the urgent transportation needs of Holocaust survivors.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> How State long-term care ombudsmen may address the unique needs of residents of long-term care facilities for whom institutional settings may produce sights, sounds, smells, emotions, and routines, that can induce panic, anxiety, and retraumatization as a result of experiences from the Holocaust.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> How supportive services providers may consider the unique needs of Holocaust survivors.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> How other services provided under that Act, as determined by the Assistant Secretary for Aging, may serve Holocaust survivors.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Date of Issuance</inline>.—</heading><content>The guidance described in subsection (a) shall be issued not later than 180 days after the date of enactment of this Act [<date date=\"2016-04-19\">Apr. 19, 2016</date>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa85d9e-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Study of Effectiveness of State Long-Term Care Ombudsman Programs</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/102/375/tII/s211\">Pub. L. 102–375, title II, § 211</ref>, <date date=\"1992-09-30\">Sept. 30, 1992</date>, <ref href=\"/us/stat/106/1215\">106 Stat. 1215</ref>, as amended by <ref href=\"/us/pl/103/171/s4/a/2\">Pub. L. 103–171, § 4(a)(2)</ref>, <date date=\"1993-12-02\">Dec. 2, 1993</date>, <ref href=\"/us/stat/107/1991\">107 Stat. 1991</ref>, provided that not later than <date date=\"1995-01-01\">Jan. 1, 1995</date>, the Assistant Secretary for Aging, in consultation with State agencies, State Long-Term Care Ombudsmen, the National Ombudsman Resource Center, and professional ombudsmen associations, directly, or by grant or contract, was to conduct a study and submit a report to Congress analyzing separately with respect to each State effectiveness of State long-term care ombudsman programs.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa85d9f-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Study on Board and Care Facility Quality</heading><p><ref href=\"/us/pl/102/375/tII/s212\">Pub. L. 102–375, title II, § 212</ref>, <date date=\"1992-09-30\">Sept. 30, 1992</date>, <ref href=\"/us/stat/106/1216\">106 Stat. 1216</ref>, provided that:<quotedContent origin=\"/us/pl/102/375/tII/s212\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Arrangement for Study Committee</inline>.—</heading><content>The Secretary of Health and Human Services shall enter into an arrangement, in accordance with subsection (d), to establish a study committee described in subsection (c) to conduct a study through the Institute of Medicine of the National Academy of Sciences on the quality of board and care facilities for older individuals (as defined in section 102 [<ref href=\"/us/usc/t42/s3002\">42 U.S.C. 3002</ref>] of the Older Americans Act of 1965 (<ref href=\"/us/usc/t42/s3001\">42 U.S.C. 3001</ref> et seq.)) and the disabled.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Scope of Study</inline>.—</heading><chapeau>The study shall include—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> an examination of existing quality, health, and safety requirements for board and care facilities and the enforcement of such requirements for their adequacy and effectiveness, with special attention to their effectiveness in promoting good personal care;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> an examination of, and recommendations with respect to, the appropriate role of Federal, State, and local governments in assuring the health and safety of residents of board and care facilities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> specific recommendations to the Congress and the Secretary, by not later than 20 months after the date of the enactment of this Act [<date date=\"1992-09-30\">Sept. 30, 1992</date>], concerning the establishment of minimum national standards for the quality, health, and safety of residents of such facilities and the enforcement of such standards.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Composition of Study Committee</inline>.—</heading><chapeau>The study committee shall be composed of members as appointed from among the following:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">National academy of sciences</inline>.—</heading><chapeau>The members of the National Academy of Sciences with experience in long-term care. The members so appointed shall include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> physicians;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> experts on the administration of drugs to older individuals, and disabled individuals receiving long-term care services; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> experts on the enforcement of life-safety codes in long-term care facilities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Residents</inline>.—</heading><chapeau>Residents of board and care facilities (including privately owned board and care facilities), and representatives of such residents or of organizations that advocate on behalf of such residents. Members so appointed shall include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> residents of a nonprofit board and care facility; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> individuals who represent—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> residents of nonprofit board and care facilities; or</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> organizations that advocate on behalf of residents of nonprofit board and care facilities.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Operators</inline>.—</heading><chapeau>Operators of board and care facilities (including privately owned board and care facilities), and individuals who represent such operators or organizations that represent the interests of such operators. Members so appointed shall include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> operators of a nonprofit board and care facility; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> individuals who represent—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> operators of nonprofit board and care facilities; or</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> organizations that represent the interests of operators of nonprofit board and care facilities.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Officers.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">State officers</inline>.