<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="iddeead705-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011"><num value="3011">§ 3011.</num><heading> Establishment of Administration on Aging</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeead706-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/a"><num value="a" class="bold">(a)</num><heading class="bold"> Function and operation</heading><content><p style="-uslm-lc:I11" class="indent0">There is established in the Office of the Secretary an Administration on Aging which shall be headed by an Assistant Secretary for Aging. Except for subchapter IX, the Administration shall be the agency for carrying out this chapter. There shall be a direct reporting relationship between the Assistant Secretary and the Secretary. In the performance of the functions of the Assistant Secretary, the Assistant Secretary shall be directly responsible to the Secretary. The Secretary shall not approve or require any delegation of the functions of the Assistant Secretary (including the functions of the Assistant Secretary carried out through regional offices) to any other officer not directly responsible to the Assistant Secretary.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeead707-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/b"><num value="b" class="bold">(b)</num><heading class="bold"> Appointment of Assistant Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">The Assistant Secretary shall be appointed by the President by and with the advice and consent of the Senate.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeead708-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c"><num value="c" class="bold">(c)</num><heading class="bold"> Office for American Indian, Alaskan Native, and Native Hawaiian Programs; Director</heading><paragraph style="-uslm-lc:I11" class="indent0" id="iddeead709-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/1"><num value="1">(1)</num><content> There is established in the Administration an Office for American Indian, Alaskan Native, and Native Hawaiian Programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeead70a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/2"><num value="2">(2)</num><content> The Office shall be headed by a Director of the Office for American Indian, Alaskan Native, and Native Hawaiian Aging appointed by the Assistant Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeead70b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3"><num value="3">(3)</num><chapeau> The Director of the Office for American Indian, Alaskan Native, and Native Hawaiian Aging shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead70c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/A"><num value="A">(A)</num><clause style="-uslm-lc:I12" class="indent1" id="iddeead70d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/A/i"><num value="i">(i)</num><content> evaluate the adequacy of outreach under subchapter III and subchapter X for older individuals who are Native Americans and recommend to the Assistant Secretary necessary action to improve service delivery, outreach, coordination between subchapter III and subchapter X services, and particular problems faced by older Indians and Native Hawaiians; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="iddeead70e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/A/ii"><num value="ii">(ii)</num><content> include a description of the results of such evaluation and recommendations in the annual report required by <ref href="/us/usc/t42/s3018/a">section 3018(a) of this title</ref> to be submitted by the Assistant Secretary;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead70f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/B"><num value="B">(B)</num><content> serve as the effective and visible advocate in behalf of older individuals who are Native Americans within the Department of Health and Human Services and with other departments and agencies of the Federal Government regarding all Federal policies affecting such individuals, with particular attention to services provided to Native Americans by the Indian Health Service;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead710-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/C"><num value="C">(C)</num><content> coordinate activities between other Federal departments and agencies to assure a continuum of improved services through memoranda of agreements or through other appropriate means of coordination;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead711-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/D"><num value="D">(D)</num><content> administer and evaluate the grants provided under this chapter to Indian tribes, public agencies and nonprofit private organizations serving Native Hawaiians;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead712-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/E"><num value="E">(E)</num><content> recommend to the Assistant Secretary policies and priorities with respect to the development and operation of programs and activities conducted under this chapter relating to older individuals who are Native Americans;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead713-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/F"><num value="F">(F)</num><content> collect and disseminate information related to problems experienced by older Native Americans, including information (compiled with assistance from public or nonprofit private entities, including institutions of higher education, with experience in assessing the characteristics and health status of older individuals who are Native Americans) on elder abuse, in-home care, health problems, and other problems unique to Native Americans;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead714-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/G"><num value="G">(G)</num><content> develop research plans, and conduct and arrange for research, in the field of American Native aging with a special emphasis on the gathering of statistics on the status of older individuals who are Native Americans;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead715-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/H"><num value="H">(H)</num><content> develop and provide technical assistance and training programs to grantees under subchapter X;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead716-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/I"><num value="I">(I)</num><chapeau> promote coordination—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeead717-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/I/i"><num value="i">(i)</num><content> between the administration of subchapter III and the administration of subchapter X; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeead718-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/I/ii"><num value="ii">(ii)</num><content> between programs established under subchapter III by the Assistant Secretary and programs established under subchapter X by the Assistant Secretary;</content>
