use of excess funds to supplement cost of administration of area plans; election to pay costs from sums received for administration of area plans</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff689-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/a/1\"><num value=\"1\">(1)</num><content> Amounts available to States under subsection (b) may be used to make grants to States for paying such percentages as each State agency determines, but not more than 75 percent, of the cost of the administration of its State plan, including the preparation of the State plan, the evaluation of activities carried out under such plan, the collection of data and the carrying out of analyses related to the need for supportive services, nutrition services, and multipurpose senior centers within the State, and dissemination of information so obtained, the provision of short-term training to personnel of public or nonprofit private agencies and organizations engaged in the operation of programs authorized by this chapter, and the carrying out of demonstration projects of statewide significance relating to the initiation, expansion, or improvement of services assisted under this subchapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff68a-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/a/2\"><num value=\"2\">(2)</num><content> Any sums available to a State under subsection (b) for part of the cost of the administration of its State plan which the State determines is not needed for such purpose may be used by the State to supplement the amount available under <ref href=\"/us/usc/t42/s3024/d/1/A\">section 3024(d)(1)(A) of this title</ref> to cover part of the cost of the administration of area plans.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff68b-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/a/3\"><num value=\"3\">(3)</num><content> Any State which has been designated a single planning and service area under <ref href=\"/us/usc/t42/s3025/a/1/E\">section 3025(a)(1)(E) of this title</ref> covering all, or substantially all, of the older individuals in such State, as determined by the Assistant Secretary, may elect to pay part of the costs of the administration of State and area plans either out of sums received under this section of out of sums made available for the administration of area plans under <ref href=\"/us/usc/t42/s3024/d/1/A\">section 3024(d)(1)(A) of this title</ref>, but shall not pay such costs out of sums received or allotted under both such sections.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"iddf2ff68c-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Formula for computation of allotment; application for additional funds; approval of application by Assistant Secretary; limitation on amount of additional funds; transfer of funds</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff68d-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/1\"><num value=\"1\">(1)</num><chapeau> If for any fiscal year the aggregate amount appropriated under <ref href=\"/us/usc/t42/s3023\">section 3023 of this title</ref> does not exceed $800,000,000, then—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff68e-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/1/A\"><num value=\"A\">(A)</num><chapeau> except as provided in subparagraph (B), the greater of—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf2ff68f-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/1/A/i\"><num value=\"i\">(i)</num><content> 5 percent of the total amount of the allotments made to a State under sections 3024(a)(1) and 3030s–1(f) of this title; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf2ff690-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> $300,000; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff691-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/1/B\"><num value=\"B\">(B)</num><content> in the case of Guam, American Samoa, the United States Virgin Islands, the Trust Territory of the Pacific Islands, and the Commonwealth of the Northern Mariana Islands, the greater of 5 percent of such total amount or $75,000;</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be available to such State to carry out the purposes of this section.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff692-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/2\"><num value=\"2\">(2)</num><chapeau> If for any fiscal year the aggregate amount appropriated under <ref href=\"/us/usc/t42/s3023\">section 3023 of this title</ref> exceeds $800,000,000, then—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff693-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/2/A\"><num value=\"A\">(A)</num><chapeau> except as provided in subparagraph (B), the greater of—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf2ff694-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/2/A/i\"><num value=\"i\">(i)</num><content> 5 percent of the total amount of the allotments made to a State under sections 3024(a)(1) and 3030s–1(f) of this title; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf2ff695-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/2/A/ii\"><num value=\"ii\">(ii)</num><content> $750,000; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff696-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/2/B\"><num value=\"B\">(B)</num><content> in the case of Guam, American Samoa, the United States Virgin Islands, the Trust Territory of the Pacific Islands, and the Commonwealth of the Northern Mariana Islands, the greater of 5 percent of such total amount or $100,000;</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be available to such State to carry out the purposes of this section.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff697-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff698-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/A\"><num value=\"A\">(A)</num><content> If the aggregate amount appropriated under <ref href=\"/us/usc/t42/s3023\">section 3023 of this title</ref> for a fiscal year does not exceed $800,000,000, then any State which desires to receive amounts, in addition to amounts allotted to such State under paragraph (1), to be used in the administration of its State plan in accordance with subsection (a) may transmit an application to the Assistant Secretary in accordance with this paragraph. Any such application shall be transmitted in such form, and according to such procedures, as the Assistant Secretary may require, except that such application may not be made as part of, or as an amendment to, the State plan.