L. 108–373, title II, § 213(a), Oct. 27, 2004, 118 Stat. 1766.)","seq_in_title":3510,"parent_identifier":"/us/usc/t42/ch38/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38","level":"chapter","num":"CHAPTER 38—","heading":"PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"GRANTS FOR PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaad36542-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d\"><num value=\"3154d\">§ 3154d.</num><heading> Brightfields demonstration program</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad36543-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definition of brightfield site</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this section, the term “brightfield site” means a brownfield site that is redeveloped through the incorporation of 1 or more solar energy technologies.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad36544-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Demonstration program</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">On the application of an eligible recipient, the Secretary may make a grant for a project for the development of a brightfield site if the Secretary determines that the project will—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad36545-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/b/1\"><num value=\"1\">(1)</num><content> use 1 or more solar energy technologies to develop abandoned or contaminated sites for commercial use; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad36546-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/b/2\"><num value=\"2\">(2)</num><content> improve the commercial and economic opportunities in the area in which the project is located.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad36547-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Savings clause</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">To the extent that any portion of a grant awarded under subsection (b) involves remediation, the remediation shall be subject to <ref href=\"/us/usc/t42/s3222\">section 3222 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad36548-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3154d/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2004 through 2008, to remain available until expended.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idaad36549-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/136/tII/s218\">Pub.