</clause>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">including sharing among grantees information on programs funded, and on training and technical assistance provided, under such subchapters; and</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead719-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/c/3/J"><num value="J">(J)</num><content> serve as the effective and visible advocate on behalf of older individuals who are Indians, Alaskan Natives, and Native Hawaiians, in the States to promote the enhanced delivery of services and implementation of programs, under this chapter and other Federal Acts, for the benefit of such individuals.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeead71a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d"><num value="d" class="bold">(d)</num><heading class="bold"> Office of Long-Term Care Ombudsman Programs</heading><paragraph style="-uslm-lc:I11" class="indent0" id="iddeead71b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/1"><num value="1">(1)</num><content> There is established in the Administration the Office of Long-Term Care Ombudsman Programs (in this subsection referred to as the “Office”).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeead71c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="iddeead71d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/A"><num value="A">(A)</num><content> The Office shall be headed by a Director of the Office of Long-Term Care Ombudsman Programs (in this subsection referred to as the “Director”) who shall be appointed by the Assistant Secretary from among individuals who have expertise and background in the fields of long-term care advocacy and management. The Director shall report directly to the Assistant Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="iddeead71e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B"><num value="B">(B)</num><chapeau> No individual shall be appointed Director if—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="iddeead71f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/i"><num value="i">(i)</num><chapeau> the individual has been employed within the previous 2 years by—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="iddeead720-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/i/I"><num value="I">(I)</num><content> a long-term care facility;</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="iddeead721-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/i/II"><num value="II">(II)</num><content> a corporation that then owned or operated a long-term care facility; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="iddeead722-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/i/III"><num value="III">(III)</num><content> an association of long-term care facilities;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="iddeead723-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/ii"><num value="ii">(ii)</num><chapeau> the individual—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="iddeead724-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/ii/I"><num value="I">(I)</num><content> has an ownership or investment interest (represented by equity, debt, or other financial relationship) in a long-term care facility or long-term care service; or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="iddeead725-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/ii/II"><num value="II">(II)</num><content> receives, or has the right to receive, directly or indirectly remuneration (in cash or in kind) under a compensation arrangement with an owner or operator of a long-term care facility; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="iddeead726-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/2/B/iii"><num value="iii">(iii)</num><content> the individual, or any member of the immediate family of the individual, is subject to a conflict of interest.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeead727-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3"><num value="3">(3)</num><chapeau> The Director shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead728-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/A"><num value="A">(A)</num><content> serve as an effective and visible advocate on behalf of older individuals who reside in long-term care facilities, within the Department of Health and Human Services and with other departments, agencies, and instrumentalities of the Federal Government regarding all Federal policies affecting such individuals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead729-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/B"><num value="B">(B)</num><chapeau> review and make recommendations to the Assistant Secretary regarding—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeead72a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/B/i"><num value="i">(i)</num><content> the approval of the provisions in State plans submitted under <ref href="/us/usc/t42/s3027/a">section 3027(a) of this title</ref> that relate to State Long-Term Care Ombudsman programs; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeead72b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/B/ii"><num value="ii">(ii)</num><content> the adequacy of State budgets and policies relating to the programs;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead72c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/C"><num value="C">(C)</num><chapeau> after consultation with State Long-Term Care Ombudsmen and the State agencies, make recommendations to the Assistant Secretary regarding—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeead72d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/C/i"><num value="i">(i)</num><content> policies designed to assist State Long-Term Care Ombudsmen; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeead72e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/C/ii"><num value="ii">(ii)</num><content> methods to periodically monitor and evaluate the operation of State Long-Term Care Ombudsman programs, to ensure that the programs satisfy the requirements of <ref href="/us/usc/t42/s3027/a/9">section 3027(a)(9) of this title</ref> and <ref href="/us/usc/t42/s3058g">section 3058g of this title</ref>, including provision of service to residents of board and care facilities and of similar adult care facilities;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead72f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/D"><num value="D">(D)</num><chapeau> keep the Assistant Secretary and the Secretary fully and currently informed about—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeead730-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/D/i"><num value="i">(i)</num><content> problems relating to State Long-Term Care Ombudsman programs; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeead731-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/D/ii"><num value="ii">(ii)</num><content> the necessity for, and the progress toward, solving the problems;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead732-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/E"><num value="E">(E)</num><content> review, and make recommendations to the Secretary and the Assistant Secretary regarding, existing and proposed Federal legislation, regulations, and policies regarding the operation of State Long-Term Care Ombudsman programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead733-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/F"><num value="F">(F)</num><content> make recommendations to the Assistant Secretary and the Secretary regarding the policies of the Administration, and coordinate the activities of the Administration with the activities of other Federal entities, State and local entities, and nongovernmental entities, relating to State Long-Term Care Ombudsman programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeead734-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/G"><num value="G">(G)</num><content> supervise the activities carried out under the authority of the Administration that relate to State Long-Term Care Ombudsman programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4835-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/H"><num value="H">(H)</num><content> administer the