L. 90–448, title VI, § 602(d), Aug. 1, 1968, 82 Stat. 532.)","seq_in_title":3553,"parent_identifier":"/us/usc/t42/ch41/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch41","level":"chapter","num":"CHAPTER 41—","heading":"DEMONSTRATION CITIES AND METROPOLITAN DEVELOPMENT PROGRAM","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch41/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"PLANNED AREAWIDE DEVELOPMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaad69916-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335\"><num value=\"3335\">§ 3335.</num><heading> Grants to assist in planned areawide development</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad69917-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Supplementary grants</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to make supplementary grants to applicant State and local public bodies and agencies carrying out, or assisting in carrying out, areawide development projects meeting the requirements of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad69918-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Criteria</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Grants may be made under this section only for areawide development projects in areas for which it has been demonstrated, to the satisfaction of the Secretary, that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad69919-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/b/1\"><num value=\"1\">(1)</num><content> areawide comprehensive planning and programing provide an adequate basis for evaluating (A) the location, financing, and scheduling of individual public facility proj­ects (including but not limited to hospitals and libraries; sewer, water, and sewage treatment facilities; highway, mass transit, airport, and other transportation facilities; and recreation and other open-space areas) whether or not federally assisted; and (B) other proposed land development or uses, which projects or uses, because of their size, density, type, or location, have public areawide or interjurisdictional significance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad6991a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/b/2\"><num value=\"2\">(2)</num><content> adequate areawide institutional or other arrangements exist for coordinating, on the basis of such areawide comprehensive planning and programing, local public policies and activities affecting the development of the area; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaad6991b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/b/3\"><num value=\"3\">(3)</num><content> public facility projects and other land development or uses which have a major impact on the development of the area are, in fact, being carried out in accord with such areawide comprehensive planning and programing.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad6991c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Grant to unit of general local government or other applicant</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaad6991d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/c/1\"><num value=\"1\">(1)</num><content> Where the applicant for a grant under this section is a unit of general local government, it must demonstrate to the satisfaction of the Secretary that, taking into consideration the scope of its authority and responsibilities, it is adequately assuring that public facility proj­ects and other land development or uses of public areawide or interjurisdictional significance are being, and will be, carried out in accord with areawide planning and programing meeting the requirements of subsection (b). In making this determination the Secretary shall give special consideration to whether the applicant is effectively assisting in, and conforming to, areawide planning and programing through (A) the location and scheduling of public facility projects, whether or not federally assisted; and (B) where appropriate, the establishment and consistent administration of zoning codes, subdivision regulations, and similar land-use and density controls.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idaad6991e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/c/2\"><num value=\"2\">(2)</num><content> Where the applicant for a grant under this section is not a unit of general local government, both it and the unit of general local government having jurisdiction over the location of the project must meet the requirements of this subsection.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad6991f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Secretary’s consideration of comments of State bodies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In making the determinations required under this section, the Secretary shall obtain, and give full consideration to, the comments of the body or bodies (State or local) responsible for comprehensive planning and programing for the area.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad69920-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Restriction on grants to certain areawide development projects</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No grant shall be made under this section with respect to an areawide development project for which a Federal grant has been made, or a contract of assistance has been entered into, under the legislation referred to in paragraph (2) of <ref href=\"/us/usc/t42/s3338\">section 3338 of this title</ref>, prior to <date date=\"1966-02-21\">February 21, 1966</date>, or more than one year prior to the date on which the Secretary has made the determinations required under this section with respect to the applicant and to the area in which the project is located: <i>Provided</i>, That in the case of a project for which a contract of assistance under the legislation referred to in paragraph (2) of <ref href=\"/us/usc/t42/s3338\">section 3338 of this title</ref> has been entered into after <date date=\"1967-06-30\">June 30, 1967</date>, no grant shall be made under this section unless an application for such grant has been made on or before the date of such contract.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaad6c031-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s3335/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Racial balance or imbalance within school districts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall authorize the Secretary to require (or condition the availability or amount of financial assistance authorized to be provided under this subchapter upon) the adoption by any community of a program to achieve a racial balance or to eliminate racial imbalance within school districts.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idaad6c032-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/754/tII/s205\">Pub.
