<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida55af1f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h"><num value="300h">§ 300h.</num><heading> Regulations for State programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida55b1802-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Publication of proposed regulations; promulgation; amendments; public hearings; administrative consultations</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida55b1803-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/a/1"><num value="1">(1)</num><content> The Administrator shall publish proposed regulations for State underground injection control programs within 180 days after <date date="1974-12-16">December 16, 1974</date>. Within 180 days after publication of such proposed regulations, he shall promulgate such regulations with such modifications as he deems appropriate. Any regulation under this subsection may be amended from time to time.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida55b1804-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/a/2"><num value="2">(2)</num><content> Any regulation under this section shall be proposed and promulgated in accordance with <ref href="/us/usc/t5/s553">section 553 of title 5</ref> (relating to rulemaking), except that the Administrator shall provide opportunity for public hearing prior to promulgation of such regulations. In proposing and promulgating regulations under this section the Administrator shall consult with the Secretary, the National Drinking Water Advisory Council, and other appropriate Federal entities and with interested State entities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida55b1805-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Minimum requirements; restrictions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida55b1806-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/1"><num value="1">(1)</num><chapeau> Regulations under subsection (a) for State underground injection programs shall contain minimum requirements for effective programs to prevent underground injection which endangers drinking water sources within the meaning of subsection (d)(2). Such regulations shall require that a State program, in order to be approved under <ref href="/us/usc/t42/s300h–1">section 300h–1 of this title</ref>—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b1807-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/1/A"><num value="A">(A)</num><content> shall prohibit, effective on the date on which the applicable underground injection control program takes effect, any underground injection in such State which is not authorized by a permit issued by the State (except that the regulations may permit a State to authorize underground injection by rule);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b1808-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/1/B"><num value="B">(B)</num><content> shall require (i) in the case of a program which provides for authorization of underground injection by permit, that the applicant for the permit to inject must satisfy the State that the underground injection will not endanger drinking water sources, and (ii) in the case of a program which provides for such an authorization by rule, that no rule may be promulgated which authorizes any underground injection which endangers drinking water sources;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b1809-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/1/C"><num value="C">(C)</num><content> shall include inspection, monitoring, recordkeeping, and reporting requirements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b3f1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/1/D"><num value="D">(D)</num><content> shall apply (i) as prescribed by section 300j–6(b) <ref class="footnoteRef" idref="fn002327">1</ref><note type="footnote" id="fn002327"><num>1</num> See References in Text note below.</note> of this title, to underground injections by Federal agencies, and (ii) to underground injections by any other person whether or not occurring on property owned or leased by the United States.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida55b3f1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/2"><num value="2">(2)</num><chapeau> Regulations of the Administrator under this section for State underground injection control programs may not prescribe requirements which interfere with or impede—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b3f1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/2/A"><num value="A">(A)</num><content> the underground injection of brine or other fluids which are brought to the surface in connection with oil or natural gas production or natural gas storage operations, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b3f1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/2/B"><num value="B">(B)</num><content> any underground injection for the secondary or tertiary recovery of oil or natural gas,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">unless such requirements are essential to assure that underground sources of drinking water will not be endangered by such injection.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida55b3f1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="ida55b3f1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/A"><num value="A">(A)</num><content> The regulations of the Administrator under this section shall permit or provide for consideration of varying geologic, hydrological, or historical conditions in different States and in different areas within a State.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida55b3f20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/B"><num value="B">(B)</num><clause style="-uslm-lc:I11" class="indent0" id="ida55b3f21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/B/i"><num value="i">(i)</num><content> In prescribing regulations under this section the Administrator shall, to the extent feasible, avoid promulgation of requirements which would unnecessarily disrupt State underground injection control programs which are in effect and being enforced in a substantial number of States.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="ida55b3f22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/B/ii"><num value="ii">(ii)</num><content> For the purpose of this subparagraph, a regulation prescribed by the Administrator under this section shall be deemed to disrupt a State underground injection control program only if it would be infeasible to comply with both such regulation and the State underground injection control program.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="ida55b3f23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/B/iii"><num value="iii">(iii)</num><content> For the purpose of this subparagraph, a regulation prescribed by the Administrator under this section shall be deemed unnecessary only if, without such regulation, underground sources of drinking water will not be endangered by an underground injection.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida55b3f24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/b/3/C"><num value="C">(C)</num><content> Nothing in this section shall be construed to alter or affect the duty to assure that underground sources of drinking water will not be endangered by any underground injection.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida55b6635-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Temporary permits; notice and hearing</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida55b6636-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/1"><num value="1">(1)</num><chapeau> The Administrator may, upon application of the Governor of a State which authorizes underground injection by means of permits, authorize such State to issue (without regard to subsection (b)(1)(B)(i)) temporary permits for underground injection which may be effective until the, expiration of four years after <date date="1974-12-16">December 16, 1974</date>, if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b6637-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/1/A"><num value="A">(A)</num><content> the Administrator finds that the State has demonstrated that it is unable and could not reasonably have been able to process all permit applications within the time available;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b6638-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/1/B"><num value="B">(B)</num><content> the Administrator determines the adverse effect on the environment of such temporary permits is not unwarranted;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b6639-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/1/C"><num value="C">(C)</num><content> such temporary permits will be issued only with respect to injection wells in operation on the date on which such State’s permit program approved under this part first takes effect and for which there was inadequate time to process its permit application; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b663a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/1/D"><num value="D">(D)</num><content> the Administrator determines the temporary permits require the use of adequate safeguards established by rules adopted by him.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida55b663b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/2"><num value="2">(2)</num><chapeau> The Administrator may, upon application of the Governor of a State which authorizes underground injection by means of permits, authorize such State to issue (without regard to subsection (b)(1)(B)(i)), but after reasonable notice and hearing, one or more temporary permits each of which is applicable to a particular injection well and to the underground injection of a particular fluid and which may be effective until the expiration of four years after <date date="1974-12-16">December 16, 1974</date>, if the State finds, on the record of such hearing—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b663c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/2/A"><num value="A">(A)</num><content> that technology (or other means) to permit safe injection of the fluid in accordance with the applicable underground injection control program is not generally available (taking costs into consideration);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b663d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/2/B"><num value="B">(B)</num><content> that injection of the fluid would be less harmful to health than the use of other available means of disposing of waste or producing the desired product; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida55b663e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/c/2/C"><num value="C">(C)</num><content> that available technology or other means have been employed (and will be employed) to reduce the volume and toxicity of the fluid and to minimize the potentially adverse effect of the injection on the public health.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida55b8d4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d"><num value="d" class="bold">(d)</num><heading class="bold"> “Underground injection” defined; underground injection endangerment of drinking water sources</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this part:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida55b8d50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Underground injection</inline>.—</heading><chapeau>The term “underground injection”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida55b8d51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/1/A"><num value="A">(A)</num><content> means the subsurface emplacement of fluids by well injection; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida55b8d52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/1/B"><num value="B">(B)</num><chapeau> excludes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida55b8d53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/1/B/i"><num value="i">(i)</num><content> the underground injection of natural gas for purposes of storage; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida55b8d54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/1/B/ii"><num value="ii">(ii)</num><content> the underground injection of fluids or propping agents (other than diesel fuels) pursuant to hydraulic fracturing operations related to oil, gas, or geothermal production activities.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida55b8d55-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300h/d/2"><num value="2">(2)</num><content> Underground injection endangers drinking water sources if such injection may result in the presence in underground water which supplies or can reasonably be expected to supply any public water system of any contaminant, and if the presence of such contaminant may result in such system’s not complying with any national primary drinking water regulation or may otherwise adversely affect the health of persons.</content>
