A, title I, § 1501(a), Oct. 1, 2009, 123 Stat. 2041.)","seq_in_title":3503,"parent_identifier":"/us/usc/t42/ch38/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38","level":"chapter","num":"CHAPTER 38—","heading":"PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"GRANTS FOR PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaad2c8b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151\"><num value=\"3151\">§ 3151.</num><heading> Use of funds in projects constructed under projected cost</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad2c8b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the case of a grant to a recipient for a construction project under section 3141 or 3149 of this title, if the Secretary determines, before closeout of the project, that the cost of the project, based on the designs and specifications that were the basis of the grant, has decreased because of decreases in costs, the Secretary may approve, without further appropriation, the use of the excess funds (or a portion of the excess funds) by the recipient—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad2c8ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/a/1\"><num value=\"1\">(1)</num><content> to increase the Federal share of the cost of a project under this title to the maximum percentage allowable under <ref href=\"/us/usc/t42/s3144\">section 3144 of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad2c8bb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/a/2\"><num value=\"2\">(2)</num><content> to improve the project.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad2c8bc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Other uses of excess funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any amount of excess funds remaining after application of subsection (a) may be used by the Secretary for providing assistance under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad2c8bd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Transferred funds</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In the case of excess funds described in subsection (a) in projects using funds transferred from other Federal agencies pursuant to <ref href=\"/us/usc/t42/s3214\">section 3214 of this title</ref>, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad2efce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/c/1\"><num value=\"1\">(1)</num><content> use the funds in accordance with subsection (a), with the approval of the originating agency; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad2efcf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3151/c/2\"><num value=\"2\">(2)</num><content> return the funds to the originating agency.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaad2efd0-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/136/tII/s211\">Pub.
