L. 116–192, § 2, Oct. 30, 2020, 134 Stat. 978.)","seq_in_title":3525,"parent_identifier":"/us/usc/t42/ch38/schVI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38","level":"chapter","num":"CHAPTER 38—","heading":"PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38/schVI","level":"subchapter","num":"SUBCHAPTER VI—","heading":"MISCELLANEOUS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idda395847-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211\"><num value=\"3211\">§ 3211.</num><heading> Powers of Secretary</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idda395848-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the duties of the Secretary under this chapter, the Secretary may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda395849-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/1\"><num value=\"1\">(1)</num><content> adopt, alter, and use a seal, which shall be judicially noticed;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39584a-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/2\"><num value=\"2\">(2)</num><content> subject to the civil service and classification laws, select, employ, appoint, and fix the compensation of such personnel as are necessary to carry out this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39584b-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/3\"><num value=\"3\">(3)</num><content> hold such hearings, sit and act at such times and places, and take such testimony, as the Secretary determines to be appropriate;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39584c-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/4\"><num value=\"4\">(4)</num><content> request directly, from any Federal agency, board, commission, office, or independent establishment, such information, suggestions, estimates, and statistics as the Secretary determines to be necessary to carry out this chapter (and each Federal agency, board, commission, office, or independent establishment may provide such information, suggestions, estimates, and statistics directly to the Secretary);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda397f5d-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/5\"><num value=\"5\">(5)</num><chapeau> under regulations promulgated by the Secretary—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda397f5e-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/5/A\"><num value=\"A\">(A)</num><content> assign or sell at public or private sale, or otherwise dispose of for cash or credit, in the Secretary’s discretion and on such terms and conditions and for such consideration as the Secretary determines to be reasonable, any evidence of debt, contract, claim, personal property, or security assigned to or held by the Secretary in connection with assistance provided under this chapter; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda397f5f-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/5/B\"><num value=\"B\">(B)</num><content> collect or compromise all obligations assigned to or held by the Secretary in connection with that assistance until such time as the obligations are referred to the Attorney General for suit or collection;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39a570-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/6\"><num value=\"6\">(6)</num><content> deal with, complete, renovate, improve, modernize, insure, rent, or sell for cash or credit, on such terms and conditions and for such consideration as the Secretary determines to be reasonable, any real or personal property conveyed to or otherwise acquired by the Secretary in connection with assistance provided under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39a571-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/7\"><num value=\"7\">(7)</num><content> pursue to final collection, by means of compromise or other administrative action, before referral to the Attorney General, all claims against third parties assigned to the Secretary in connection with assistance provided under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39a572-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/8\"><num value=\"8\">(8)</num><content> acquire, in any lawful manner, any property (real, personal, or mixed, tangible or intangible), to the extent appropriate in connection with assistance provided under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39cc83-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/9\"><num value=\"9\">(9)</num><content> in addition to any powers, functions, privileges, and immunities otherwise vested in the Secretary, take any action, including the procurement of the services of attorneys by contract, determined by the Secretary to be necessary or desirable in making, purchasing, servicing, compromising, modifying, liquidating, or otherwise administratively dealing with assets held in connection with financial assistance provided under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39cc84-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/10\"><num value=\"10\">(10)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39cc85-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/10/A\"><num value=\"A\">(A)</num><content> employ experts and consultants or organizations as authorized by <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref> except that contracts for such employment may be renewed annually;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39cc86-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/10/B\"><num value=\"B\">(B)</num><content> compensate individuals so employed, including compensation for travel time; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39cc87-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/10/C\"><num value=\"C\">(C)</num><content> allow individuals so employed, while away from their homes or regular places of business, travel expenses, including per diem in lieu of subsistence, as authorized by <ref href=\"/us/usc/t5/s5703\">section 5703 of title 5</ref> for persons employed intermittently in the Federal Government service;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39f398-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/11\"><num value=\"11\">(11)</num><chapeau> establish performance measures for grants and other assistance provided under this chapter, and use the performance measures to evaluate the economic impact of economic development assistance programs under this chapter, which establishment and use of performance measures shall be provided by the Secretary through—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda39f399-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/11/A\"><num value=\"A\">(A)</num><content> officers or employees of the Department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda39f39a-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/11/B\"><num value=\"B\">(B)</num><content> the employment of persons under contracts entered into for such purposes; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda39f39b-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/11/C\"><num value=\"C\">(C)</num><content> grants to persons, using funds made available to carry out this chapter;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda39f39c-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/12\"><num value=\"12\">(12)</num><content> conduct environmental reviews and incur necessary expenses to evaluate and monitor the environmental impact of economic development assistance provided and proposed to be provided under this chapter, including expenses associated with the representation and defense of the actions of the Secretary relating to the