style=\"-uslm-lc:I80\" id=\"id8d5ac4ec-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602\"><num value=\"3602\">§ 3602.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this subchapter—</chapeau><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4ed-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/a\"><num value=\"a\">(a)</num><content> “Secretary” means the Secretary of Housing and Urban Development.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4ee-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/b\"><num value=\"b\">(b)</num><content> “Dwelling” means any building, structure, or portion thereof which is occupied as, or designed or intended for occupancy as, a residence by one or more families, and any vacant land which is offered for sale or lease for the construction or location thereon of any such building, structure, or portion thereof.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4ef-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/c\"><num value=\"c\">(c)</num><content> “Family” includes a single individual.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f0-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/d\"><num value=\"d\">(d)</num><content> “Person” includes one or more individuals, corporations, partnerships, associations, labor organizations, legal representatives, mutual companies, joint-stock companies, trusts, unincorporated organizations, trustees, trustees in cases under title 11, receivers, and fiduciaries.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f1-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/e\"><num value=\"e\">(e)</num><content> “To rent” includes to lease, to sublease, to let and otherwise to grant for a consideration the right to occupy premises not owned by the occupant.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f2-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/f\"><num value=\"f\">(f)</num><content> “Discriminatory housing practice” means an act that is unlawful under section 3604, 3605, 3606, or 3617 of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f3-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/g\"><num value=\"g\">(g)</num><content> “State” means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, or any of the territories and possessions of the United States.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f4-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/h\"><num value=\"h\">(h)</num><chapeau> “Handicap” means, with respect to a person—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5ac4f5-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/h/1\"><num value=\"1\">(1)</num><content> a physical or mental impairment which substantially limits one or more of such person’s major life activities,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5ac4f6-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/h/2\"><num value=\"2\">(2)</num><content> a record of having such an impairment, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5ac4f7-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/h/3\"><num value=\"3\">(3)</num><content> being regarded as having such an impairment,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">but such term does not include current, illegal use of or addiction to a controlled substance (as defined in <ref href=\"/us/usc/t21/s802\">section 802 of title 21</ref>).</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5ac4f8-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/i\"><num value=\"i\">(i)</num><chapeau> “Aggrieved person” includes any person who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec09-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/i/1\"><num value=\"1\">(1)</num><content> claims to have been injured by a discriminatory housing practice; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec0a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/i/2\"><num value=\"2\">(2)</num><content> believes that such person will be injured by a discriminatory housing practice that is about to occur.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec0b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/j\"><num value=\"j\">(j)</num><content> “Complainant” means the person (including the Secretary) who files a complaint under <ref href=\"/us/usc/t42/s3610\">section 3610 of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec0c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/k\"><num value=\"k\">(k)</num><chapeau> “Familial status” means one or more individuals (who have not attained the age of 18 years) being domiciled with—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec0d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/k/1\"><num value=\"1\">(1)</num><content> a parent or another person having legal custody of such individual or individuals; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec0e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/k/2\"><num value=\"2\">(2)</num><content> the designee of such parent or other person having such custody, with the written permission of such parent or other person.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The protections afforded against discrimination on the basis of familial status shall apply to any person who is pregnant or is in the process of securing legal custody of any individual who has not attained the age of 18 years.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec0f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/l\"><num value=\"l\">(l)</num><content> “Conciliation” means the attempted resolution of issues raised by a complaint, or by the investigation of such complaint, through informal negotiations involving the aggrieved person, the respondent, and the Secretary.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec10-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/m\"><num value=\"m\">(m)</num><content> “Conciliation agreement” means a written agreement setting forth the resolution of the issues in conciliation.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec11-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/n\"><num value=\"n\">(n)</num><chapeau> “Respondent” means—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec12-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/n/1\"><num value=\"1\">(1)</num><content> the person or other entity accused in a complaint of an unfair housing practice; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8d5aec13-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/n/2\"><num value=\"2\">(2)</num><content> any other person or entity identified in the course of investigation and notified as required with respect to respondents so identified under <ref href=\"/us/usc/t42/s3610/a\">section 3610(a) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8d5aec14-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s3602/o\"><num value=\"o\">(o)</num><content> “Prevailing party” has the same meaning as such term has in <ref href=\"/us/usc/t42/s1988\">section 1988 of this title</ref>.</content>\n</subsection>\n<sourceCredit
