L. 105–393, title I, § 102(a), Nov. 13, 1998, 112 Stat. 3614.)","seq_in_title":3528,"parent_identifier":"/us/usc/t42/ch38/schVI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38","level":"chapter","num":"CHAPTER 38—","heading":"PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38/schVI","level":"subchapter","num":"SUBCHAPTER VI—","heading":"MISCELLANEOUS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaad4eba9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214\"><num value=\"3214\">§ 3214.</num><heading> Delegation of functions and transfer of funds among Federal agencies</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad4ebaa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Delegation of functions to other Federal agencies</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad4ebab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/a/1\"><num value=\"1\">(1)</num><content> delegate to the heads of other Federal agencies such functions, powers, and duties of the Secretary under this chapter as the Secretary determines to be appropriate; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad4ebac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/a/2\"><num value=\"2\">(2)</num><content> authorize the redelegation of the functions, powers, and duties by the heads of the agencies.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad4ebad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Transfer of funds to other Federal agencies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Funds authorized to be appropriated to carry out this chapter may be transferred between Federal agencies, if the funds are used for the purposes for which the funds are specifically authorized and appropriated.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad4ebae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Transfer of funds from other Federal agencies</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad4ebaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Subject to paragraph (2), for the purposes of this chapter, the Secretary may accept transfers of funds from other Federal agencies if the funds are used for the purposes for which (and in accordance with the terms under which) the funds are specifically authorized and appropriated.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaad4ebb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Use of funds</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The transferred funds—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad4ebb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/c/2/A\"><num value=\"A\">(A)</num><content> shall remain available until expended; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaad4ebb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3214/c/2/B\"><num value=\"B\">(B)</num><content> may, to the extent necessary to carry out this chapter, be transferred to and merged by the Secretary with the appropriations for salaries and expenses.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaad4ebb3-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/136/tVI/s604\">Pub.