environmental impact of the assistance, using any funds made available to carry out <ref href=\"/us/usc/t42/s3147\">section 3147 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda3a1aad-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/13\"><num value=\"13\">(13)</num><content> sue and be sued in any court of record of a State having general jurisdiction or in any United States district court, except that no attachment, injunction, garnishment, or other similar process, mesne or final, shall be issued against the Secretary or the property of the Secretary; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idda3a1aae-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/a/14\"><num value=\"14\">(14)</num><content> establish such rules, regulations, and procedures as the Secretary considers appropriate for carrying out this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idda3a1aaf-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Deficiency judgments</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The authority under subsection (a)(7) to pursue claims shall include the authority to obtain deficiency judgments or otherwise pursue claims relating to mortgages assigned to the Secretary.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idda3a41c0-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Inapplicability of certain other requirements</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\"><ref href=\"/us/usc/t41/s6101\">Section 6101 of title 41</ref> shall not apply to any contract of hazard insurance or to any purchase or contract for services or supplies on account of property obtained by the Secretary as a result of assistance provided under this chapter if the premium for the insurance or the amount of the services or supplies does not exceed $1,000.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idda3a41c1-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Property interests</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idda3a41c2-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The powers of the Secretary under this section, relating to property acquired by the Secretary in connection with assistance provided under this chapter, shall extend to property interests of the Secretary relating to projects approved under—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda3a41c3-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/1/A\"><num value=\"A\">(A)</num><content> this chapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda3a41c4-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/1/B\"><num value=\"B\">(B)</num><content> title I of the Public Works Employment Act of 1976 (<ref href=\"/us/usc/t42/s6701\">42 U.S.C. 6701</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda3a68d5-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/1/C\"><num value=\"C\">(C)</num><content> title II of the Trade Act of 1974 (<ref href=\"/us/usc/t19/s2251\">19 U.S.C. 2251</ref> et seq.); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idda3a68d6-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/1/D\"><num value=\"D\">(D)</num><content> the Community Emergency Drought Relief Act of 1977 (<ref href=\"/us/usc/t42/s5184\">42 U.S.C. 5184</ref> note; <ref href=\"/us/pl/95/31\">Public Law 95–31</ref>).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idda3a68d7-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Release</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idda3a68d8-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), the Secretary may release, in whole or in part, any real property interest, or tangible personal property interest, in connection with a grant after the date that is 20 years after the date on which the grant was awarded.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idda3a68d9-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Certain releases</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idda3a68da-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">On written request from a recipient of a grant under <ref href=\"/us/usc/t42/s3149/d\">section 3149(d) of this title</ref>, the Secretary shall release, in accordance with this subparagraph, any Federal interest in connection with the grant, if—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idda3a68db-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/i/I\"><num value=\"I\">(I)</num><content> the request is made not less than 7 years after the final disbursement of the original grant;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idda3a8fec-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/i/II\"><num value=\"II\">(II)</num><content> the recipient has complied with the terms and conditions of the grant to the satisfaction of the Secretary;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idda3a8fed-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/i/III\"><num value=\"III\">(III)</num><content> any proceeds realized from the grant will be used for 1 or more activities that continue to carry out the economic development purposes of this chapter; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idda3a8fee-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/i/IV\"><num value=\"IV\">(IV)</num><content> the recipient includes in the written request a description of how the recipient will use the proceeds of the grant in accordance with subclause (III).</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idda3a8fef-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Deadline</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idda3a8ff0-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/ii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Except as provided in subclause (II), the Secretary shall complete all closeout actions for the grant by not later than 180 days after receipt and acceptance of the written request under clause (i).</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idda3a8ff1-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/ii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Extension</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The Secretary may extend a deadline under subclause (I) by an additional 180 days if the Secretary determines the extension to be necessary.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idda3ab702-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/d/2/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Savings provision</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\"><ref href=\"/us/usc/t42/s3212\">Section 3212 of this title</ref> shall continue to apply to a project assisted with a grant under <ref href=\"/us/usc/t42/s3149/d\">section 3149(d) of this title</ref> regardless of whether the Secretary releases a Federal interest under clause (i).</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idda3ab703-2357-11eb-b315-8d9d3537db2b\" identifier=\"/us/usc/t42/s3211/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Powers of conveyance and execution</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The power to convey and to execute, in the name of the Secretary, deeds of conveyance, deeds of release, assignments and satisfactions of mortgages, and any other written instrument relating to real or personal property or any interest in such property acquired by the Secretary under this chapter may be exercised by the Secretary, or by any officer or agent appointed by the Secretary for that purpose, without the execution of any express delegation of power or power of attorney.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idda3ade14-2357-11eb-b315-8d9d3537db2b\">(<ref href=\"/us/pl/89/136/tVI/s601\">Pub.