—</heading><content>Elected and appointed State officers who have responsibility relating to the health and safety of residents of board and care facilities.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Representatives</inline>.—</heading><content>Representatives of such officers or of organizations representing such officers.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Other individuals</inline>.—</heading><content>Other individuals with relevant expertise.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Use of Institute of Medicine</inline>.—</heading><content>The Secretary shall request the National Academy of Sciences, through the Institute of Medicine, to establish, appoint, and provide administrative support for the study committee under an arrangement under which the actual expenses incurred by the Academy in carrying out such functions will be paid by the Secretary. If the National Academy of Sciences is willing to do so, the Secretary shall enter into such arrangement with the Academy.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Involvement of Others.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Government officials</inline>.—</heading><content>The study committee shall conduct its work in a manner that provides for the consultation with Members of Congress or their representatives, officials of the Department of Health and Human Services, and officials of State and local governments who are not members of the study committee.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Experts</inline>.—</heading><content>The study committee may consult with any individual or organization with expertise relating to the issues involved in the activities of the study committee.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 20 months after an arrangement is entered into under subsection (d), the study committee shall submit, to the Secretary, the Speaker of the House of Representatives, and the President pro tempore of the Senate, a report containing the results of the study referred to in subsection (a) and the recommendations made under subsection (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Board and Care Facility Defined</inline>.—</heading><content>In this section, the term ‘board and care facility’ means a facility described in section 1616(e) of the Social Security Act (<ref href=\"/us/usc/t42/s1372e/e\">42 U.S.C. 1372e(e)</ref> [<ref href=\"/us/usc/t42/s1382e/e\">42 U.S.C. 1382e(e)</ref>]).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"h\">“(h)</num><heading> <inline class=\"small-caps\">Authorization</inline>.—</heading><content>There are authorized to be appropriated to carry out this section $1,500,000 for fiscal year 1992 and such sums as may be necessary for subsequent fiscal years.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa884b0-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Study on Home Care Quality</heading><p><ref href=\"/us/pl/102/375/tII/s213\">Pub. If the National Academy of Sciences is willing to do so, the Secretary shall enter into such arrangement with the Academy.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Involvement of Others.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Members and officials</inline>.—</heading><content>The committee shall conduct its work in a manner that provides for consultation with Members of Congress or their representatives, officials of the Department of Health and Human Services, and officials of State and local governments who are not members of the committee.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Individual or organization with expertise</inline>.—</heading><content>The committee may consult with any individual or organization with expertise relating to the issues involved in the activities of the committee.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 20 months after an arrangement is entered into under subsection (d), the committee shall submit, to the Secretary, the Speaker of the House of Representatives, and the President pro tempore of the Senate, a report containing the results of the study referred to in subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Authorization</inline>.—</heading><content>There are authorized to be appropriated to carry out this section $1,000,000 for fiscal year 1992 and such sums as may be necessary for subsequent fiscal years.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa8abc1-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Long-Term Health Care Workers</heading><p><ref href=\"/us/pl/102/375/tVIII\">Pub. L. 102–375, title VIII</ref>, subtitle A, <date date=\"1992-09-30\">Sept. 30, 1992</date>, <ref href=\"/us/stat/106/1293-1295\">106 Stat. 1293–1295</ref>, provided that:<quotedContent origin=\"/us/pl/102/375/tVIII\">\n<section style=\"-uslm-lc:I580467\"><num value=\"801\">“SEC. 801.</num><heading> DEFINITIONS.</heading><chapeau style=\"-uslm-lc:I21\" class=\"indent0\">“As used in this subtitle:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Nursing home nurse aide</inline>.—</heading><content>The term ‘nursing home nurse aide’ means an individual employed at a nursing or convalescent home who assists in the care of patients at such home under the direction of nursing and medical staff.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Home health care aide</inline>.—</heading><chapeau>The term ‘home health care aide’ means an individual who—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> is employed by a government, charitable, nonprofit, or proprietary agency; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> cares for elderly, convalescent, or handicapped individuals in the home of the individuals by performing routine home assistance (such as housecleaning, cooking, and laundry) and assisting in the health care of such individuals under the direction of a physician or nurse.</content>\n</subparagraph>\n</paragraph>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"802\">“SEC. 802.</num><heading> INFORMATION REQUIREMENTS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">National Center for Health Statistics</inline>.