<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida63bb40b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk"><num value="300kk">§ 300kk.</num><heading> Data collection, analysis, and quality</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63bb40c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a"><num value="a" class="bold">(a)</num><heading class="bold"> Data collection</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bb40d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall ensure that, by not later than 2 years after <date date="2010-03-23">March 23, 2010</date>, any federally conducted or supported health care or public health program, activity or survey (including Current Population Surveys and American Community Surveys conducted by the Bureau of Labor Statistics and the Bureau of the Census) collects and reports, to the extent practicable—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb40e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/1/A"><num value="A">(A)</num><content> data on race, ethnicity, sex, primary language, and disability status for applicants, recipients, or participants;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb40f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/1/B"><num value="B">(B)</num><content> data at the smallest geographic level such as State, local, or institutional levels if such data can be aggregated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb410-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/1/C"><num value="C">(C)</num><content> sufficient data to generate statistically reliable estimates by racial, ethnic, sex, primary language, and disability status subgroups for applicants, recipients or participants using, if needed, statistical oversamples of these subpopulations; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb411-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/1/D"><num value="D">(D)</num><content> any other demographic data as deemed appropriate by the Secretary regarding health disparities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bb412-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Collection standards</heading><chapeau style="-uslm-lc:I12" class="indent1">In collecting data described in paragraph (1), the Secretary or designee shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb413-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/A"><num value="A">(A)</num><content> use Office of Management and Budget standards, at a minimum, for race and ethnicity measures;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb414-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/B"><num value="B">(B)</num><content> develop standards for the measurement of sex, primary language, and disability status;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb415-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/C"><num value="C">(C)</num><chapeau> develop standards for the collection of data described in paragraph (1) that, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida63bb416-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/C/i"><num value="i">(i)</num><content> collects self-reported data by the applicant, recipient, or participant; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida63bb417-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/C/ii"><num value="ii">(ii)</num><content> collects data from a parent or legal guardian if the applicant, recipient, or participant is a minor or legally incapacitated;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb418-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/D"><num value="D">(D)</num><chapeau> survey health care providers and establish other procedures in order to assess access to care and treatment for individuals with disabilities and to identify—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida63bb419-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/D/i"><num value="i">(i)</num><content> locations where individuals with disabilities access primary, acute (including intensive), and long-term care;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida63bb41a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/D/ii"><num value="ii">(ii)</num><content> the number of providers with accessible facilities and equipment to meet the needs of the individuals with disabilities, including medical diagnostic equipment that meets the minimum technical criteria set forth in <ref href="/us/usc/t29/s794f">section 794f of title 29</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida63bb41b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/D/iii"><num value="iii">(iii)</num><content> the number of employees of health care providers trained in disability awareness and patient care of individuals with disabilities; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bb41c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/2/E"><num value="E">(E)</num><content> require that any reporting requirement imposed for purposes of measuring quality under any ongoing or federally conducted or supported health care or public health program, activity, or survey includes requirements for the collection of data on individuals receiving health care items or services under such programs activities <ref class="footnoteRef" idref="fn002504">1</ref><note type="footnote" id="fn002504"><num>1</num> So in original.</note> by race, ethnicity, sex, primary language, and disability status.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bb41d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Data management</heading><chapeau style="-uslm-lc:I12" class="indent1">In collecting data described in paragraph (1), the Secretary, acting through the National Coordinator for Health Information Technology shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb2e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/3/A"><num value="A">(A)</num><content> develop national standards for the management of data collected; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb2f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/a/3/B"><num value="B">(B)</num><content> develop interoperability and security systems for data management.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63bdb30-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/b"><num value="b" class="bold">(b)</num><heading class="bold"> Data analysis</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bdb31-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> <ref class="footnoteRef" idref="fn002505">2</ref><note type="footnote" id="fn002505"><num>2</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/1/D"><num value="D">(D)</num><content> the Centers for Disease Control and Prevention;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/1/E"><num value="E">(E)</num><content> the Centers for Medicare &amp; Medicaid Services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb39-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/1/F"><num value="F">(F)</num><content> the Indian Health Service and epidemiology centers funded under the Indian Health Care Improvement Act [<ref href="/us/usc/t25/s1601">25 U.S.C. 1601</ref> et seq.];</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb3a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/1/G"><num value="G">(G)</num><content> the Office of Rural health; <ref class="footnoteRef" idref="fn002508">5</ref><note type="footnote" id="fn002508"><num>5</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb3c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/1/I"><num value="I">(I)</num><content> other entities as determined appropriate by the Secretary.</content>
</subparagraph>
</paragraph>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bdb40-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Availability of data</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may make data described in (a) and (b) available for additional research, analyses, and dissemination to other Federal agencies, non-governmental entities, and the public, in accordance with any Federal agency’s data user agreements.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63bdb41-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/d"><num value="d" class="bold">(d)</num><heading class="bold"> Limitations on use of data</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to permit the use of information collected under this section in a manner that would adversely affect any individual.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63bdb42-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e"><num value="e" class="bold">(e)</num><heading class="bold"> Protection and sharing of data</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bdb43-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Privacy and other safeguards</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall ensure (through the promulgation of regulations or otherwise) that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb44-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/1/A"><num value="A">(A)</num><chapeau> all data collected pursuant to subsection (a) is protected—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida63bdb45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/1/A/i"><num value="i">(i)</num><content> under privacy protections that are at least as broad as those that the Secretary applies to other health data under the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<ref href="/us/pl/104/191">Public Law 104–191</ref>; <ref href="/us/stat/110/2033">110 Stat. 2033</ref>); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida63bdb46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/1/A/ii"><num value="ii">(ii)</num><content> from all inappropriate internal use by any entity that collects, stores, or receives the data, including use of such data in determinations of eligibility (or continued eligibility) in health plans, and from other inappropriate uses, as defined by the Secretary; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida63bdb47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/1/B"><num value="B">(B)</num><content> all appropriate information security safeguards are used in the collection, analysis, and sharing of data collected pursuant to subsection (a).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida63bdb48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Data sharing</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish procedures for sharing data collected pursuant to subsection (a), measures relating to such data, and analyses of such data, with other relevant Federal and State agencies including the agencies, centers, and entities within the Department of Health and Human Services specified in subsection (c)(1)..<sup>1</sup></p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63bdb49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/f"><num value="f" class="bold">(f)</num><heading class="bold"> Data on rural underserved populations</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall ensure that any data collected in accordance with this section regarding racial and ethnic minority groups are also collected regarding underserved rural and frontier populations.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63c025a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/g"><num value="g" class="bold">(g)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">For the purpose of carrying out this section, there are authorized to be appropriated such sums as may be necessary for each of fiscal years 2010 through 2014.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63c025b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/h"><num value="h" class="bold">(h)</num><heading class="bold"> Requirement for implementation</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of this section, data may not be collected under this section unless funds are directly appropriated for such purpose in an appropriations Act.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida63c025c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s300kk/i"><num value="i" class="bold">(i)</num><heading class="bold"> Consultation</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall consult with the Director of the Office of Personnel Management, the Secretary of Defense, the Secretary of Veterans Affairs, the Director of the Bureau of the Census, the Commissioner of Social Security, and the head of other appropriate Federal agencies in carrying out this section.</p>
