L. 96–88, title V, § 509(b), Oct. 17, 1979, 93 Stat. 695.)","seq_in_title":1491,"parent_identifier":"/us/usc/t42/ch7/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GRANTS TO STATES FOR OLD-AGE ASSISTANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id89416bb9-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s304\"><num value=\"304\">§ 304.</num><heading> Stopping payment on deviation from required provisions of plan or failure to comply therewith</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the case of any State plan which has been approved under this subchapter by the Secretary, if the Secretary, after reasonable notice and opportunity for hearing to the State agency administering or supervising the administration of such plan, finds—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id894192ca-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s304/1\"><num value=\"1\">(1)</num><content> that the plan has been so changed as to impose any age, residence, or citizenship requirement prohibited by <ref href=\"/us/usc/t42/s302/b\">section 302(b) of this title</ref>, or that in the administration of the plan any such prohibited requirement is imposed, with the knowledge of such State agency, in a substantial number of cases; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id894192cb-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s304/2\"><num value=\"2\">(2)</num><content> that in the administration of the plan there is a failure to comply substantially with any provision required by <ref href=\"/us/usc/t42/s302/a\">section 302(a) of this title</ref> to be included in the plan;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">the Secretary shall notify such State agency that further payments will not be made to the State (or, in his discretion, that payments will be limited to categories under or parts of the State plan not affected by such failure) until the Secretary is satisfied that such prohibited requirement is no longer so imposed, and that there is no longer any such failure to comply. L. 90–248</ref> inserted “(or, in his discretion, that payments will be limited to categories under or parts of the State plan not affected by such failure)” after “further payments will not be made to the State” and substituted in last sentence “further payments to such State (or shall limit payments to categories under or parts of the State plan not affected by such failure)” for “further certification to the Secretary of the Treasury with respect to such State”.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">1960—<ref href=\"/us/pl/86/778\">Pub.