—</heading><chapeau>The Director of the National Center for Health Statistics of the Centers for Disease Control [now Centers for Disease Control and Prevention] shall collect, and prepare a report containing—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> demographic information on home health care aides and nursing home nurse aides, including information on the—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> age, race, marital status, education, number of children and other dependents, gender, and primary language, of the aides; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> location of facilities at which the aides are employed in—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> rural communities; or</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> urban or suburban communities; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> information on the role of the aides in providing institution-based and home-based long-term care.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Department of Labor</inline>.—</heading><chapeau>The Secretary of Labor shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> collect, and prepare a report containing, information on home health care aides, including—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><chapeau> information on conditions of employment, including—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> the length of employment of the aides with the current employer of the aides;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><chapeau> the number of aides who are—</chapeau><subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"I\">     “(I)</num><content> employed by a for-profit employer;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"II\">     “(II)</num><content> employed by a nonprofit private employer;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"III\">     “(III)</num><content> employed by a charitable employer;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"IV\">     “(IV)</num><content> employed by a government employer; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"V\">     “(V)</num><content> independent contractors;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> the number of full-time, part-time, and temporary positions for the aides;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> the ratio of the aides to professional staff;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> the types of tasks performed by the aides, the level of skill needed to perform the tasks, and whether the tasks are completed in a institution-based or home-based setting; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vi\">“(vi)</num><content> the average number and range of hours worked each week by the aides; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> information on availability of the employment benefits for home health care aides and a description of the benefits, including—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> information on health insurance coverage;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> the type of pension plan coverage;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> the amount of vacation leave;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> wage rates; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> the extent of work-related training provided; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> collect, and prepare a report containing, information on nursing home nurse aides, including—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the information described in subparagraphs (A) and (B) of paragraph (1); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> information on—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> the type of facility of the employer of the aides, such as a skilled nursing facility, as defined in section 1819(a) of the Social Security Act (<ref href=\"/us/usc/t42/s1395i–3/a\">42 U.S.C. 1395i–3(a)</ref>), or an intermediate care facility within the meaning of section 1121(a) of the Social Security Act (<ref href=\"/us/usc/t42/s1320a/a\">42 U.S.C. 1320a(a)</ref>);</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> the number of beds at the facility; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> the ratio of the aides to residents of the facility.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"803\">“SEC. 803.</num><heading> REPORTS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Reports to Commissioner on Aging</inline> [now <inline class=\"small-caps\">Assistant Secretary for Aging</inline>].—</heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Transmittal.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">National center for health statistics report</inline>.—</heading><content>Not later than <date date=\"1994-03-01\">March 1, 1994</date>, the Director of the National Center for Health Statistics of the Centers for Disease Control [now Centers for Disease Control and Prevention] shall transmit to the Commissioner on Aging the report required by section 802(a).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Department of labor reports.—</inline></heading><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">Home health care aides</inline>.—</heading><content>Not later than <date date=\"1993-03-01\">March 1, 1993</date>, the Secretary of Labor shall transmit to the Commissioner on Aging a plan for the collection of the information described in section 802(b)(1). Not later than <date date=\"1995-03-01\">March 1, 1995</date>, the Secretary of Labor shall transmit to the Commissioner on Aging the report required by section 802(b)(1).</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><heading> <inline class=\"small-caps\">Nursing home nurse aides</inline>.—</heading><content>Not later than <date date=\"1994-03-01\">March 1, 1994</date>, the Secretary of Labor shall transmit to the Commissioner on Aging the report required by section 802(b)(2).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Preparation.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">National center for health statistics report</inline>.—</heading><content>The report required by section 802(a) shall be prepared and organized in such a manner as the Director of the National Center for Health Statistics may determine to be appropriate.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Department of labor reports</inline>.—</heading><content>The reports required by paragraphs (1) and (2) of section 802(b) shall be prepared and organized in such a manner as the Secretary of Labor may determine to be appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Presentation of information</inline>.—</heading><content>The reports required by section 802 shall not identify by name individuals supplying information for purposes of the reports. The reports shall present information collected in the aggregate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Report to Congress</inline>.