L. 110–18, § 2(2), Apr. 20, 2007, 121 Stat. 80.)","seq_in_title":1107,"parent_identifier":"/us/usc/t42/ch6A/schXIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch6A","level":"chapter","num":"CHAPTER 6A—","heading":"PUBLIC HEALTH SERVICE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch6A/schXIII","level":"subchapter","num":"SUBCHAPTER XIII—","heading":"PREVENTIVE HEALTH MEASURES WITH RESPECT TO BREAST AND CERVICAL CANCERS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida573a9a0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m\"><num value=\"300m\">§ 300m.</num><heading> Requirements with respect to type and quality of services</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida573a9a1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Requirement of provision of all services by date certain</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may not make a grant under <ref href=\"/us/usc/t42/s300k\">section 300k of this title</ref> unless the State involved agrees—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida573a9a2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/1\"><num value=\"1\">(1)</num><content> to ensure that, initially and throughout the period during which amounts are received pursuant to the grant, not less than 60 percent of the grant is expended to provide each of the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>, including making available screening procedures for both breast and cervical cancers;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida573a9a3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/2\"><num value=\"2\">(2)</num><chapeau> subject to subsection (b), to ensure that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573a9a4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/2/A\"><num value=\"A\">(A)</num><content> in the case of breast cancer, both a physical examination of the breasts and the screening procedure known as a mammography are conducted; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573d0b5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/2/B\"><num value=\"B\">(B)</num><content> in the case of cervical cancer, both a pelvic examination and the screening procedure known as a pap smear are conducted;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida573d0b6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/3\"><num value=\"3\">(3)</num><content> to ensure that, by the end of any second fiscal year of payments pursuant to the grant, each of the services or activities described in <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref> is provided; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida573d0b7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/a/4\"><num value=\"4\">(4)</num><content> to ensure that not more than 40 percent of the grant is expended to provide the services or activities described in paragraphs (3) through (6) of such section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida573d0b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Use of improved screening procedures</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may not make a grant under <ref href=\"/us/usc/t42/s300k\">section 300k of this title</ref> unless the State involved agrees that, if any screening procedure superior to a procedure described in subsection (a)(2) becomes commonly available and is recommended for use, any entity providing screening procedures pursuant to the grant will utilize the superior procedure rather than the procedure described in such subsection.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida573d0b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Quality assurance regarding screening procedures</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may not make a grant under <ref href=\"/us/usc/t42/s300k\">section 300k of this title</ref> unless the State involved agrees that the State will, in accordance with applicable law, assure the quality of screening procedures conducted pursuant to such section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida573d0ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Waiver of services requirement on division of funds</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida573d0bb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish a demonstration project under which the Secretary may waive the requirements of paragraphs (1) and (4) of subsection (a) for not more than 5 States, if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573d0bc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/A\"><num value=\"A\">(A)</num><content> the State involved will use the waiver to leverage non-Federal funds to supplement each of the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573d0bd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/B\"><num value=\"B\">(B)</num><content> the application of such requirement would result in a barrier to the enrollment of qualifying women;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573d0be-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/C\"><num value=\"C\">(C)</num><chapeau> the State involved—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573d0bf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/C/i\"><num value=\"i\">(i)</num><content> demonstrates, to the satisfaction of the Secretary, the manner in which the State will use such waiver to expand the level of screening and follow-up services provided immediately prior to the date on which the waiver is granted; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573d0c0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/C/ii\"><num value=\"ii\">(ii)</num><content> provides assurances, satisfactory to the Secretary, that the State will, on an annual basis, demonstrate, through such documentation as the Secretary may require, that the State has used such waiver as described in clause (i);</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573d0c1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/D\"><num value=\"D\">(D)</num><chapeau> the State involved submits to the Secretary—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573d0c2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/D/i\"><num value=\"i\">(i)</num><chapeau> assurances, satisfactory to the Secretary, that the State will maintain the average annual level of State fiscal year expenditures for the services and activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref> for the period for which the waiver is granted, and for the period for which any extension of such wavier <ref class=\"footnoteRef\" idref=\"fn002336\">1</ref><note type=\"footnote\" id=\"fn002336\"><num>1</num> So in original. Probably should be “waiver”.