L. 110–18, § 2(1), Apr. 20, 2007, 121 Stat. 80.)","seq_in_title":1104,"parent_identifier":"/us/usc/t42/ch6A/schXIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch6A","level":"chapter","num":"CHAPTER 6A—","heading":"PUBLIC HEALTH SERVICE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch6A/schXIII","level":"subchapter","num":"SUBCHAPTER XIII—","heading":"PREVENTIVE HEALTH MEASURES WITH RESPECT TO BREAST AND CERVICAL CANCERS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida572e629-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k\"><num value=\"300k\">§ 300k.</num><heading> Establishment of program of grants to States</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida572e62a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, may make grants to States on the basis of an established competitive review process for the purpose of carrying out programs—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e62b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/1\"><num value=\"1\">(1)</num><content> to screen women for breast and cervical cancer as a preventive health measure;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e62c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/2\"><num value=\"2\">(2)</num><content> to provide appropriate referrals for medical treatment of women screened pursuant to paragraph (1) and to ensure, to the extent practicable, the provision of appropriate follow-up services and support services such as case management;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e62d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/3\"><num value=\"3\">(3)</num><content> to develop and disseminate public information and education programs for the detection and control of breast and cervical cancer;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e62e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/4\"><num value=\"4\">(4)</num><content> to improve the education, training, and skills of health professionals (including allied health professionals) in the detection and control of breast and cervical cancer;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e62f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/5\"><num value=\"5\">(5)</num><content> to establish mechanisms through which the States can monitor the quality of screening procedures for breast and cervical cancer, including the interpretation of such procedures; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida572e630-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/a/6\"><num value=\"6\">(6)</num><content> to evaluate activities conducted under paragraphs (1) through (5) through appropriate surveillance or program-monitoring activities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida572e631-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Grant and contract authority of States</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida572e632-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State receiving a grant under subsection (a) may, subject to paragraphs (2) and (3), expend the grant to carry out the purpose described in such subsection through grants to public and nonprofit private entities and through contracts with public and private entities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida572e633-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Certain applications</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If a nonprofit private entity and a private entity that is not a nonprofit entity both submit applications to a State to receive an award of a grant or contract pursuant to paragraph (1), the State may give priority to the application submitted by the nonprofit private entity in any case in which the State determines that the quality of such application is equivalent to the quality of the application submitted by the other private entity.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida572e634-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Payments for screenings</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount paid by a State to an entity under this subsection for a screening procedure under subsection (a)(1) may not exceed the amount that would be paid under part B of title XVIII of the Social Security Act [<ref href=\"/us/usc/t42/s1395j\">42 U.S.C. 1395j</ref> et seq.] if payment were made under such part for furnishing the procedure to a woman enrolled under such part.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida5730d45-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Special consideration for certain States</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In making grants under subsection (a) to States whose initial grants under such subsection are made for fiscal year 1995 or any subsequent fiscal year, the Secretary shall give special consideration to any State whose proposal for carrying out programs under such subsection—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida5730d46-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/c/1\"><num value=\"1\">(1)</num><content> has been approved through a process of peer review; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida5730d47-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/c/2\"><num value=\"2\">(2)</num><chapeau> is made with respect to geographic areas in which there is—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5730d48-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/c/2/A\"><num value=\"A\">(A)</num><content> a substantial rate of mortality from breast or cervical cancer; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5730d49-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/c/2/B\"><num value=\"B\">(B)</num><content> a substantial incidence of either of such cancers.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida5730d4a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300k/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Coordinating committee regarding year 2020 health objectives</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall establish a committee to coordinate the activities of the agencies of the Public Health Service (and other appropriate Federal agencies) that are carried out toward achieving the objectives established by the Secretary for reductions in the rate of mortality from breast and cervical cancer in the United States by the year 2020.