National Ombudsman Resource Center established under <ref href="/us/usc/t42/s3012/a/18">section 3012(a)(18) of this title</ref> and make recommendations to the Assistant Secretary regarding the operation of the National Ombudsman Resource Center;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4836-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/I"><num value="I">(I)</num><content> advocate, monitor, and coordinate Federal and State activities of Long-Term Care Ombudsmen under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4837-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/J"><num value="J">(J)</num><content> submit to the Speaker of the House of Representatives and the President pro tempore of the Senate an annual report on the effectiveness of services provided under <ref href="/us/usc/t42/s3027/a/9">section 3027(a)(9) of this title</ref> and <ref href="/us/usc/t42/s3058g">section 3058g of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4838-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/K"><num value="K">(K)</num><content> have authority to investigate the operation or violation of any Federal law administered by the Department of Health and Human Services that may adversely affect the health, safety, welfare, or rights of older individuals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4839-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/L"><num value="L">(L)</num><content> not later than 180 days after <date date="2016-04-19">April 19, 2016</date>, establish standards applicable to the training required by <ref href="/us/usc/t42/s3058g/h/5">section 3058g(h)(5) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed483a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/d/3/M"><num value="M">(M)</num><content> collect and analyze best practices related to responding to elder abuse, neglect, and exploitation in long-term care facilities, and publish a report of such best practices.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeed483b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e"><num value="e" class="bold">(e)</num><heading class="bold"> Elder abuse prevention and services</heading><paragraph style="-uslm-lc:I11" class="indent0" id="iddeed483c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/1"><num value="1">(1)</num><content> The Assistant Secretary is authorized to designate within the Administration a person to have responsibility for elder abuse prevention and services.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed483d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2"><num value="2">(2)</num><chapeau> It shall be the duty of the Assistant Secretary, acting through the person designated to have responsibility for elder abuse prevention and services, and in coordination with the heads of State adult protective services programs and the Director of the Office of Long-Term Care Ombudsman Programs—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed483e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A"><num value="A">(A)</num><chapeau> to develop objectives, priorities, policy, and a long-term plan for—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeed483f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/i"><num value="i">(i)</num><content> facilitating the development, implementation, and continuous improvement of a coordinated, multidisciplinary elder justice system in the United States;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4840-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/ii"><num value="ii">(ii)</num><chapeau> providing Federal leadership to support State efforts in carrying out elder justice programs and activities relating to—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="iddeed4841-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/ii/I"><num value="I">(I)</num><content> elder abuse prevention, detection, treatment, intervention, and response;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="iddeed4842-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/ii/II"><num value="II">(II)</num><content> training of individuals regarding the matters described in subclause (I); and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="iddeed4843-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/ii/III"><num value="III">(III)</num><content> the development of a State comprehensive elder justice system, as defined in <ref href="/us/usc/t42/s3058aa–1/b">section 3058aa–1(b) of this title</ref>;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4844-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/iii"><num value="iii">(iii)</num><content> establishing Federal guidelines and disseminating best practices for uniform data collection and reporting by States;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4845-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/iv"><num value="iv">(iv)</num><content> working with States, the Department of Justice, and other Federal entities to annually collect, maintain, and disseminate data relating to elder abuse, neglect, and exploitation, to the extent practicable;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4846-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/v"><num value="v">(v)</num><content> establishing an information clearinghouse to collect, maintain, and disseminate information concerning best practices and resources for training, technical assistance, and other activities to assist States and communities to carry out evidence-based programs to prevent and address elder abuse, neglect, and exploitation;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4847-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/vi"><num value="vi">(vi)</num><content> conducting research related to elder abuse, neglect, and exploitation;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4848-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/vii"><num value="vii">(vii)</num><content> providing technical assistance to States and other eligible entities that provide or fund the provision of the services described in subchapter XI;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4849-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/viii"><num value="viii">(viii)</num><content> carrying out a study to determine the national incidence and prevalence of elder abuse, neglect, and exploitation in all settings; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed484a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/A/ix"><num value="ix">(ix)</num><content> promoting collaborative efforts and diminishing duplicative efforts in the development and carrying out of elder justice programs at the Federal, State and local levels; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed484b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/2/B"><num value="B">(B)</num><content> to assist States and other eligible entities under subchapter XI to develop strategic plans to better coordinate elder justice activities, research, and training.