value=\"3154a\">§ 3154a.</num><heading> Performance awards</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad316fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may make a performance award in connection with a grant made, on or after <date date=\"2004-10-27\">October 27, 2004</date>, to an eligible recipient for a project under section 3141 or 3149 of this title.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad316fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Performance measures</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad316fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall promulgate regulations to establish performance measures for making performance awards under subsection (a).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad316fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Considerations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In promulgating regulations under paragraph (1), the Secretary shall consider the inclusion of performance measures that assess—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad316ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/2/A\"><num value=\"A\">(A)</num><content> whether the recipient meets or exceeds scheduling goals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad31700-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/2/B\"><num value=\"B\">(B)</num><content> whether the recipient meets or exceeds job creation goals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad31701-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/2/C\"><num value=\"C\">(C)</num><content> amounts of private sector capital investments leveraged; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad31702-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/b/2/D\"><num value=\"D\">(D)</num><content> such other factors as the Secretary determines to be appropriate.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad31703-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Amount of awards</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad31704-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall base the amount of a performance award made under subsection (a) in connection with a grant on the extent to which a recipient meets or exceeds performance measures established in connection with the grant.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad31705-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Maximum amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of a performance award may not exceed 10 percent of the amount of the grant.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad31706-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Use of awards</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A recipient of a performance award under subsection (a) may use the award for any eligible purpose under this chapter, in accordance with <ref href=\"/us/usc/t42/s3212\">section 3212 of this title</ref> and such regulations as the Secretary may promulgate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad31707-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Federal share</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding <ref href=\"/us/usc/t42/s3144\">section 3144 of this title</ref>, the funds of a performance award may be used to pay up to 100 percent of the cost of an eligible project or activity.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad31708-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Treatment in meeting non-Federal share requirements</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For the purposes of meeting the non-Federal share requirements under this, or any other, Act the funds of a performance award shall be treated as funds from a non-Federal source.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad33e19-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Terms and conditions</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In making performance awards under subsection (a), the Secretary shall establish such terms and conditions as the Secretary considers to be appropriate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad33e1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Funding</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall use any amounts made available for economic development assistance programs to carry out this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad33e1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Reporting requirement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall include information regarding performance awards made under this section in the annual report required under <ref href=\"/us/usc/t42/s3213\">section 3213 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad33e1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Review by Comptroller General</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad33e1d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/j/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Review</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Comptroller General shall regularly review the implementation of this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad33e1e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154a/j/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 1 year after <date date=\"2004-10-27\">October 27, 2004</date>, the Comptroller General shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the findings of the Comptroller on implementation of this
