L. 116–131, title II, § 201, Mar. 25, 2020, 134 Stat. 254.)","seq_in_title":3373,"parent_identifier":"/us/usc/t42/ch35/schIII/ptA","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch35","level":"chapter","num":"CHAPTER 35—","heading":"PROGRAMS FOR OLDER AMERICANS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch35/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"GRANTS FOR STATE AND COMMUNITY PROGRAMS ON AGING","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch35/schIII/ptA","level":"part","num":"Part A—","heading":"General Provisions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idada8695d-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021\"><num value=\"3021\">§ 3021.</num><heading> Purpose and program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idada8695e-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Congressional declaration of purpose</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada8695f-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1\"><num value=\"1\">(1)</num><chapeau> It is the purpose of this subchapter to encourage and assist State agencies and area agencies on aging to concentrate resources in order to develop greater capacity and foster the development and implementation of comprehensive and coordinated systems to serve older individuals by entering into new cooperative arrangements in each State with the persons described in paragraph (2), for the planning, and for the provision of, supportive services, and multipurpose senior centers, in order to—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86960-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1/A\"><num value=\"A\">(A)</num><content> secure and maintain maximum independence and dignity in a home environment for older individuals capable of self care with appropriate supportive services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86961-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1/B\"><num value=\"B\">(B)</num><content> remove individual and social barriers to economic and personal independence for older individuals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86962-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1/C\"><num value=\"C\">(C)</num><content> provide a continuum of care for vulnerable older individuals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86963-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1/D\"><num value=\"D\">(D)</num><content> secure the opportunity for older individuals to receive managed in-home and community-based long-term care services; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86964-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/1/E\"><num value=\"E\">(E)</num><content> measure impacts related to social determinants of health of older individuals.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada86965-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2\"><num value=\"2\">(2)</num><chapeau> The persons referred to in paragraph (1) include—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86966-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/A\"><num value=\"A\">(A)</num><content> State agencies and area agencies on aging;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada86967-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/B\"><num value=\"B\">(B)</num><content> other State agencies, including agencies that administer home and community care programs;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada89078-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/C\"><num value=\"C\">(C)</num><content> Indian tribes, tribal organizations, and Native Hawaiian organizations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada89079-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/D\"><num value=\"D\">(D)</num><content> the providers, including voluntary organizations or other private sector organizations, of supportive services, nutrition services, and multipurpose senior centers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada8907a-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/E\"><num value=\"E\">(E)</num><content> organizations representing or employing older individuals or their families; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idada8907b-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/a/2/F\"><num value=\"F\">(F)</num><content> organizations that have experience in providing training, placement, and stipends for volunteers or participants who are older individuals (such as organizations carrying out Federal service programs administered by the Corporation for National and Community Service), in community service settings.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idada8907c-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Administration of program</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada8907d-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/b/1\"><num value=\"1\">(1)</num><content> In order to effectively carry out the purpose of this subchapter, the Assistant Secretary shall administer programs under this subchapter through the Administration.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada8907e-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/b/2\"><num value=\"2\">(2)</num><content> In carrying out the provisions of this subchapter, the Assistant Secretary may request the technical assistance and cooperation of the Department of Education, the Department of Labor, the Department of Housing and Urban Development, the Department of Transportation, the Office of Community Services, the Department of Veterans Affairs, the Substance Abuse and Mental Health Services Administration,,<ref class=\"footnoteRef\" idref=\"fn003230\">1</ref><note type=\"footnote\" id=\"fn003230\"><num>1</num> So in original.</note> and such other agencies and departments of the Federal Government as may be appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idada8907f-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Ombudsman program</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Assistant Secretary shall provide technical assistance and training (by contract, grant, or otherwise) to State long-term care ombudsman programs established under <ref href=\"/us/usc/t42/s3027/a/9\">section 3027(a)(9) of this title</ref> in accordance with <ref href=\"/us/usc/t42/s3058g\">section 3058g of this title</ref>, and to individuals within such programs designated under <ref href=\"/us/usc/t42/s3058g\">section 3058g of this title</ref> to be representatives of a long-term care ombudsman, in order to enable such ombudsmen and such representatives to carry out the ombudsman program effectively.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idada89080-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Use of funds</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada89081-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/d/1\"><num value=\"1\">(1)</num><content> Any funds received under an allotment as described in <ref href=\"/us/usc/t42/s3024/a\">section 3024(a) of this title</ref>, or funds contributed toward the non-Federal share under <ref href=\"/us/usc/t42/s3024/d\">section 3024(d) of this title</ref>, shall be used only for activities and services to benefit older individuals and other individuals as specifically provided for in this subchapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idada8b792-c149-11ea-9926-d3ea3d33fdd4\" identifier=\"/us/usc/t42/s3021/d/2\"><num value=\"2\">(2)</num><content> No provision of this subchapter shall be construed as prohibiting a State agency or area agency on aging from providing services by using funds from sources not described in paragraph (1).</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idada8b793-c149-11ea-9926-d3ea3d33fdd4\">(<ref href=\"/us/pl/89/73/tIII/s301\">Pub.