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed484c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/e/3"><num value="3">(3)</num><content> The Secretary, acting through the Assistant Secretary, may issue such regulations as may be necessary to carry out this subsection and <ref href="/us/usc/t42/s3058aa–1">section 3058aa–1 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeed484d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/f"><num value="f" class="bold">(f)</num><heading class="bold"> Mental health services</heading><paragraph style="-uslm-lc:I11" class="indent0" id="iddeed484e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/f/1"><num value="1">(1)</num><content> The Assistant Secretary may designate an officer or employee who shall be responsible for the administration of mental and behavioral health services authorized under this chapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed484f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/f/2"><num value="2">(2)</num><content> It shall be the duty of the Assistant Secretary, acting through the individual designated under paragraph (1), to develop objectives, priorities, and a long-term plan for supporting State and local efforts involving education about and prevention, detection, and treatment of mental disorders, including age-related dementia, depression, and Alzheimer’s disease and related neurological disorders with neurological and organic brain dysfunction.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="iddeed4850-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g"><num value="g" class="bold">(g)</num><heading class="bold"> Research, Demonstration, and Evaluation Center for the Aging Network</heading><paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4851-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/1"><num value="1">(1)</num><content> The Assistant Secretary shall, as appropriate, coordinate the research and evaluation functions of this chapter under a Research, Demonstration, and Evaluation Center for the Aging Network (in this subsection referred to as the “Center”), which shall be headed by a director designated by the Assistant Secretary from individuals described in paragraph (4).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4852-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/2"><num value="2">(2)</num><chapeau> The purpose of the Center shall be—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4853-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/2/A"><num value="A">(A)</num><content> to coordinate, as appropriate, research, research dissemination, evaluation, demonstration projects, and related activities carried out under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4854-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/2/B"><num value="B">(B)</num><content> to provide assessment of the programs and interventions authorized under this chapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4855-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/2/C"><num value="C">(C)</num><content> to increase the repository of information on evidence-based programs and interventions available to the aging network, which information shall be applicable to existing programs and interventions and help in the development of new evidence-based programs and interventions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4856-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3"><num value="3">(3)</num><chapeau> Activities of the Center shall include, as appropriate, conducting, promoting, coordinating, and providing support for—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4857-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/A"><num value="A">(A)</num><chapeau> research and evaluation activities that support the objectives of this chapter, including—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="iddeed4858-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/A/i"><num value="i">(i)</num><content> evaluation of new and existing programs and interventions authorized by this chapter; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="iddeed4859-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/A/ii"><num value="ii">(ii)</num><content> research on and assessment of the relationship between programs and interventions under this chapter and the health outcomes, social determinants of health, quality of life, and independence of individuals served under this chapter;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed485a-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/B"><num value="B">(B)</num><content> demonstration projects that support the objectives of this chapter, including activities to bring effective demonstration projects to scale with a prioritization of projects that address the needs of underserved populations, and promote partnerships among aging services, community-based organizations, and Medicare and Medicaid providers, plans, and health (including public health) systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed485b-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/C"><num value="C">(C)</num><content> outreach and dissemination of research findings; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed485c-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/3/D"><num value="D">(D)</num><content> technical assistance related to the activities described in this paragraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed485d-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/4"><num value="4">(4)</num><content> The director shall be an individual with substantial knowledge of and experience in aging and health policy, and research administration.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed485e-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/5"><num value="5">(5)</num><chapeau> Not later than <date date="2020-10-01">October 1, 2020</date>, and at 5-year intervals thereafter, the director shall prepare and publish in the Federal Register for public comment a draft of a 5-year plan that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed485f-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/5/A"><num value="A">(A)</num><content> outlines priorities for research, research dissemination, evaluation, demonstration projects, and related activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4860-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/5/B"><num value="B">(B)</num><content> explains the basis for such priorities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="iddeed4861-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/5/C"><num value="C">(C)</num><content> describes how the plan will meet the needs of underserved populations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4862-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/6"><num value="6">(6)</num><content> The director shall coordinate, as appropriate, research, research dissemination, evaluation, and demonstration projects, and related activities with appropriate agency program staff, and, as appropriate, with other Federal departments and agencies involved in research in the field of aging.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4863-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/7"><num value="7">(7)</num><content> Not later than <date date="2020-12-31">December 31, 2020</date>, and annually thereafter, the director shall prepare, and submit to the Secretary, the Committee on Health, Education, Labor, and Pensions of the Senate, the Special Committee on Aging of the Senate, and the Committee on Education and Labor of the House of Representatives, a report on the activities funded under this section and subchapter IV.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4864-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/8"><num value="8">(8)</num><content> The director shall, as appropriate, consult with experts on aging research and evaluation and aging network stakeholders on the implementation of the activities described under paragraph (3) of this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="iddeed4865-75c9-11ea-ab93-c45e2e133810" identifier="/us/usc/t42/s3011/g/9"><num value="9">(9)</num><content> The director shall coordinate, as appropriate, all research and evaluation authorities under this chapter.</content>