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff699-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/B\"><num value=\"B\">(B)</num><chapeau> The Assistant Secretary may approve any application transmitted by a State under subparagraph (A) if the Assistant Secretary determines, based upon a particularized showing of need, that—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff69a-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/B/i\"><num value=\"i\">(i)</num><content> the State will be unable to fully and effectively administer its State plan and to carry out programs and projects authorized by this subchapter unless such additional amounts are made available by the Assistant Secretary;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff69b-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/B/ii\"><num value=\"ii\">(ii)</num><content> the State is making full and effective use of its allotment under paragraph (1) and of the personnel of the State agency and area agencies designated under <ref href=\"/us/usc/t42/s3025/a/2/A\">section 3025(a)(2)(A) of this title</ref> in the administration of its State plan in accordance with subsection (a); and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf2ff69c-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/B/iii\"><num value=\"iii\">(iii)</num><content> the State agency and area agencies on aging of such State are carrying out, on a full-time basis, programs and activities which are in furtherance of the objectives of this chapter.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff69d-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/C\"><num value=\"C\">(C)</num><content> The Assistant Secretary may approve that portion of the amount requested by a State in its application under subparagraph (A) which the Assistant Secretary determines has been justified in such application.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff69e-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/D\"><num value=\"D\">(D)</num><content> Amounts which any State may receive in any fiscal year under this paragraph may not exceed three-fourths of 1 percent of the sum of the amounts allotted under <ref href=\"/us/usc/t42/s3024/a\">section 3024(a) of this title</ref> to such State to carry out the State plan for such fiscal year.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff69f-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/3/E\"><num value=\"E\">(E)</num><content> No application by a State under subparagraph (A) shall be approved unless it contains assurances that no amounts received by the State under this paragraph will be used to hire any individual to fill a job opening created by the action of the State in laying off or terminating the employment of any regular employee not supported under this chapter in anticipation of filling the vacancy so created by hiring an employee to be supported through use of amounts received under this paragraph.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff6a0-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4\"><num value=\"4\">(4)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf2ff6a1-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/A\"><num value=\"A\">(A)</num><content> Notwithstanding any other provision of this subchapter and except as provided in subparagraph (B), with respect to funds received by a State and attributable to funds appropriated under paragraph (1) or (2) of <ref href=\"/us/usc/t42/s3023/b\">section 3023(b) of this title</ref>, the State may elect to transfer not more than 40 percent of the funds so received between subpart I and subpart II of part C, for use as the State considers appropriate to meet the needs of the area served. The Assistant Secretary shall approve any such transfer unless the Assistant Secretary determines that such transfer is not consistent with the objectives of this chapter.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267a2-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/B\"><num value=\"B\">(B)</num><content> If a State demonstrates, to the satisfaction of the Assistant Secretary, that funds received by the State and attributable to funds appropriated under paragraph (1) or (2) of <ref href=\"/us/usc/t42/s3023/b\">section 3023(b) of this title</ref>, including funds transferred under subparagraph (A) without regard to this subparagraph, for any fiscal year are insufficient to satisfy the need for services under subpart I or subpart II of part C, then the Assistant Secretary may grant a waiver that permits the State to transfer under subparagraph (A) to satisfy such need an additional 10 percent of the funds so received by a State and attributable to funds appropriated under paragraph (1) or (2) of <ref href=\"/us/usc/t42/s3023/b\">section 3023(b) of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267a3-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/C\"><num value=\"C\">(C)</num><chapeau> A State’s request for a waiver under subparagraph (B) shall—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267a4-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/C/i\"><num value=\"i\">(i)</num><content> be not more than one page in length;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267a5-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/C/ii\"><num value=\"ii\">(ii)</num><content> include a request that the waiver be granted;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267a6-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/C/iii\"><num value=\"iii\">(iii)</num><content> specify the amount of the funds received by a State and attributable to funds appropriated under paragraph (1) or (2) of <ref href=\"/us/usc/t42/s3023/b\">section 3023(b) of this title</ref>, over the permissible 40 percent referred to in subparagraph (A), that the State requires to satisfy the need for services under subpart I or II of part C; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267a7-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/C/iv\"><num value=\"iv\">(iv)</num><content> not include a request for a waiver with respect to an amount if the transfer of the amount would jeopardize the appropriate provision of services under subpart I or II of part C.