—</heading><chapeau>The Commissioner on Aging [now Assistant Secretary for Aging] shall review the reports required by section 802 and shall submit to the appropriate committees of Congress a report containing—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the reports required by section 802;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the comments of the Commissioner on the reports; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> additional information, regarding the roles of nursing home nurse aides and home health care aides in providing long-term care, obtained through the State Long-Term Care Ombudsman program established under sections 307(a)(12) and 712 of the Older Americans Act of 1965 [now <ref href=\"/us/usc/t42/s3027/a/9\">42 U.S.C. 3027(a)(9)</ref>, 3058g].</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"804\">“SEC. 804.</num><heading> OCCUPATIONAL CODE.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“The Secretary of Labor shall include an occupational code covering nursing home nurse aides and an occupational code covering home health care aides in each wage survey of relevant industries conducted by the Department of Labor that begins after the date of enactment of this Act [<date date=\"1992-09-30\">Sept. 30, 1992</date>].”</p>\n</content>\n</section>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idaaa8d2d2-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Limitation on Authority To Enter Into Contracts</heading><p><ref href=\"/us/pl/102/375/tIX/s901\">Pub. L. 109–365, title IX, § 901(a)</ref>, <date date=\"2006-10-17\">Oct. 17, 2006</date>, <ref href=\"/us/stat/120/2598\">120 Stat. 2598</ref>, provided that:<quotedContent origin=\"/us/pl/109/365/tIX/s901/a\">\n<section style=\"-uslm-lc:I580467\"><num value=\"201\">“SEC. 201.</num><heading> AUTHORIZATION OF THE CONFERENCE.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Authority To Call Conference</inline>.—</heading><content>Not later than <date date=\"2005-12-31\">December 31, 2005</date>, the President shall convene the White House Conference on Aging in order to fulfill the purpose set forth in subsection (c) and to make fundamental policy recommendations regarding programs that are important to older individuals and to the families and communities of such individuals.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Planning and Direction</inline>.—</heading><content>The Conference described in subsection (a) shall be planned and conducted under the direction of the Secretary, in cooperation with the Assistant Secretary for Aging, the Director of the National Institute on Aging, the Administrator of the Health Care Financing Administration, the Social Security Administrator, and the heads of such other Federal agencies serving older individuals as are appropriate. Planning and conducting the Conference includes the assignment of personnel.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Purpose</inline>.—</heading><chapeau>The purpose of the Conference described in subsection (a) shall be to gather individuals representing the spectrum of thought and experience in the field of aging to—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> evaluate the manner in which the objectives of this Act [probably means the Older Americans Act of 1965, <ref href=\"/us/pl/89/73\">Pub. L. 89–73</ref>, which enacted this chapter] can be met by using the resources and talents of older individuals, of families and communities of such individuals, and of individuals from the public and private sectors;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> evaluate the manner in which national policies that are related to economic security and health care are prepared so that such policies serve individuals born from 1946 to 1964 and later, as the individuals become older individuals, including an examination of the Social Security, Medicare, and Medicaid programs carried out under titles II, XVIII, and XIX of the Social Security Act (<ref href=\"/us/usc/t42/s401\">42 U.S.C. 401</ref> et seq., 1395 et seq., and 1396 et seq.) in relation to providing services under this Act, and determine how well such policies respond to the needs of older individuals; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> develop not more than 50 recommendations to guide the President, Congress, and Federal agencies in serving older individuals.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Conference Participants and Delegates.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Participants</inline>.—</heading><chapeau>In order to carry out the purposes of this section, the Conference shall bring together—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> representatives of Federal, State, and local governments,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> professional and lay people who are working in the field of aging, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> representatives of the general public, particularly older individuals.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Selection of delegates</inline>.—</heading><content>The delegates shall be selected without regard to political affiliation or past partisan activity and shall, to the best of the appointing authority’s ability, be representative of the spectrum of thought in the field of aging. Delegates shall include individuals who are professionals, individuals who are nonprofessionals, minority individuals, individuals from low-income families, representatives of Federal, State, and local governments, and individuals from rural areas. A majority of such delegates shall be age 55 or older.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"202\">“SEC. 202.</num><heading> CONFERENCE ADMINISTRATION.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Administration</inline>.—</heading><chapeau>In administering this section, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> provide written notice to all members of the Policy Committee of each meeting, hearing, or working session of the Policy Committee not later than 48 hours before the occurrence of such meeting, hearing, or working session,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> request the cooperation and assistance of the heads of such other Federal departments and agencies as may be appropriate in the carrying out of this section,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> make available for public comment a proposed agenda, prepared by the Policy Committee, for the Conference which will reflect to the greatest extent possible the major issues facing older individuals consistent with the provisions of subsection (a),</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> prepare and make available background materials for the use of delegates to the Conference which the Secretary deems necessary, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> engage such additional personnel as may be necessary to carry out the provisions of this section without regard to provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Duties</inline>.