L. 105–393, title I, § 102(a), Nov. 13, 1998, 112 Stat. 3615.)","seq_in_title":3530,"parent_identifier":"/us/usc/t42/ch38/schVI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38","level":"chapter","num":"CHAPTER 38—","heading":"PUBLIC WORKS AND ECONOMIC DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch38/schVI","level":"subchapter","num":"SUBCHAPTER VI—","heading":"MISCELLANEOUS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8d46522f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3216\"><num value=\"3216\">§ 3216.</num><heading> Employment of expediters and administrative employees</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Assistance shall not be provided by the Secretary under this chapter to any business unless the owners, partners, or officers of the business—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d465230-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3216/1\"><num value=\"1\">(1)</num><content> certify to the Secretary the names of any attorneys, agents, and other persons engaged by or on behalf of the business for the purpose of expediting applications made to the Secretary for assistance of any kind, under this chapter, and the fees paid or to be paid to the person for expediting the applications; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d465231-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3216/2\"><num value=\"2\">(2)</num><chapeau> execute an agreement binding the business, for the 2-year period beginning on the date on which the assistance is provided by the Secretary to the business, to refrain from employing, offering any office or employment to, or retaining for professional services, any person who, on the date on which the assistance or any part of the assistance was provided, or within the 1-year period ending on that date—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8d465232-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3216/2/A\"><num value=\"A\">(A)</num><content> served as an officer, attorney, agent, or employee of the Department; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8d465233-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3216/2/B\"><num value=\"B\">(B)</num><content> occupied a position or engaged in activities that the Secretary determines involved discretion with respect to the granting of assistance under this chapter.</content>\n</subparagraph>\n</paragraph>\n<sourceCredit id=\"id8d465234-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/89/136/tVI/s606\">Pub.