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267a8-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/4/D\"><num value=\"D\">(D)</num><content> The State, in consultation with area agencies on aging, shall ensure the process used by the State in transferring funds under this paragraph (including requirements relating to the authority and timing of such transfers) is simplified and clarified to reduce administrative barriers and direct limited resources to the greatest nutrition service needs at the community level. Such process shall be modified to attempt to lessen the administrative barriers of such transfers, and help direct limited resources to where they are needed the most as the unmet need for nutrition services grows.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267a9-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/5\"><num value=\"5\">(5)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267aa-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/5/A\"><num value=\"A\">(A)</num><content> Notwithstanding any other provision of this subchapter, of the funds received by a State attributable to funds appropriated under subsection (a)(1), and paragraphs (1) and (2) of subsection (b), of <ref href=\"/us/usc/t42/s3023\">section 3023 of this title</ref>, the State may elect to transfer not more than 30 percent for any fiscal year between programs under part B and part C, for use as the State considers appropriate. The State shall notify the Assistant Secretary of any such election.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267ab-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/5/B\"><num value=\"B\">(B)</num><content> At a minimum, the notification described in subparagraph (A) shall include a description of the amount to be transferred, the purposes of the transfer, the need for the transfer, and the impact of the transfer on the provision of services from which the funding will be transferred.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267ac-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/6\"><num value=\"6\">(6)</num><content> A State agency may not delegate to an area agency on aging or any other entity the authority to make a transfer under paragraph (4)(A) or (5)(A).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267ad-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7\"><num value=\"7\">(7)</num><chapeau> The Assistant Secretary shall annually collect, and include in the report required by <ref href=\"/us/usc/t42/s3018/a\">section 3018(a) of this title</ref>, data regarding the transfers described in paragraphs (4)(A) and (5)(A), including—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267ae-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/A\"><num value=\"A\">(A)</num><content> the amount of funds involved in the transfers, analyzed by State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267af-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/B\"><num value=\"B\">(B)</num><content> the rationales for the transfers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267b0-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/C\"><num value=\"C\">(C)</num><chapeau> in the case of transfers described in paragraphs (4)(A) and (5)(A), the effect of the transfers of the provision of services, including the effect on the number of meals served, under—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf3267b1-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/C/i\"><num value=\"i\">(i)</num><content> subpart I of part C; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf3267b2-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/C/ii\"><num value=\"ii\">(ii)</num><content> subpart II of part C; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267b3-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/D\"><num value=\"D\">(D)</num><chapeau> in the case of transfers described in paragraph (5)(A)—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf3267b4-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/D/i\"><num value=\"i\">(i)</num><content> in the case of transfers to part B, information on the supportive services, or services provided through senior centers, for which the transfers were used; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"iddf3267b5-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/D/ii\"><num value=\"ii\">(ii)</num><chapeau> the effect of the transfers on the provision of services provided under—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"iddf3267b6-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/D/ii/I\"><num value=\"I\">(I)</num><content> part B; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"iddf3267b7-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/7/D/ii/II\"><num value=\"II\">(II)</num><content> part C, including the effect on the number of meals served.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"iddf3267b8-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/8\"><num value=\"8\">(8)</num><chapeau> The Assistant Secretary shall review the reports submitted under <ref href=\"/us/usc/t42/s3027/a/30\">section 3027(a)(30) of this title</ref> and include aggregate data in the report required by <ref href=\"/us/usc/t42/s3018/a\">section 3018(a) of this title</ref>, including data on—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"iddf3267b9-75c9-11ea-ab93-c45e2e133810\" identifier=\"/us/usc/t42/s3028/b/8/A\"><num value=\"A\">(A)</num><content> the effectiveness of the programs, policies, and services provided by area agencies on aging in assisting older individuals whose needs were the focus of all centers funded under subchapter IV in fiscal year 2019;