</note> is granted, at a level that is not less than—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida573f7d3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/D/i/I\"><num value=\"I\">(I)</num><content> the level of the State fiscal year expenditures for such services and activities for the fiscal year preceding the first fiscal year for which the waiver is granted; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida573f7d4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/D/i/II\"><num value=\"II\">(II)</num><content> at the option of the State and upon approval by the Secretary, the average level of the State expenditures for such services and activities for the 3-fiscal year period preceding the first fiscal year for which the waiver is granted; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7d5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/D/ii\"><num value=\"ii\">(ii)</num><content> a plan, satisfactory to the Secretary, for maintaining the level of activities carried out under the waiver after the expiration of the waiver and any extension of such waiver;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573f7d6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/E\"><num value=\"E\">(E)</num><content> the Secretary finds that granting such a waiver to a State will increase the number of women in the State that receive each of the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>, including making available screening procedures for both breast and cervical cancers; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida573f7d7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/1/F\"><num value=\"F\">(F)</num><content> the Secretary finds that granting such a waiver to a State will not adversely affect the quality of each of the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida573f7d8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Duration of waiver</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida573f7d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In granting waivers under paragraph (1), the Secretary—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/A/i\"><num value=\"i\">(i)</num><content> shall grant such waivers for a period that is not less than 1 year but not more than 2 years; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> upon request of a State, may extend a waiver for an additional period that is not less than 1 year but not more than 2 years in accordance with subparagraph (B).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida573f7dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Additional period</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary, upon the request of a State that has received a waiver under paragraph (1), shall, at the end of the waiver period described in subparagraph (A)(i), review performance under the waiver and may extend the waiver for an additional period if the Secretary determines that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/i\"><num value=\"i\">(i)</num><content> without an extension of the waiver, there will be a barrier to the enrollment of qualifying women;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/ii\"><num value=\"ii\">(ii)</num><content> the State requesting such extended waiver will use the waiver to leverage non-Federal funds to supplement the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida573f7df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/iii\"><num value=\"iii\">(iii)</num><content> the waiver has increased, and will continue to increase, the number of women in the State that receive the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida5741ef0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/iv\"><num value=\"iv\">(iv)</num><content> the waiver has not, and will not, result in lower quality in the State of the services or activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida5741ef1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/v\"><num value=\"v\">(v)</num><chapeau> the State has maintained the average annual level of State fiscal expenditures for the services and activities described in paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref> for the period for which the waiver was granted at a level that is not less than—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida5741ef2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/v/I\"><num value=\"I\">(I)</num><content> the level of the State fiscal year expenditures for such services and activities for the fiscal year preceding the first fiscal year for which the waiver is granted; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida5741ef3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/2/B/v/II\"><num value=\"II\">(II)</num><content> at the option of the State and upon approval by the Secretary, the average level of the State expenditures for such services and activities for the 3-fiscal year period preceding the first fiscal year for which the waiver is granted.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida5741ef4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Reporting requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall include as part of the evaluations and reports required under <ref href=\"/us/usc/t42/s300n–4\">section 300n–4 of this title</ref>, the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5741ef5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/A\"><num value=\"A\">(A)</num><content> A description of the total amount of dollars leveraged annually from Non-Federal <ref class=\"footnoteRef\" idref=\"fn002337\">2</ref><note type=\"footnote\" id=\"fn002337\"><num>2</num> So in original. Probably should be “non-Federal”.</note> entities in States receiving a waiver under paragraph (1) and how these amounts were used.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5741ef6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/B\"><num value=\"B\">(B)</num><chapeau> With respect to States receiving a waiver under paragraph (1), a description of the percentage of the grant that is expended on providing each of the services or activities described in—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida5741ef7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/B/i\"><num value=\"i\">(i)</num><content> paragraphs (1) and (2) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida5741ef8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/B/ii\"><num value=\"ii\">(ii)</num><content> paragraphs (3) through (6) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref>.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5741ef9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/C\"><num value=\"C\">(C)</num><content> A description of the number of States receiving waivers under paragraph (1) annually.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida5741efa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/D\"><num value=\"D\">(D)</num><chapeau> With respect to States receiving a waiver under paragraph (1), a description of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida5741efb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s300m/d/3/D/i\"><num value=\"i\">(i)</num><content> the number of women receiving services under paragraphs (1), (2), and (3) of <ref href=\"/us/usc/t42/s300k/a\">section 300k(a) of this title</ref> in programs before and after the granting of such waiver;