—</heading><chapeau>The Secretary shall, in carrying out the Secretary’s responsibilities and functions under this section, and as part of the White House Conference on Aging, ensure that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the agenda prepared under subsection (a)(3) for the Conference is published in the Federal Register not later than 30 days after such agenda is approved by the Policy Committee, and the Secretary may republish such agenda together with the recommendations of the Secretary regarding such agenda, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the personnel engaged under subsection (a)(5) shall be fairly balanced in terms of points of views represented and shall be appointed without regard to political affiliation or previous partisan activities, [and]</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the recommendations of the Conference are not inappropriately influenced by any appointing authority or by any special interest, but will instead be the result of the independent judgment of the Conference, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> current and adequate statistical data, including decennial census data, and other information on the well-being of older individuals in the United States are readily available, in advance of the Conference, to the delegates of the Conference, together with such information as may be necessary to evaluate Federal programs and policies relating to aging. In carrying out this subparagraph, the Secretary is authorized to make grants to, and enter into cooperative agreements with, public agencies and nonprofit private organizations.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Gifts</inline>.—</heading><content>The Secretary may accept, on behalf of the United States, gifts (in cash or in kind, including voluntary and uncompensated services), which shall be available to carry out this title. Gifts of cash shall be available in addition to amounts appropriated to carry out this title. Gifts may be earmarked by the donor or the executive committee for a specific purpose.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Records</inline>.—</heading><chapeau>The Secretary shall maintain records regarding—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the sources, amounts, and uses of gifts accepted under subsection (c); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the identity of each person receiving assistance to carry out this title, and the amount of such assistance received by each such person.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"203\">“SEC. 203.</num><heading> POLICY COMMITTEE; RELATED COMMITTEES.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Policy Committee.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><chapeau>There is established a Policy Committee comprised of 17 members to be selected, not later than 2 years prior to the date on which the Conference convenes, as follows:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Presidential appointees</inline>.—</heading><chapeau>Nine members shall be selected by the President and shall include—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> three members who are officers or employees of the United States; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> six members with experience in the field of aging, including providers and consumers of aging services.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">House appointees</inline>.—</heading><content>Two members shall be selected by the Speaker of the House of Representatives, after consultation with the Committee on Education and the Workforce and the Committee on Ways and Means of the House of Representatives, and two members shall be selected by the Minority Leader of the House of Representatives, after consultation with such committees.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Senate appointees</inline>.—</heading><content>Two members shall be selected by the Majority Leader of the Senate, after consultation with members of the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, and two members shall be selected by the Minority Leader of the Senate, after consultation with members of such committees.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Duties of the policy committee</inline>.—</heading><chapeau>The Policy Committee shall initially meet at the call of the Secretary, but not later than 30 days after the last member is selected under subsection (a). Subsequent meetings of the Policy Committee shall be held at the call of the chairperson of the Policy Committee. Through meetings, hearings, and working sessions, the Policy Committee shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> make recommendations to the Secretary to facilitate the timely convening of the Conference;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> formulate and approve a proposed agenda for the Conference not later than 90 days after the first meeting of the Policy Committee for the Secretary;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> make recommendations for participants and delegates of the Conference;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> establish the number of delegates to be selected under section 201(d)(2);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> establish an executive committee consisting of three to five members, with a majority of such members being age 55 or older, to work with Conference staff; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> establish other committees as needed that have a majority of members who are age 55 or older.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Voting; chairperson.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Voting</inline>.—</heading><content>The Policy Committee shall act by the vote of a majority of the members present. A quorum of Committee members shall not be required to conduct Committee business.