<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaad27a74-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149"><num value="3149">§ 3149.</num><heading> Grants for economic adjustment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaad27a75-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">On the application of an eligible recipient, the Secretary may make grants for development of public facilities, public services, business development (including funding of a revolving loan fund), planning, technical assistance, training, and any other assistance to alleviate long-term economic deterioration and sudden and severe economic dislocation and further the economic adjustment objectives of this subchapter.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaad27a76-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/b"><num value="b" class="bold">(b)</num><heading class="bold"> Criteria for assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may provide assistance under this section only if the Secretary determines that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaad27a77-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/b/1"><num value="1">(1)</num><chapeau> the project will help the area to meet a special need arising from—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaad27a78-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/b/1/A"><num value="A">(A)</num><content> actual or threatened severe unemployment; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaad27a79-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/b/1/B"><num value="B">(B)</num><content> economic adjustment problems resulting from severe changes in economic conditions; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaad27a7a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/b/2"><num value="2">(2)</num><content> the area for which a project is to be carried out has a comprehensive economic development strategy and the project is consistent with the strategy, except that this paragraph shall not apply to planning projects.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaad27a7b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c"><num value="c" class="bold">(c)</num><heading class="bold"> Particular community assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">Assistance under this section may include assistance provided for activities identified by communities, the economies of which are injured by—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaad2a18c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c/1"><num value="1">(1)</num><content> military base closures or realignments, defense contractor reductions in force, or Department of Energy defense-related funding reductions, for help in diversifying their economies through projects to be carried out on Federal Government installations or elsewhere in the communities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaad2a18d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c/2"><num value="2">(2)</num><content> disasters or emergencies, in areas with respect to which a major disaster or emergency has been declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121">42 U.S.C. 5121</ref> et seq.), for post-disaster economic recovery;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaad2a18e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c/3"><num value="3">(3)</num><content> international trade, for help in economic restructuring of the communities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaad2a18f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c/4"><num value="4">(4)</num><content> fishery failures, in areas with respect to which a determination that there is a commercial fishery failure has been made under <ref href="/us/usc/t16/s1861a/a">section 1861a(a) of title 16</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaad2a190-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/c/5"><num value="5">(5)</num><content> the loss of manufacturing jobs, for reinvesting in and diversifying the economies of the communities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaad2a191-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d"><num value="d" class="bold">(d)</num><heading class="bold"> Special provisions relating to revolving loan fund grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaad2a192-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall promulgate regulations to maintain the proper operation and financial integrity of revolving loan funds established by recipients with assistance under this section.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaad2a193-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Efficient administration</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaad2a194-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/2/A"><num value="A">(A)</num><content> at the request of a grantee, amend and consolidate grant agreements governing revolving loan funds to provide flexibility with respect to lending areas and borrower criteria;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaad2a195-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/2/B"><num value="B">(B)</num><content> assign or transfer assets of a revolving loan fund to third party for the purpose of liquidation, and the third party may retain assets of the fund to defray costs related to liquidation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaad2a196-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/2/C"><num value="C">(C)</num><content> take such actions as are appropriate to enable revolving loan fund operators to sell or securitize loans (except that the actions may not include issuance of a Federal guaranty by the Secretary).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaad2a197-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Treatment of actions</heading><content><p style="-uslm-lc:I12" class="indent1">An action taken by the Secretary under this subsection with respect to a revolving loan fund shall not constitute a new obligation if all grant funds associated with the original grant award have been disbursed to the recipient.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idaad2a198-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Preservation of securities laws</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaad2a199-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Not treated as exempted securities</heading><content><p style="-uslm-lc:I13" class="indent2">No securities issued pursuant to paragraph (2)(C) shall be treated as exempted securities for purposes of the Securities Act of 1933 (<ref href="/us/usc/t15/s77a">15 U.S.C. 77a</ref> et seq.) or the Securities Exchange Act of 1934 (<ref href="/us/usc/t15/s78a">15 U.S.C. 78a</ref> et seq.), unless exempted by rule or regulation of the Securities and Exchange Commission.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idaad2a19a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/d/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Preservation</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (A), no provision of this subsection or any regulation promulgated by the Secretary under this subsection supersedes or otherwise affects the application of the securities laws (as the term is defined in section 3(a) of the Securities Exchange Act of 1934 (<ref href="/us/usc/t15/s78c/a">15 U.S.C. 78c(a)</ref>)) or the rules, regulations, or orders of the Securities and Exchange Commission or a self-regulatory organization under that Commission.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaad2a19b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s3149/e"><num value="e" class="bold">(e)</num><heading class="bold"> Disaster mitigation</heading><content><p style="-uslm-lc:I11" class="indent0">In providing assistance pursuant to subsection (c)(2), if appropriate and as applicable, the Secretary may encourage hazard mitigation in assistance provided pursuant to such subsection.</p>