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Chairperson</inline>.—</heading><content>The President shall select the chairperson from among the members of the Policy Committee. The chairperson may vote only to break a tie vote of the other members of the Policy Committee.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Advisory and Other Committees.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The President shall establish an advisory committee to the Conference which shall include representation from the Federal Council on Aging and other public agencies and private nonprofit organizations as appropriate. The President shall consider for appointment to the advisory committee individuals recommended by the Policy Committee.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Other committees</inline>.—</heading><content>The Secretary may establish such other committees, including technical committees, as may be necessary to assist in the planning, conducting, and reviewing of the Conference.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Composition of Committees</inline>.—</heading><content>Each committee established under subsection (b) shall be composed of professionals and public members, and shall include individuals from low-income families and from minority groups. A majority of the public members of each such committee shall be 55 years of age or older, and individuals who are Native Americans.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Compensation</inline>.—</heading><content>Appointed members of any such committee (other than any officers or employees of the Federal Government), while attending conferences or meetings of the committee or otherwise serving at the request of the Secretary, shall be entitled to receive compensation at a rate to be fixed by the Secretary, but not to exceed the daily equivalent of the maximum rate of pay payable under <ref href=\"/us/usc/t5/s5376\">section 5376 of title 5</ref>, United States Code (including travel time). While away from their homes or regular places of business, such members may be allowed travel expenses, including per diem in lieu of subsistence, as authorized under section 5703 of such title for persons employed intermittently in Federal Government service.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"204\">“SEC. 204.</num><heading> REPORT OF THE CONFERENCE.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Preliminary Report</inline>.—</heading><content>Not later than 100 days after the date on which the Conference adjourns, the Policy Committee shall publish and deliver to the chief executive officers of the States a preliminary report on the Conference. Comments on the preliminary report of the Conference shall be accepted by the Policy Committee.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Final Report</inline>.—</heading><content>Not later than 6 months after the date on which the Conference adjourns, the Policy Committee shall publish and transmit to the President and to Congress recommendations resulting from the Conference and suggestions for any administrative action and legislation necessary to implement the recommendations contained within the report.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"205\">“SEC. 205.</num><heading> DEFINITIONS.</heading><chapeau style=\"-uslm-lc:I21\" class=\"indent0\">“For the purposes of this title—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the term ‘area agency on aging’ has the meaning given the term in section 102 of the Older Americans Act of 1965 (<ref href=\"/us/usc/t42/s3002\">42 U.S.C. 3002</ref>),</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the term ‘State agency on aging’ means the State agency designated under section 305(a)(1) of the Act,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the term ‘Secretary’ means the Secretary of Health and Human Services,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> the term ‘Conference’ means the White House Conference on Aging, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> the term ‘State’ means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands of the United States, the Trust Territory of the Pacific Islands, or the Commonwealth of the Northern Mariana Islands.</content>\n</paragraph>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"206\">“SEC. 206.</num><heading> AUTHORIZATION OF APPROPRIATIONS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Authorization.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>There are authorized to be appropriated to carry out this section [title]—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> such sums as may be necessary for the first fiscal year in which the Policy Committee plans the Conference and for the following fiscal year; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> such sums as may be necessary for the fiscal year in which the Conference is held.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Contracts</inline>.—</heading><content>Authority to enter into contracts under this title shall be effective only to the extent, or in such amounts as are, provided in advance in appropriations Acts.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Availability of Funds.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Except as provided in paragraph (3), funds appropriated to carry out this title and funds received as gifts under section 202(c) shall remain available for obligation or expenditure until the expiration of the one-year period beginning on the date the Conference adjourns.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Unobligated funds</inline>.—</heading><content>Except as provided in paragraph (3), any such funds neither expended nor obligated before the expiration of the one-year period beginning on the date the Conference adjourns shall be available to carry out the Older Americans Act of 1965 (<ref href=\"/us/usc/t42/s3001\">42 U.S.C. 3001</ref> et seq.).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Conference not convened</inline>.—</heading><content>If the Conference is not convened before <date date=\"2005-12-31\">December 31, 2005</date>, such funds neither expended nor obligated before such date shall be available to carry out the Older Americans Act of 1965.”</content>\n</paragraph>\n</subsection>\n</section>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For reference to maximum rate under <ref href=\"/us/usc/t5/s5376\">section 5376 of Title 5</ref>, Government Organization and Employees, see <ref href=\"/us/pl/110/372/s2/d/3\">section 2(d)(3) of Pub.
